Yes, the conventional wisdom is that she is still the prohibitive favorite, armed with big money, big connections, and the Big Dog, Bill.But the so-called “wisdom” is “conventional” for a reason.As a result of endless sordid scandals and predictably Clintonian evasions, her poll numbers on everything from favor ability to trustworthiness are in a nosedive. A battery of new polls in key swing states such as Colorado and Iowa show her losing to a number of GOP challengers.She’s also taking incoming from the left, particularly from Vermont senator and socialist Bernie Sanders, who is scoring major crowds and an increasing percentage of the Democratic vote, indicating that the leftist base sees him as a viable option and not merely a vehicle to register discontent with Mrs. Clinton.Polls this early in the cycle can be unreliable. But they do indicate a significant downward trend for her that must have her campaign at DEF CON 3.None of this, however, is her most serious problem. Instead, it’s something much closer to home, much more insidious, much more dangerous than anything else.It’s President Obama. And he just made his move.Here’s how it’s likely going down:The Clintons and the Obamas have a long history of bad blood, dating to the 2008 primary race. After Mr. Obama creamed her, he offered her the plum gig of secretary of state. Friends close, enemies closer. She tried to get her dirty tricks consigliere, Sidney Blumenthal, a top position in the State Department, which Mr. Obama pointedly denied. So she hired him anyway through the Clinton Foundation.Through Mr. Blumenthal, she was fed all kinds of intelligence on global hotspots such as Libya, much of it inaccurate, as she circumvented traditional government communication chains via her private email server. What was she hiding from Mr. Obama? And why? Perhaps because she trusted Mr. Obama about as much as she trusted Bill.Mr. Obama didn’t trust her either. In a recently disclosed email, Mrs. Clinton complained that she heard “on the radio” that there was a “Cabinet meeting” that morning and wondered if she could attend. The secretary of state — second in line to the presidency — was frozen out, so she set up her own fiefdom.Mr. Obama needs a successor whom he can control to ensure that the “fundamental transformation of the nation” continues. He cannot control either of the Clintons. In a revealing “tell” this week, he said, “In 18 months, I’m turning over the keys. I want to make sure I’m turning over the keys to somebody who is serious about the serious problems that the country faces and the world faces.”
He will therefore back the one person he knows will do his bidding: his vice president, Joe Biden, whom he summons to his side for every critical photo op, including the announcement of the Iran deal.There’s more going on there than just symbolism.So here’s the likely plan: Mr. Biden will announce that he is running for president (the reported dying wish of his late son, Beau). After a respectable amount of time, Mr. Obama will announce that while he admires all of the Democratic candidates, Mr. Biden has earned his particular loyalty.Following his presidential endorsement, Mr. Obama will then support Mr. Biden with the full weight of the White House, including the sophisticated technical infrastructure his campaigns used to win in 2008 and 2012. For years, Mrs. Clinton has begged Mr. Obama to turn it over to her, and he refused. He’s been saving it for someone else.Mr. Obama will also use his considerable influence with black and Latino voters to support Mr. Biden, which may be enough to help him significantly.But Mrs. Clinton is a survivor, they will say. The media protects her. True. But it will be a much different situation if she’s under criminal investigation by the Justice Department or worse, crippled by a Special Prosecutor or even an indictment.Don’t think Mr. Obama will go there? He already has. Last week, the New York Times reported that two inspectors general from his administration recommended that the Justice Department open a “criminal” inquiry into her handling of classified material. The leak to the Times came from a “senior administration official,” which some have speculated was Mr. Obama’s own consigliere, Valerie Jarrett. The Times walked back some of the details, but the damage was done. If Mr. Obama did not want a DOJ criminal investigation of Mrs. Clinton to go forward, he would not have let it go this far. He wants the investigation, wants her nailed, wants her out. And he’s doing it, slowly, steadily.The Clintons used to be champion Machiavellians. But in Mr. Obama, they look like they are being outmaneuvered — again — by the ultimate take-no-prisoners master. Hillary is being given the Judas kiss by her former boss, a man loyal to no one but himself.

