The biggest factor of why Seniors  are losing more and more benefits. They are getting blamed for the country going broke.

Saddled with a corporate media that marches in lockstep with the government, elected officials who dance to the tune of their corporate benefactors, and a court system that serves to maintain order rather than mete out justice, Americans often feel as if they have no voice, no authority and no recourse when it comes to holding government officials accountable and combating rampant corruption and injustice.

We’re impotent in the face of SWAT teams that break down doors and leave toddlers scarred for life. We’re helpless to prevent police shootings that leave unarmed citizens dead for no other reason than the police officer involved felt “threatened.” We shrug dismissively over the plight of fellow citizens who have their heads cracked, their bodies broken and their rights violated for failing to jump to attention when a police officer issues an order. And we fail to care about the thousands of individuals who have been punished with extreme sentences for nonviolent offenses and are forced to spend their lives as modern-day slaves in bondage to private prisons and the profit-driven corporations they serve.

Make no mistake about it: virtually anything and everything is a crime nowadays (feeding the birds, growing vegetables in your front yard, etc.) to such an extent that if a prosecutor, police officer and judge were so inclined, you could be locked up for any inane reason.

This is tyranny dressed up in the official garb of the police state. It is the self-righteous, heavy-handed arm of the law being used as a decoy to divert your attention to the so-called criminals in your midst (the fisherman who threw back small fish into the ocean, the mother who let her child walk to the playground alone, the pastor holding Bible studies in his backyard) so that you don’t focus on the criminal behavior being perpetrated by the government (bribery, cronyism, electoral fraud, slush funds, graft, pork, theft, and on and on).

In the face of such abject injustice, outright corruption and overt inequality, it’s hard to feel empowered to believe the average citizen can make a difference. It’s hard to persuade anyone to stand against tyranny when all you can promise them as a reward is persecution, prosecution and a one-way trip to the morgue. And when the outcome seems to be a foregone conclusion—the government always wins—it can seem pointless, even foolhardy, to dare to challenge the system. As such, it’s far easier to buy into the political process, even though elections amount to nothing of consequence.

There are also those who subscribe to the notion that an armed revolution is the only thing that will save America. These armed resistors are making themselves easy targets and will be the first to be taken down by militarized police who are trained to kill and armed to the teeth with every kind of weapon imaginable, from grenade launchers and sniper rifles to armored vehicles and Black Hawk helicopters.

So how do you not only push back against the police state’s bureaucracy, corruption and cruelty but also launch a counterrevolution aimed at reclaiming control over the government using nonviolent means?

You start by changing the rules and engaging in some (nonviolent) guerrilla tactics.

Employ militant nonviolent resistance and civil disobedience, which Martin Luther King Jr. used to great effect through the use of sit-ins, boycotts and marches.
Take part in grassroots activism, which takes a trickle-up approach to governmental reform by implementing change at the local level (in other words, think nationally, but act locally).

And then, while you’re at it, nullify everything the government does that is illegitimate, egregious or blatantly unconstitutional.

Various cities and states have been using this historic doctrine with mixed results on issues as wide ranging as gun control and healthcare to “claim freedom from federal laws they find onerous or wrongheaded.”

Where nullification can be particularly powerful, however, is in the hands of the juror.

As law professor Ilya Somin explains, jury nullification is the practice by which a jury refuses to convict someone accused of a crime if they believe the “law in question is unjust or the punishment is excessive.”

According to former federal prosecutor Paul Butler, the doctrine of jury nullification is “premised on the idea that ordinary citizens, not government officials, should have the final say as to whether a person should be punished.”

Imagine that: a world where the citizenry—not the government or its corporate controllers—actually calls the shots and determines what is just.

In a world of “rampant overcriminalization,” where the average citizen unknowingly breaks three laws a day, jury nullification acts as “a check on runaway authoritarian criminalization and the increasing network of confusing laws that are passed with neither the approval nor oftentimes even the knowledge of the citizenry.”

