A new privacy-protecting Internet service and telephone provider still in the planning stages could become the ACLU's dream and the FBI's worst nightmare. by Declan McCullagh April 11, 2012 4:00 AM PDT Nicholas Merrill is planning to revolutionize online privacy with a concept as simple as it is ingenious: a telecommunications provider designed from its inception to shield its customers from surveillance. Merrill, 39, who previously ran a New York-based Internet provider, told CNET that he's raising funds to launch a national "non-profit telecommunications provider dedicated to privacy, using ubiquitous encryption" that will sell mobile phone service, for as little as $20 a month, and Internet connectivity. The ISP would not merely employ every technological means at its disposal, including encryption and limited logging, to protect its customers. It would also -- and in practice this is likely more important -- challenge government surveillance demands of dubious legality or constitutionality. A decade of revelations has underlined the intimate relationship between many telecommunications companies and Washington officialdom. Leading providers including AT&T and Verizon handed billions of customer telephone records to the National Security Agency; only Qwest refused to participate. Verizon turned over customer data to the FBI without court orders. An AT&T whistleblower accused the company of illegally opening its network to the NSA, a practice that the U.S. Congress retroactively made legal in 2008. By contrast, Merrill says his ISP, to be run by a non-profit called the Calyx Institute with for-profit subsidiaries, will put customers first. "Calyx will use all legal and technical means available to protect the privacy and integrity of user data," he says. Merrill is in the unique position of being the first ISP exec to fight back against the Patriot Act's expanded police powers -- and win. In February 2004, the FBI sent Merrill a secret "national security letter" (not an actual court order signed by a judge) asking for confidential information about his customers and forbidding him from disclosing the letter's existence. He enlisted the ACLU to fight the gag order, and won. A federal judge barred the FBI from invoking that portion of the law, ruling it was "an "unconstitutional prior restraint of speech in violation of the First Amendment." Merrill's identity was kept confidential for years as the litigation continued. In 2007, the Washington Post published his anonymous op-ed which said: "I resent being conscripted as a secret informer for the government," especially because "I have doubts about the legitimacy of the underlying investigation." He wasn't able to discuss his case publicly until 2010. His recipe for Calyx was inspired by those six years of interminable legal wrangling with the Feds: Take wireless service like that offered by Clear, which began selling 4G WiMAX broadband in 2009. Inject end-to-end encryption for Web browsing. Add e-mail that's stored in encrypted form, so even Calyx can't read it after it arrives. Wrap all of this up into an easy-to-use package and sell it for competitive prices, ideally around $20 a month without data caps, though perhaps prepaid for a full year. "The idea that we are working on is to not be capable of complying" with requests from the FBI for stored e-mail and similar demands, Merrill says. A 1994 federal law called the Communications Assistance for Law Enforcement Act was highly controversial when it was enacted because it required telecommunications carriers to configure their networks for easy wiretappability by the FBI. But even CALEA says that ISPs "shall not be responsible for decrypting" communications if they don't possess "the information necessary to decrypt." Translation: make sure your customers own their data and only they can decrypt it. Merrill has formed an advisory board with members including Sascha Meinrath from the New America Foundation; former NSA technical director Brian Snow; and Jacob Appelbaum from the Tor Project. "I have no doubt that such an organization would be extremely useful," ACLU deputy legal director Jameel Jaffer wrote in a letter last month. "Our ability to protect individual privacy in the realm of telecommunications depends on the availability of phone companies and ISPs willing to work with us, and unfortunately the number of companies willing to publicly challenge the government is exceedingly small." The next step for Merrill is to raise about $2 million and then, if all goes well, launch the service later this year. Right now Calyx is largely self-funded. Thanks to a travel grant from the Ford Foundation, Merrill is heading to the San Francisco Bay area later this month to meet with venture capitalists and individual angel investors. "I am getting a lot of stuff for free since everyone I've talked to is crazy about the idea," Merrill says. "I am getting all the back-end software written for free by Riseup using a grant they just got." While the intimacy of the relationship between Washington and telecommunications companies varies over time, it's existed in one form or another for decades. In his 2006 book titled "State of War," New York Times reporter James Risen wrote: "The NSA has extremely close relationships with both the telecommunications and computer industries, according to several government officials. Only a very few top executives in each corporation are aware of such relationships." Louis Tordella, the longest-serving deputy director of the NSA, acknowledged overseeing a project to intercept telegrams