The Pentagon has spent nearly $4 billion fighting Islamic State across Syria and Iraq since operations began a year ago, according to statistics released this week. The average daily cost of the campaign is $9.9 million, or $6,785 a minute.
A colossal $3.7 billion in expenses have been racked up since the campaign began on August 8, 2014 up to August 15 of this year.

Since Operation Inherent Resolve began, the USA and its coalition allies say they have conducted a total of over 6,000 airstrikes in the region. Of those strikes, nearly 4,000 have been made in Iraq and nearly 2,500 in Syria.
Pentagon statistics claim those strikes have damaged or destroyed more than 10,000 targets, including tanks, Humvees, staging areas, and oil infrastructure. If the total cost of the campaign to-date is calculated based on actual damage, those strikes cost an estimated $400,000 per successful hit.
Pentagon officials maintain that the year-long campaign has had some success, enabling Iraqi forces to reclaim some areas, but strategic cities like Mosul and Ramadi remain under IS control, and the airstrikes have done little to uproot the terror group’s hold in Syria.
In a press briefing at the end of July, Marine Corps Brigadier General Kevin J. Killea, chief of staff for Operation Inherent Resolve, said the campaign has made progress.
“This is not the same fight as it was when it started, and I look at that based on the effects that we have had on ISIL,” Killea told reporters.
“They are much more territorial, meaning they’re defending more than they’re on the offensive. Their attacks are smaller, they are more focused, and they’re less enduring.”
“All you have to do is look at the gains that have been made on the ground recently to see that there is an effect, and there is progress,” he added.
The cost of the campaign against IS has been released as the Pentagon’s inspector general is investigating allegations by a Department of Defense whistleblower that intelligence regarding the success of the campaign was altered, according to a report published in the New York Times.
The investigation started after at least one civilian analyst working for the Defense Intelligence Agency alleged that officials coordinating the anti-IS campaign at US Central Command are “improperly reworking the conclusions of intelligence assessments” that are later handed over to top policy-makers, including 'president' Obama.
Speaking on the condition of anonymity, officials told the Times that the investigation is trying to establish if military officials changed the conclusions of drafted intelligence assessments before passing them on. If the allegations turn out to be true, it might explain why assessments of the military campaign’s effectiveness vary greatly.