Indeed, Butler believes so strongly in the power of nullification to balance the scales between the power of the prosecutor and the power of the people that he advises:

If you are ever on a jury in a marijuana case, I recommend that you vote “not guilty” — even if you think the defendant actually smoked pot, or sold it to another consenting adult. As a juror, you have this power under the Bill of Rights; if you exercise it, you become part of a proud tradition of American jurors who helped make our laws fairer.

In other words, it’s “we the people” who can and should be determining what laws are just, what activities are criminal and who can be jailed for what crimes.

Not only should the punishment fit the crime, but the laws of the land should also reflect the concerns of the citizenry as opposed to the profit-driven priorities of Corporate America.

Unfortunately, for thousands of Americans who are serving life sentences for nonviolent crimes as a result of harsh mandatory sentencing laws passed by “tough on crime” politicians, the punishment rarely fits the crime.

As I point out in my book Battlefield America: The War on the American People, with every ill inflicted upon us by the American police state, from overcriminalization and surveillance to militarized police and private prisons, it’s money that drives the police state. And there is a lot of money to be made from criminalizing nonviolent activities and jailing Americans for nonviolent offenses.

This is where the power of jury nullification is so critical: to reject inane laws and extreme sentences and counteract the edicts of a profit-driven governmental elite that sees nothing wrong with jailing someone for a lifetime for a relatively insignificant crime.

Of course, the powers-that-be don’t want the citizenry to know that it has any power at all.  They would prefer that we remain clueless about the government’s many illicit activities, ignorant about our constitutional rights, and powerless to bring about any real change. Indeed, so determined are they to keep us in the dark about the powers vested in “we the people” that the U.S. Supreme Court ruled in 1895 that jurors had no right during trials to be told about nullification!!!!  Moreover, anyone daring to educate a jury about nullification runs the risk of prosecution. 

Just recently, for example, 56-year-old Mark Lannicelli was charged with seven counts of jury tampering for handing out jury nullification fliers outside a Denver courtroom. Now Lannicelli is not being accused of advocating for or against any case in progress, nor is he charged with targeting any particular members of the jury. Nevertheless, Lannicelli could be sentenced to one to three years in prison because he dared to educate the jurors about an option that no judge or prosecutor ever mentions in court: the right to acquit someone who may be guilty if they also believe that the law is unjust.

Such intimidation tactics proved less successful when used against Julian Heicklen, who was accused of jury tampering for handing out nullifications pamphlets in Manhattan. A federal district court judge found Heicklen not only innocent of the charge of jury tampering, but went so far as to warn that the law—18 U.S.C. § 1504—raises significant First Amendment concerns (“the First Amendment squarely protects speech concerning judicial proceedings and public debate regarding the functioning of the judicial system, so long as that speech does not interfere with the fair and impartial administration of justice”).

Jury nullification has played a significant role in our nation’s history. It was championed early on by John Hancock and John Adams and relied on at various points since then to push back against laws deemed egregious, unjust or simply out of step with the times. Most recently, jury nullification has become a popular tactic to thwart laws that mandate harsh punishments for those convicted of possessing even minimal amounts of marijuana.

For instance, in one case I worked on years ago, a jury refused to convict a 54-year-old man who had been charged with possession of marijuana. Prosecutors claimed that a SWAT team, doing an area-wide land and air sweep, had spotted two marijuana plants growing in the hollow of a dead tree on the man’s 39-acre property. Had the man been found guilty, he would have been sentenced to jail and his 90-year-old mother, blind, deaf and dependent on him for care, would have had to be institutionalized.

In delivering his closing arguments, the prosecutor warned the jury that disagreement with the laws against pot possession and disapproval of police tactics are not valid reasons to nullify a case. Of course, those are exactly the reasons why more Americans should opt for nullification.

In an age in which government officials accused of wrongdoing—police officers, elected officials, etc.—are treated with general leniency, while the average citizen is prosecuted to the full extent of the law, jury nullification is a powerful reminder that, as the Constitution tells us, “we the people” are the government.

For too long we’ve allowed our so-called “representatives” to call the shots. Now it’s time to restore the citizenry to their rightful place in the republic: as the masters, not the servants. Jury nullification is one way of doing so.