in the 1970s. Called Project Shamrock, it relied on the major telegraph companies including Western Union secretly turning over copies of all messages sent to or from the United States. "All of the big international carriers were involved, but none of 'em ever got a nickel for what they did," Tordella said before his death in 1996, according to a history written by L. Britt Snider, a Senate aide who became the CIA's inspector general. Like the eavesdropping system that President George W. Bush secretly authorized, Project Shamrock had a "watch list" of people whose conversations would be identified and plucked out of the ether by NSA computers. It was initially intended to be used for foreign intelligence purposes, but at its peak, 600 American citizens appeared on the list, including singer Joan Baez, pediatrician Benjamin Spock, actress Jane Fonda and the Rev. Martin Luther King Jr. Even if Calyx encrypts everything, the surveillance arms of the FBI and the bureau's lesser-known counterparts will still have other legal means to eavesdrop on Americans, of course. Police can remotely install spyware on a suspect's computer. Or install keyloggers by breaking into a home or office. Or, as the Secret Service outlined at last year's RSA conference, they can try to guess passwords and conduct physical surveillance. That prospect doesn't exactly please the FBI. Last year, CNET was the first to report that the FBI warned Congress about what it dubbed the "Going Dark" problem, meaning when police are thwarted in conducting court-authorized eavesdropping because Internet companies aren't required to build in back doors in advance, or because the technology doesn't permit it. FBI general counsel Valerie Caproni said at the time that agents armed with wiretap orders need to be able to conduct surveillance of "Web-based e-mail, social networking sites, and peer-to-peer communications technology." But until Congress changes the law, a privacy-first ISP like Calyx will remain perfectly legal. Obama administration defends 2nd mass surveillance project

The Obama administration found itself defending -- and beginning to explain -- yet another surveillance effort after leaked documents revealed information about two secret National Security Agency intelligence-gathering programs. On top of a Guardian newspaper report that revealed how authorities were collecting phone records from millions, a Washington Post report detailed another program that scours major Internet companies including Google and Facebook for data. A former senior NSA official confirmed to Fox News that the program was started in 2007 by the FBI and NSA and allows them to tap into top U.S. Internet companies to pull audio, video and other data. While civil liberties groups cried foul over the program, Director of National Intelligence James Clapper issued a statement late Thursday decrying the leak of the materials. He called the disclosure of the program that allows the NSA to collect communications data from Internet companies "reprehensible" and said the phone-records monitoring leak could cause harm to the nation's intelligence gathering activities. At the same time, he took the rare step of moving to declassify information about the programs as he sought to defend them against criticism. “The article omits key information regarding how a classified intelligence collection program is used to prevent terrorist attacks and the numerous safeguards that protect privacy and civil liberties," he said of the Guardian story. Clapper also said the government was "prohibited from indiscriminately sifting through the telephony metadata acquired under the program.” All information acquired, he said, “is subject to strict, court-imposed restrictions on review and handling. The court only allows the data to be queried when there is a reasonable suspicion, based on specific facts, that the particular basis for the query is associated with a foreign terrorist organization. “ Several hours earlier, a senior administration official also pushed back, saying the Guardian article and Washington Post article about the Internet mining refers to collection under a law that "does not allow the targeting of any U.S. citizen or of any person located within the United States.” It was not immediately clear how the official defined “targeting.” “The program is subject to oversight by the Foreign Intelligence Surveillance Court, the Executive Branch, and Congress,” the official said. “It involves extensive procedures, specifically approved by the court, to ensure that only non-U.S. persons outside the U.S. are targeted, and that minimize the acquisition, retention and dissemination of incidentally acquired information about U.S. persons.” A former NSA official told Fox News the FBI and National Security Agency (NSA) have been tapping into leading U.S. Internet companies to pull audio, video and photographs. According to the official, the program began in 2007 and is in the second phase. Metadata from the companies is used to identify suspicious individuals and the secondary search goes into content. The official told Fox News that the Utah Data Center is likely a repository for this material. The classified program is code-named PRISM, the Washington Post reported, and has not been disclosed publicly before. Members of Congress who are aware of the program were reportedly bound by oath to keep it confidential. According to slides from an internal presentation intended for NSA senior analysts and obtained by the Washington Post, the program accounts for nearly one in seven intelligence