On Tuesday evening, we asked what would happen if emerging markets joined China in dumping US Treasurys. For months we’ve documented the PBoC’s liquidation of its vast stack of US paper. Back in July for instance, we noted that China had dumped a record $143 billion in US Treasurys in three months via Belgium, leaving Goldman speechless for once.
We followed all of this up this week by noting that thanks to the new FX regime (which, in theory anyway, should have required less intervention), China has likely sold somewhere on the order of $100 billion in US Treasurys in the past two weeks alone in open FX ops to steady the yuan. Put simply, as part of China's devaluation and subsequent attempts to contain said devaluation, China has been purging an epic amount of Treasurys.
But even as the cat was out of the bag for Zero Hedge readers and even as, to mix colorful escape metaphors, the genie has been out of the bottle since mid-August for China which, thanks to a steadfast refusal to just float the yuan and be done with it, will have to continue selling USTs by the hundreds of billions, the world at large was slow to wake up to what China’s FX interventions actually implied until Wednesday when two things happened: i) Bloomberg, citing fixed income desks in New York, noted "substantial selling pressure" in long-term USTs emanating from somebody in the "Far East", and ii) Bill Gross asked, in a tweet, if China was selling Treasurys.
Sure enough, on Thursday we got confirmation of what we’ve been detailing exhaustively for months. Here’s Bloomberg:
China has cut its holdings of U.S. Treasuries this month to raise dollars needed to support the yuan in the wake of a shock devaluation two weeks ago, according to people familiar with the matter.
Channels for such transactions include China selling directly, as well as through agents in Belgium and Switzerland, said one of the people, who declined to be identified as the information isn’t public. China has communicated with U.S. authorities about the sales, said another person. They didn’t reveal the size of the disposals.
The latest available Treasury data and estimates by strategists suggest that China controls $1.48 trillion of U.S. government debt, according to data compiled by Bloomberg. That includes about $200 billion held through Belgium, which Nomura Holdings Inc. says is home to Chinese custodial accounts.
Now that what has been glaringly obvious for at least six months has been given the official mainstream stamp of fact-based approval, the all-clear has been given for rampant speculation on what exactly this means for US monetary policy. Here’s Bloomberg again:
The PBOC has sold at least $106 billion of reserve assets in the last two weeks, including Treasuries, according to an estimate from Societe Generale SA. The figure was based on the bank’s calculation of how much liquidity will be added to China’s financial system through Tuesday’s reduction of interest rates and lenders’ reserve-requirement ratios. The assumption is that the central bank aims to replenish the funds it drained when it bought yuan to stabilize the currency.
China selling Treasuries is “not a surprise, but possibly something which people haven’t fully priced in,” said Owen Callan, a Dublin-based fixed-income strategist at Cantor Fitzgerald LP. “It would change the outlook on Treasuries quite a bit if you started to price in a fairly large liquidation of their reserves over the next six months or so as they manage the yuan to whatever level they have in mind.”As we discussed on Wednesday evening, we do, thanks to a review of the extant academic literature undertaken by Citi, have an idea of what foreign FX reserve liquidation means for USTs. "Suppose EM and developing countries, which hold $5491 bn in reserves, reduce holdings by 10% over one year - this amounts to 3.07% of US GDP and means 10yr Treasury yields rates rise by a mammoth 108bp ," Citi said, in a note dated earlier this week.
“By selling Treasuries to defend the renminbi, they’re preventing Treasury yields from going lower despite the fact that we’ve seen a sharp drop in the stock market,” David Woo, head of global rates and currencies research at Bank of America Corp., said on Bloomberg Television on Wednesday. “China has a direct impact on global markets through U.S. rates.”
In other words, for every $500 billion in liquidated Chinese FX reserves, there's an attendant 108bps worth of upward pressure on the 10Y. Bear in mind here that thanks to the threat of a looming Fed rate hike and a litany of other factors including plunging commodity prices and idiosyncratic political risks, EM currencies are in free fall which means that it's not just China that's in the process of liquidating USD assets.
The clear takeaway is that there's a substantial amount of upward pressure building for UST yields and that is a decisively undesirable situation for the Fed to find itself in going into September. On Wednesday we summed the situation up as follows: "one of the catalysts for the EM outflows is the looming Fed hike which, when taken together with the above, means that if the FOMC raises rates, they will almost surely accelerate the pressure on EM, triggering further FX reserve drawdowns (i.e. UST dumping), resulting in substantial upward pressure on yields and prompting an immediate policy reversal and perhaps even QE4."
Well now that China's UST liquidation frenzy has reached a pace where it could no longer be swept under the rug and/or played down as inconsequential, and now that Bill Dudley has officially opened the door for "additional quantitative easing", it would appear that the only way to prevent China and EM UST liquidation from, as Citi puts it, "choking off the US housing market," and exerting a kind of forced tightening via the UST transmission channel, will be for the FOMC to usher in QE4.

Judicial Watch Files Amicus Brief Asking Supreme Court To Require Fourth Circuit to Follow Three-Judge Court Act in Maryland Gerrymandering Challenge