The reality with which we must contend is that justice in America is reserved for those who can afford to buy their way out of jail. For the rest of us who are dependent on the “fairness” of the system, there exists a multitude of ways in which justice can and does go wrong every day. Police misconduct. 
Prosecutorial misconduct. 
Judicial bias. 
Inadequate defense. 
Prosecutors who care more about winning a case than seeking justice. 
Judges who care more about what is legal than what is just. Jurors who know nothing of the law and are left to deliberate in the dark about life-and-death decisions. 
And an overwhelming body of laws, statutes and ordinances that render the average American a criminal, no matter how law-abiding they might think themselves.

As I’ve said before, when you go into a courtroom, you’re going up against three adversaries who more often than not are operating off the same playbook: the police, the prosecutor and the judge.

If you’re to have any hope of remaining free—and I use that word loosely—your best bet remains in your fellow citizens.

They may not know what the Constitution says (studies have shown Americans to be abysmally ignorant about their rights), they may not know what the laws are (there are so many on the books that the average American breaks three laws a day without knowing it), and they may not even believe in your innocence, but if you’re lucky, they will have a conscience that speaks louder than the legalistic tones of the prosecutors and the judges and reminds them that justice and fairness go hand in hand.

That’s ultimately what jury nullification is all about: restoring a sense of fairness to our system of justice. It’s the best protection for “we the people” against the oppression and tyranny of the government, and God knows, we can use all the protection we can get.

Most of all, jury nullification is a powerful way to remind the government—all of those bureaucrats who have appointed themselves judge, jury and jailer over all that we are, have and do—that we’re the ones who set the rules.

If they don’t like it, they can get another job.

U.S. stocks traded sharply lower Thursday morning, with the Dow Jones Industrial Average plunging 200 points after oil prices tumbled to near $40 a barrel. The S&P 500 turned negative for the year after all 10 sectors traded lower, led by a 1.5 percent decline in financial stocks.
The losses in financial stocks were fueled by fears that the U.S. Federal Reserve may wait until after September to raise interest rates, a delay due to global growth concerns. Policy makers need more confidence that inflation is moving toward their goal before the Fed will lift rates, minutes released a day earlier from the central bank’s July meeting showed.
The Dow Jones Industrial Average (INDEXDJX:.DJI) tumbled 202.37 points, or 1.17 percent, to 17,146.36. The S&P 500 index (INDEXSP:.INX)  lost 22.07 points, or 1.06 percent, to 2,057.30. And the Nasdaq composite (INDEXNASDAQ:.IXIC) dropped 72.56 points, or 1.44 percent, to 4,945.77.