reports. The companies that participate knowingly in the program are Microsoft, Yahoo, Google, Facebook, PalTalk, AOL, Skype, YouTube and Apple, the Washington Post reports. A number of the Internet companies issued statements Thursday night saying they only complied when legally bound to do so. "Even when the system works just as advertised, with no American singled out for targeting, the NSA routinely collects a great deal of American content," the Washington Post report said. "That is described as "incidental," and it is inherent in contact chaining, one of the basic tools of the trade." To be immune from lawsuits, companies like Yahoo and AOL are reportedly obliged to accept a directive from the attorney general and national intelligence director to open their service to the FBI's Data Intercept Technology Unit, which acts as a liaison between the companies and the NSA. According to the slides, there has been “continued exponential growth in tasking to Facebook and Skype." "With a few clicks and an affirmation that the subject is believed to be engaged in terrorism, espionage or nuclear proliferation, an analyst obtains full access to Facebook’s 'extensive search and surveillance capabilities against the variety of online social networking services,'" the Washington Post reports. Skype can reportedly be monitored for audio when one end of a call is a conventional telephone and also can be monitored for video, chat and file transfers when users connect just by a computer. Google services that can be monitored include Gmail, voice and video chat, Google Drive files, and search terms. A spokesperson for Google says the company "cares deeply" about the security of users' data. "We disclose user data to government in accordance with the law, and we review all such requests carefully," the spokesperson said. "From time to time, people allege that we have created a government 'back door' into our systems, but Google does not have a 'back door' for the government to access private user data." Protecting the privacy of our users and their data is a top priority for Facebook," the company's chief security officer Joe Sullivan said in a statement. "We do not provide any government organization with direct access to Facebook servers. When Facebook is asked for data or information about specific individuals, we carefully scrutinize any such request for compliance with all applicable laws, and provide information only to the extent required by law." A Microsoft spokesperson said that the company only provides customer data after receiving a legally binding order or subpoena. "In addition we only ever comply with orders for requests about specific accounts or identifiers," the spokesperson said. "If the government has a broader voluntary national security program to gather customer data we don't participate in it." Former employees of the National Security Agency say the publishing of a court order asking Verizon to hand over all its phone calling records for a three-month period opens a new window on an operation that has been in place for years and involves all major U.S. phone companies. “NSA has been doing all this stuff all along, and it’s been all these companies, not just one,” William Binney told news program Democracy Now on Thursday. “They’re just continuing the collection of this data on all U.S. citizens.” NSA Whistleblowers Startling Claims: Records on 3 Billion Calls Collected Per Day And Its Not Just Verizon Binney, who worked at the NSA for almost 40 years, left the agency after the attacks of 9/11 because he objected to the expansion of its surveillance of U.S. citizens. British newspaper The Guardian late Wednesday released an order from the secret Foreign Intelligence Surveillance Court, requesting Verizon to give the NSA the details on every phone call on its landline and wireless networks on a daily basis between April 25 and July 19. Binney estimates that the NSA collects records on 3 billion calls per day. “These are routine orders,” said Thomas Drake, another NSA whistleblower. “What’s new is we’re seeing an actual order, and people are surprised by it.” “We’ve been saying this for years from the wilderness,” Drake told Democracy Now. “But it’s like, hey, everybody went to sleep while the government is collecting all these records.” Drake started working for the NSA in 2001 and blew the whistle on what he saw as a wasteful and invasive program at the agency. He was later prosecuted for keeping classified information. Most of the charges were dropped before trial, and he was sentenced to one year of probation and community service. The NSA’s original charter was to eavesdrop on communications between countries, not inside the U.S. That expansion of its mission appears to have happened after 9/11, but the agency has continuously denied that it spies on domestic communications. In March, for instance, NSA spokeswoman Vanee Vines, emailed an Associated Press reporter about a story that described the NSA as a monitor of worldwide Internet data and phone calls. “NSA collects, monitors, and analyzes a variety of FOREIGN signals and communications for indications of threats to the United States and for information of value to the U.S. government,” she wrote. “FOREIGN is the operative word. Verizon’s general counsel emailed employees Thursday saying that the company has an obligation to obey court orders, but did not confirm the existence of an order. James Bamford, a journalist and author of several books on the NSA, said it’s very surprising to see that the agency tracks domestic calls, including local