The Three-Judge Court Act requires that three-judge panels must hear all constitutional challenges to legislative redistricting unless, according past Supreme Court rulings, a case is “obviously frivolous,” “essentially fictitious,” “wholly insubstantial,” or “obviously without merit.”
In 2013, the Fourth Circuit departed from this precedent, determining that a single judge could decide not to convene a three-judge panel if he determined the case was not “plausible.” The Fourth Circuit applied the same standard in its 2014 ruling against Shapiro and fellow plaintiffs John Benisek, and Maria Pycha.
In November 2013, Shapiro, Benisek, and Pycha sued Maryland state officials alleging that the 2011 congressional districts established by the Maryland General Assembly violated their constitutional rights. When the District Court dismissed the suit, the plaintiffs appealed to the U.S. Court of Appeals for the Fourth Circuit. In October 2014, a single Fourth Circuit Court judge upheld the District Court ruling, denying the plaintiffs an oral hearing before a three-judge panel. In February 2015, the plaintiffs filed a Petition for a Writ of Certiorari to the U.S. Supreme Court, which the Supreme Court granted in June 2015.
Judicial Watch has a particular interest, as it represents several Maryland voters in a lawsuit challenging the constitutionality of Maryland’s gerrymandered congressional district maps. Judicial Watch’s amicus brief argues that:
[T]he Fourth Circuit’s ruling violates the Three-Judge Court Act and will allow states to delay judicial review of gerrymandered redistricting plans that disenfranchise voters and violate the Constitution. Moreover, on June 24, 2015, Judicial Watch filed a new constitutional challenge to Maryland’s redistricting plan on behalf of several plaintiffs. See Parrott v. McManus, No. 1:15-cv-01849 (D. Md.). The plaintiffs have asked for a three-judge panel in Parrott, but no such panel has been convened yet, and a motion to dismiss is currently pending before the single judge initially assigned to the case.Judicial Watch points out that the Fourth Circuit’s circumvention of federal law results in “an allocation of authority” to one federal court judge that “cannot be squared with Congress’s judgment—recognized by this Court and others—that apportionment challenges and other types of three-judge cases are too important to be decided in the first instance by a single judge. Nor is the difference between one and three judges merely a formality.”
Congress intended redistricting and other constitutional challenges under laws such as the Civil Rights Act of 1964 to be heard under the “exceptional procedure” of a special three-judge panel. In 1976, Congress specifically tried to ensure that redistricting cases were handled by such panels in order “to assure more weight and greater deliberation by not leaving the fate of such litigation to a single judge. By instead using motions to dismiss to limit access to three-judge courts, the Fourth Circuit has turned the Three-Judge Court Act’s purpose and framework on its head.”
The Three-Judge Court Act allows appeals from the three judge panels to go directly to the Supreme Court, bypassing the federal Circuit Courts of Appeals. This statute assures a more speedy resolution to this important class of cases, which is undermined by the Fourth Circuit’s rule, especially in redistricting cases (which impact both federal and state elections):
And when the clock is always counting down towards the next election, such a delay can control whether the alleged constitutional violation can be remedied or if it is something that a state’s voters simply must swallow.The 2013 lawsuit by Shapiro, Benisek, and Pycha came in response to a Congressional Districting Plan signed into law by then-Gov. Martin O’Malley in October 2011. Critics at the time charged that the new congressional map was specifically designed to enhance the power of select incumbents while minimizing the voting power of minorities, rural voters and Republicans. The Washington Post editorialized: “The map, drafted under Mr. O’Malley’s watchful eye, mocks the idea that voting districts should be compact or easily navigable. The eight districts respect neither jurisdictional boundaries nor communities of interest. To protect incumbents and for partisan advantage, the map has been sliced, diced, shuffled and shattered, making districts resemble studies in cubism.”
Earlier this year, when the Supreme Court was deciding whether to take up the Three-Judge Court Act challenge, Judicial Watch filed the only amicus brief. The Supreme Court agreed with Judicial Watch and the petitioners and granted cert. on June 8, 2015.
“The Supreme Court should affirm the Three-Judge Court Act and remind the Fourth Circuit that the federal courts are not above the law,” said Judicial Watch President Tom Fitton. “The Fourth Circuit subverts the law by allowing one judge inordinate power to effectively decide whether voters can challenge how a state draws congressional and state legislative districts. The Supreme Court should now check this judicial legislating that makes it harder for voters to vindicate their constitutional rights.”
Judicial Watch is working with attorneys Meir Feder and Rajeev Muttreja of the Jones Day law firm, who prepared and filed this amicus brief on Judicial Watch’s behalf.
Judicial Watch first entered the Maryland redistricting battle on August 10, 2012, when it represented MDPetitions.com and Delegate Neil Parrott in its successful lawsuit to block a move by the state’s Democrat party to have an Election Day voter referendum on the state’s controversial gerrymandering plan removed from the ballot. Three weeks later, Judicial Watch again represented Delegate Parrott in filing a complaint against Maryland Secretary of State John McDonough and the State Board of Elections challenging the misleading language of the wording of the ballot question. The current constitutional challenge to the Maryland gerrymander is pending in federal court (Parrott, et al, v. Lamone, et al (No. 1:15-cv-01849).