The Obama administration’s lax immigration policies have allowed a large number of terrorists with documented ties to ISIS and other radical Islamic groups into the United States, including individuals from Yemen, Saudi Arabia, Somalia and Uzbekistan who have been criminally charged in recent years.
Examples include a naturalized U.S. citizen from Somalia (Hinda Osman Dhirane) charged with conspiracy to provide material support to a foreign terrorist organization, a lawful permanent resident (Akhror Saidakhmetov) from Kazakhstan charged with conspiracy to provide material support to Al Qaeda in Iraq, a Yemeni national named Mufid A. Elfgeeh who also supported a foreign terrorist organization, possessed illegal firearms and attempted to kill U.S. government officers and a Syrian national named Mohamad Saeed Kodaimati who knowingly made false, fraudulently and fictitious statements to the FBI.
That’s just a snippet of a long list of foreigners with terrorist ties who have been granted U.S. entry by the Obama administration. The document was provided this month by a pair of federal lawmakers attempting to pinpoint the tragic consequences of Obama’s negligent immigration policies. The legislators, both U.S. senators, are asking Attorney General Loretta Lynch and Secretary of State John Kerry to provide details on the immigration history of the individuals—as well as their family—that appear on the chart. The list features 72 people involved with or sentenced for terrorist activity in the last year alone.
They include individuals who have engaged in or attempted to engage in acts of terrorism; conspired or attempted to conspire to provide material support to a terrorist organization; engaged in criminal conduct inspired by terrorist ideology; or who have been sentenced for any of the foregoing, the senators, Jeff Sessions of Alabama and Ted Cruz of Texas, reveal. “We would like to understand more about these individuals, and others similarly situated in recent history, and the nexus between terrorism and our immigration system,” they write in a letter to Lynch and Kerry. Sessions chairs the Senate Judiciary Committee’s Subcommittee on Immigration and Cruz chairs the Subcommittee on Oversight, Agency Action, Federal Rights and Federal Courts.
They ask that the State Department and Department of Justice (DOJ) coordinate with other relevant agencies to provide answers to their questions by early next month. Among the senators’ inquires is an unredacted copy of each non-citizen or naturalized citizen’s alien file and a breakdown by immigration status of those who at any time after entering the U.S. got flagged as a member of a terrorist organization or political/social group that endorses or espouses terrorist activity. The lawmakers seek other information as well, including the identification of subjects with terrorist ties who have been deported from the U.S. and those who have been placed in removal proceedings but were allowed to remain inside the country.
As if it weren’t bad enough that terrorists are entering the U.S. legally thanks to our weak immigration policies, the Obama administration also has a terrorist “hands off” list that permits individuals with extremist ties to enter the country. The disturbing details of this secret list come from internal Department of Homeland Security (DHS) documents exposed last year by a U.S. senator. Specifically, an electronic email exchange between U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP) asks whether to admit an individual with ties to various terrorist groups. The individual had scheduled an upcoming flight into the U.S. and was believed to be a member of the Muslim Brotherhood and a close associate and supporter of Hamas, Hezbollah and the Palestinian Islamic Jihad.
Islamic terrorists are also sneaking into the U.S. through the porous southern border. The foreigners are classified as Special Interest Aliens (SIA) by the government and they are being transported to stash areas in Acala, a rural crossroads located around 54 miles from El Paso on a state road – Highway 20. Once in the U.S., the SIAs wait for pick-up in the area’s sand hills just across Highway 20. JW has also reported that Mexican smugglers are moving ISIS operatives through the desert and across the U.S.-Mexico border with tremendous ease.

A car bomb attack has rocked a Cairo suburb, targeting a state security building. Twenty-nine people have been injured, including six police officers. Islamic State has claimed responsibility for the attack. 
 
 
The powerful blast in Cairo's northern Shubra district came in the middle of the night, the latest in a wave of militant attacks targeting security forces.
 
 

"The soldiers of the Islamic State managed to target a police building by a car bomb in the heart of Cairo," said an Islamic State statement posted on a Twitter account affiliated with the group.

 
"One policemen suffered moderate injuries and the rest (of those hurt) had minor injuries," health ministry spokesman Hossam Abdel Ghaffar said, as quoted by AFP.

One of the reasons US stocks have had such a nice run is that public companies have been making a lot of money. The profit bounce from Great Recession lows was both big and fast, taking corporate earnings to record levels both in nominal terms and as a portion of GDP.

But since 2012 profits have plateaued. And now they’re about to fall off the table, as most of the reasons for the pop are reversed out. Consider:

Between globalization and automation, corporations have been able to turn their remaining workers into virtual serfs. The next chart looks like a pretty good excuse for armed insurrection. At a minimum it’s a textbook definition of an unsustainable trend.

(Bloomberg) – Wal-Mart Stores Inc., the world’s biggest retailer, cut its annual earnings forecast for the year, hurt by currency fluctuations and a high-profile pay bump for U.S. employees.
The company now expects profit of $4.40 to $4.70 a share this fiscal year, which runs through January, according to a statement on Tuesday. Wal-Mart had previously forecast earnings of as much as $5.05 a share. Wal-Mart also posted second-quarter earnings that missed analysts’ estimates. Profit amounted to $1.08 a share in the period, excluding some items, the Bentonville, Arkansas-based company said. Analysts had expected profit of $1.12 a share, according to data compiled by Bloomberg.
Wal-Mart shares fell as much as 3.3 percent to $69.55 in New York, the biggest decline since May 19. The stock had already slid 16 percent this year through Monday’s close.
Wal-Mart announced plans in February to raise wages to at least $9 an hour this year and $10 by 2016, along with a related effort to improve training and bolster hours. The move will reduce profit by 24 cents a share, Wal-Mart said on Tuesday. That includes an 8-cent hit in the fiscal third quarter, which runs through October. Wal-Mart had previously said the effort would cost 20 cents this year.