calls. In 2006, USA Today reported that the NSA was secretly collecting a database of domestic call information. However, some phone companies denied any involvement in such a program. Bamford’s assumption was that the uproar over a separate, post-9/11 warrantless wiretapping program and the departure of the Bush administration meant that the NSA had been reined in. “Here we are, under the Obama administration, doing it sort of like the Bush administration on steroids,” he said in an interview with the Associated Press. “This order here is about as broad as it can possibly get, when it comes to focusing on personal communications. The news reports Obama is pressing Xi on the Cyber Attacks issue and both men are getting to know one another which was mostly fluff for the public's consumption. The first 15 minutes of their meeting was really the historic part of the visit with agreements and document signings pertaining to our programs and the RV which put the payout phase into OVERDRIVE! Explosive revelations. The NSA is using telecom giants to spy on anybody and everybody, in a program called PRISM. But the information is not new. Three books have been written about the super-secret NSA, and James Bamford has written them all . In 2008, Amy Goodman of Democracy Now interviewed Bamford as his latest book, The Shadow Factory, was being released. Bamford explained that, in the 1990s, everything changed for NSA. Previously, they'd been able to intercept electronic communications by using big dishes to capture what was coming down to Earth from telecom satellites. But with the shift to fiber-optic cables, NSA was shut out. So they devised new methods. For example, they set up a secret spy room at an AT&T office in San Francisco. NSA installed new equipment that enabled them to tap into the fiber-optic cables and suck up all traffic. How Bamford describes this, in 2008, tells you exactly where the PRISM program came from: "NSA began making these agreements with AT&T and other companies, and that in order to get access to the actual cables, they had to build these secret rooms in these buildings. "So what would happen would be the communications on the cables would come into the building, and then the cable would go to this thing called a splitter box, which was a box that had something that was similar to a prism, a glass prism. "And the prism was shaped like a prism, and the light signals would come in, and they'd be split by the prism. And one copy of the light signal would go off to where it was supposed to be going in the telecom system, and the other half, this new cloned copy of the cables, would actually go one floor below to NSA's secret room. "... And in the secret room was equipment by a private company called Narus, the very small company hardly anybody has ever heard of that created the hardware and the software to analyze these cables and then pick out the targets NSA is looking for and then forward the targeted communications onto NSA headquarters." In James Bamford's 2008 interview, he mentions two Israeli companies, Narus and Verint, that almost nobody knew about. They played a key role in developing and selling the technology that allowed NSA to deploy its PRISM spying program: Bamford: "Yeah. There's two major - or not major, they're small companies, but they service the two major telecom companies. This company, Narus, which was founded in Israel and has large Israel connections, does the - basically the tapping of the communications on AT&T. And Verizon chose another company, ironically also founded in Israel and largely controlled by and developed by people in Israel called Verint. "So these two companies specialize in what's known as mass surveillance. Their literature - I read this literature from Verint, for example - is supposed to only go to intelligence agencies and so forth, and it says, 'We specialize in mass surveillance,' and that's what they do. "They put [this] mass surveillance equipment in these facilities. So you have AT&T, for example, that, you know, considers it's their job to get messages from one person to another, not tapping into messages, and you get the NSA that says, we want, you know, copies of all this. So that's where these [two Israeli] companies come in. These companies act as the intermediary basically between the telecom companies and the NSA." AMY GOODMAN: "Now, Jim Bamford, take this a step further, because you say the founder and former CEO of one of these companies [Verint] is now a fugitive from the United States somewhere in Africa?" JAMES BAMFORD: "...the company that Verizon uses, Verint, the founder of the company, the former head of the company, is now a fugitive in - hiding out in Africa in the country of Namibia, because he's wanted on a number of felony warrants for fraud and other charges. And then, two other top executives of the company, the general counsel and another top official of the parent company, have also pled guilty to these charges. "So, you know, you've got companies - these [two] companies have foreign connections with potential ties to foreign intelligence agencies, and you have problems of credibility, problems of honesty and all that. And these companies - through these two companies pass probably 80 percent or more of all US communications at one point or another. "And it's even - gets even worse in the fact that these companies also supply their equipment all around the world to other countries, to countries that don't have a lot of respect for individual rights -- Vietnam, China, Libya, other countries like that. And so, these