Is this "real"?? How could such a document be executed without filing date on it anywhere??
This is not an affidavit. An affidavit is drafted based on personal experience by someone over the age of eighteen years. Each statement on the affidavit is numbered. Example:
My name is Joan (Smith) Jenkins. As Jane (Smith) Doe's sister, I am over the age of eighteen and competent to state the facts as true and not meant to be misleading in any way.
1. On June 1, 1945 Jane Smith was born in ___ County, _____State. Attached and incorporated herein by reference is a true and complete certified copy of her Birth Certificate marked Exhibit ___.
2. On Sept 30, 2000 Jane (Smith) Doe died in ___ County, ____ State. Attached and incorporated herein by reference is a true and complete copy of her Birth Certificate marked Exhibit ___.
The affidavit is then signed under oath under penalty of perjury before a notary public who dates and seals it.
Remember the "Robo" Signing debacle? The documents were not signed and notarized before a notary. Birth Certificates are Certified and sealed by a notary. Attorneys only sign declarations WITHOUT the oath which is how they get away with lying.
Check on line for the proper affidavit format for your state. The seal requires that it be given full faith and credit.