(Bloomberg) – American companies had a rough start to 2015 as they watched profits from overseas subsidiaries slide. Exactly how much blame should we assign to the currency markets? Two economists at the Federal Reserve have an idea.
U.S. corporate profits fell about 1.4 percent in the fourth quarter last year before plummeting 5.2 percent in the first quarter this year, partly driven by a plunge in the amount American companies’ foreign affiliates earned. Of the decline in overseas subsidiary profits caused by the appreciating currency and cheaper oil imports, about a third probably came specifically from the greenback, Carol Bertaut and Nitish Sinha wrote in a post this month.
Fed policy makers have voiced concern about the strong dollar’s drag on exports, both in Federal Open Market Committee minutesand in speeches (the FOMC will release a new policy statement at 2 p.m. on Wednesday). It’s a major point of concern for monetary policy-watchers as Fed officials debate when to go ahead with the first interest rate increase since 2006.

China tripled its debt post-2009 and spent most of the proceeds on infrastructure like roads and airports. US corporations got a big piece of this business, either by selling raw materials and technology to Chinese builders, or doing the work themselves. Now that bubble has burst, leaving lower commodity prices and excess capacity in its wake:

(Wall Street Journal) – With the U.S. recession behind them and the European fiscal crisis fading, American companies are grappling with a new threat: China’s economic blues. In quarterly conference calls, U.S. executives recited a litany of pain, from mild to severe, resulting from a slowdown in China’s economy, the world’s second-largest.
Engine-maker Cummins Inc., for example, said demand for excavators in China fell 34% in the second quarter from a year ago with no signs of improvement. For such companies as WeyerhaeuserCo., less construction in China means logs and lumber pile up in the U.S., pushing down prices.
“China was weak in the quarter, and we expect it to be weak as we move forward,” Robyn Denholm, chief financial officer of Juniper Networks Inc., told investors. China pulled down the networking-gear maker’s Asia-Pacific revenues by 3% from the prior quarter; without China, they would have risen 11%.
It comes at a tough time for U.S. businesses. Overall, companies in the S&P 500 index are on track to eke out a 1.2% increase in second-quarter earnings, according to data from Thomson Reuters. That is the slowest growth since fall 2012.
The modest earnings growth was recorded on a 3.5% decline in revenues—the biggest drop in nearly six years—suggesting that much of the profit gain is from cost-cutting, buybacks or other maneuvers, rather than increased sales.
The slowdown in China was evident last quarter in everything from business flights to elevator sales to car purchases. Rockwell CollinsInc. said the flight-services industry has seen international business-jet flights fall 10% this year, largely in and out of China, Russia and the Middle East. DuPont Co., which makes temperature-resistant materials for components in the automotive industry, lowered its growth forecast for the Chinese auto industry in the second half of the year to between 2% and 3%, from past rates of 5% or higher.
Add it all up, and US corporations are looking at another year of falling revenues and much lower earnings at a time when a lot of stocks are priced for, if not perfection, at least high-single-digit growth.
And none of these headwinds are going away. US workers have just begun to redress the past decade’s injustices, and now that higher minimum wage laws have been proven to be political winners, a whole generation of would-be mayors and governors will be pushing them.
China has done exactly nothing to bring its finances back into balance so will either see a 2016 crash or bail out its banks and builders and drift into a Japanese-style lost decade. Either way, its days of sucking up all the world’s extra oil, coal and earth movers are over.
And with the rest of the world in various stages of decline, crisis or chaos while the Fed seems to sincerely want higher domestic interest rates, the dollar isn’t poised to retrace the past year’s spike. Just the opposite.
So it’s a safe bet that US corporations will, in the aggregate, be less profitable next year than this year and — to the extent that earnings dictate market cap — a lot less valuable.