countries use this equipment to filter out dissident communications and people trying to protest the government. It gives them the ability to eavesdrop on communications and monitor dissident email communications. And as a result of that, people are put in jail, and so forth..." AMY GOODMAN: "And despite all of this...these telecom companies still have access to the most private communications of people all over America and actually, it ends up, around the world. And at the beginning of the summer [2008], the Democrats and Republicans joined together in granting retroactive immunity to these companies for spying on American citizens." The fugitive CEO of Verint, whom Bamford mentions, is Jacob "Kobi" Alexander. In 2006, the US Dept. of Justice charged him with conspiring to commit securities and wire and mail fraud. The SEC weighed in and filed similar civil charges. Alexander fled to Namibia, where he finally settled with the SEC for $46 million. The DOJ criminal complaint, as far as I can tell, still stands. Alexander continues to fight against extradition to the US. He is no longer the CEO of Verint. It's obvious that these two Israeli companies, Narus and Verint, working for NSA, have been able to divert duplicate mega-tons of data to Israeli intelligence. The recent media stories on this NSA PRISM spying system indicate that NSA is tapping into the servers of huge tech companies; Google, AOL, Microsoft, Skype, Apple, Yahoo. The methods of data theft may have expanded, but the result and intent remain the same. The government-corporate juggernaut moves ahead. Their rationale---catching terrorists---is, in great part, a cover story to obscure the fact that the State wants control over the lives of all citizens, as it ratchets up the very conditions that provoke rebellion. It's a classic pincer movement. As far as the current NSA PRISM spying is concerned, look for limited hangouts. These are partial admissions and excuses, offered to conceal greater crimes and stop investigations. The giant tech companies already have their limited hangout in place: "We didn't know it was happening, we would never have allowed it to happen, and we'll be much more careful in the future." Obama is saying: Yes, let's have dialogue on this matter...there's a fine line between national security needs and overweening intrusion into citizens' privacy. The NSA is saying: We do spy, but we don't read content of emails and phone calls. We just keep 'records' of the communications. The lies lying liars tell. The NSA has multiple and redundant methods of spying. If they have to cut back, for a while, on directly accessing the servers of the giant tech firms, they can do it without losing a step. After all, as James Bamford revealed five years ago, NSA cuts directly into fiber-optic cables and splits the data into two copies, one of which it keeps for itself. They can access Google and Yahoo in other ways. Most easily, they can say to these willing tech partners, "Give us all your data." And it will be done. Firms like Google are already spying on their customers, putting together extensive profiles to craft better targeted ads. Google knows spying. Doing it for commercial purposes, or for "national security" purposes? They don't make those distinctions. Second NSA PRISM Spy Leak Shows Govt, Tech Companies Are Lying to You

A second leaked slide from the NSA’s top secret PRISM operation details how the NSA actually goes straight to the servers of top tech companies like Skype and Google in order to compile your personal chats and information — exactly what the U.S. Director of National Intelligence and major corporations said wasn’t happening in statements made yesterday.

Quite frankly, it looks like The Guardian has absolutely side swiped the Director of National Intelligence James R. Clapper, Facebook, Skype, Google, and a host of others who denied that the NSA PRISM program was directly tied into the tech company servers. More specifically, there was heavy denial in regards to how the NSA spy program actually worked, which is actually now detailed on the second slide. A slide that, at the time of writing this, has not even hit the front of Drudge or other sources. Here is the slide from the top secret PRISM project, which utilizes the top tech companies in order to watch and hold every letter you type through their services:

Let’s examine what the Director of National Intelligence actually said in an attempt at damage control over the initial top secret leak during his interview with CNET (who is now totally against The Guardian for leaking the information and attempting to discredit it). In the interview, the Director says that “the government doesn’t simply scoop information from company servers.” Now, with this second slide, we see that this is exactly what the NSA does verbatim. Amazing, right?

We read in the slide that PRISM entails the collection of data “directly from the servers of these U.S. Service Providers: Microsoft, Yahoo, Google, Facebook, PalTalk, AOL, Skype, Youtube, Apple.”
In other words, it’s exactly what the U.S. Director of National Intelligence said the NSA isn’t doing. So either the very Director of the entire national intelligence division never saw the second slide of the PRISM operation that he was explaining, or he was lying to your face in an act of damage control to make sure you don’t get too upset at your leaders. As a matter of fact, PRISM is specifically about collecting information directly from the servers of these companies. It’s very unlikely, then, that this individual had no idea how it worked.