As GMO crops contaminate organic varieties
CFS just filed a lawsuit against the U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (APHIS) under the Freedom of Information Act (FOIA), alleging that APHIS has violated FOIA by habitually failing to respond to requests for records related to genetically engineered (GE) crops, unlawfully delaying its responses, and preventing the public from being duly informed about this information.
APHIS does not respond in a timely manner to many of CFS’ requests; there have been at least 29. Two appeals and 10 requests have been ignored. The lawsuit asks the court to demand that the Department of Agriculture respond.
Cristina Stella, staff attorney for Center for Food Safety states:
“APHIS has a track record of irresponsible and inadequate regulation of GE crops. In the absence of thorough government oversight, public access to information about these crops becomes all the more critical. This lawsuit is necessary to stop APHIS from continuing to ignore its duty to provide the public with information that affects farmers, communities, and the environment.”
APHIS still oversees GE crops under regulations drafted in the 1990’s, and in March of this year suddenly abandoned its plans to update its GE crop regulations, which the agency had proposed to do since 2004. Under the current regulations, experimental field trials of GE crops have repeatedly been found to escape containment, and APHIS has refused to do its job to make sure that GMO cross-contamination does not occur.
Stella explains:
“The longer APHIS fails to use its full authority to regulate the environmental and agricultural harms from GE crops, such as transgenic contamination of nearby crops, pesticide drift, and endangerment of protected species, the more these harms will occur. CFS has been seeking information about these harms for over ten years—and for over ten years, APHIS has continually ignored our requests. It cannot continue to do so.”
This is the fourth time CFS has had to sue APHIS to compel compliance with FOIA, and is reportedly the most extensive challenge to APHIS’s pattern of unreasonable delays to date.

A congressional committee blasted the Environmental Protection Agency today for blocking release of documents related to the Gold King mine disaster, which poured deadly chemicals into the largest source of drinking water in the West.
“It is disappointing, but not surprising, that the EPA failed to meet the House Science Committee’s reasonable deadline in turning over documents pertaining to the Gold King Mine spill,” said Rep. Lamar Smith (R-TX). “These documents are essential to the Committee’s ongoing investigation and our upcoming hearing on Sept. 9. But more importantly, this information matters to the many Americans directly affected in western states, who are still waiting for answers from the EPA.”
Smith – who frequently spars with the EPA – is chairman of the House Science, Space, and Technology Committee. EPA director Gina McCarthy has been asked to appear and answer questions about the agency’s role in creating a 3-million-gallon toxic spill into Colorado’s Animas River on Aug. 5. Critics say McCarthy and the EPA have been unresponsive, secretive and unsympathetic toward millions of people who live in three states bordering the river.
For several days, the EPA didn’t notify the states of Utah, New Mexico or the Navajo Nation that the spill was coming their way. McCarthy waited a week before visiting Colorado and even then she refused to tour Silverton, the town nearest the Gold King mine where EPA contractors unleashed the toxic plume into waterways that feed the Colorado River. The agency withheld the name of the contractor working on the project and other details that are generally considered public information. Lastly, the Navajo Nation, which relies on the river for drinking water and farming, received an emergency supply from the EPA in oil-contaminated containers.

“This battle against predatory species cannot be won by military might
and technology alone. By now you know that this scenario involves

how can you hope to win a battle against an enemy when the enemy
possesses jump gates and mind control technologies so that any head of
government can be abducted and mind controlled at any time? And how can
you hope to win a battle against an enemy that can hide itself from your

“These predatory species, their technology and those humans that
voluntarily serve them, can only be defeated by harnessing the
cumulative might of the metaphysical and spiritual powers, as well as
the intelligence, of the people of earth.”
