Harvey Whittemore Convicted Of Making Illegal Campaign Contributions To Harry Reid

RENO, Nev. — A Nevada powerbroker who headed a billion-dollar real estate company and pulled the strings of state politics as a prominent lobbyist for more than a decade was convicted Wednesday of making illegal campaign contributions to U.S. Sen. Harry Reid.
Harvey Whittemore, 59, could face up to 15 years in prison and hundreds of thousands of dollars in fines after a federal jury returned guilty verdicts on three counts tied to nearly $150,000 illegally funneled to Reid's re-election campaign in 2007.
Later in the day, U.S. District Judge Larry Hicks declared a mistrial on a count of lying to the FBI after jurors said they were deadlocked on that charge.
Whittemore stood with his arms behind his back and shook his head slightly after the verdicts were read. He was convicted of making excessive campaign contributions, making contributions in the name of another and causing a false statement to be made to the Federal Election Commission.
Each count carries a maximum penalty of up to five years in prison and a $250,000 fine. The judge set sentencing for Sept. 23.
Assistant U.S. Attorney Steven Myhre said prosecutors will review the case before deciding whether to refile the charge of lying to the FBI during a February 2012 interview.
Dominic Gentile, Whittemore's lead defense counsel, said the convictions will be appealed to the 9th U.S. Circuit of Appeals. He said a case pending before the U.S. Supreme Court touches on similar issues related to the constitutionality of federal limits on campaign contributions.
Among other things, Gentile said the defense will challenge Hicks' refusal to allow the defense to reference an Alabama case against the Federal Election Commission.
"His conduct was protected by the First Amendment," Gentile told reporters at a news conference with Whittemore and his wife, Annette, shortly after leaving court.
Whittemore said he would reserve immediate comment on his conviction because of the emotional toll the two-week trial has taken on his family.
"My family and I have been through quite a bit," he said.
He said he will hold a news conference when all appeals are resolved to give the "complete and true story about who was behind this and how it got started."
Annette Whittemore said the couple is fortunate to have such a close, "strong-willed" family to support them.
"Harvey said throughout the trial the one thing they can't take away is our family and friends," she said.
Prosecutors said Whittemore gave money to family members and employees in 2007 to make contributions he had promised to Reid while concealing himself as the true source to skirt campaign finance laws.
Defense attorneys argued Whittemore broke no laws by giving $5,000 checks as gifts to family members and as gifts or bonuses to 29 employees and their spouses, who then each wrote checks for the maximum allowable $4,600 to the Senate majority leader's campaign fund, Friends of Harry Reid.
Myrhe said he hopes the verdicts send a strong message that U.S. campaign finance violations are serious offenses that will be prosecuted to the fullest extent of the law.
"These laws exist to protect the election process from undue influence and to provide transparency to the voting public," he told reporters outside the courthouse.
Assistant U.S. Attorney General Mythili Raman said Whittemore used "straw donors" to evade federal contribution limits.
"The cornerstones of our campaign finance laws are contribution limits and transparency, and Mr. Whittemore's crime was designed to undermine both," Mythili said in a statement from Washington.
Prosecutors said in closing arguments Tuesday that Whittemore had been the "king of the hill" in Nevada political circles, an insider who had worked his way onto the short list of many U.S. senators and representatives as someone to call when they needed to quickly find donors.
Whittemore once hosted an event for Sen. John Edwards, then a Democratic presidential hopeful, and a fundraiser at Reid's request for then-Senate Majority Leader Tom Daschle. He also helped arrange a reception attended by President Clinton during an environmental summit at Lake Tahoe.
"When he made these contributions, he was the ultimate insider," Assistant U.S. Attorney Eric Olshan said during his closing argument. "He was making millions of dollars and getting personal thank-you notes from the most prominent politicians in the country."
Reid had no comment on the verdicts, said Kristen Orthman, a spokeswoman for the senator.
Reid was not accused of any wrongdoing. He has said he was unaware of any potential problems with the money he received.
"I received $25 million. He raised $150,000," Reid told the Las Vegas Sun earlier this week. "I had money coming in from other places."
Myhre told jurors Whittemore was driven solely by greed – "not to get more money but greed in the sense of more power."
"It's about trying to be on the short list that senators and congressmen call when they need money," he said. "That's why he did it."
Myhre said after the verdicts that he couldn't comment on why the prosecution chose not to call Reid as a witness, or whether the case involving Whittemore has been completely closed.

The BLM was going to sell the cattle at one of the smallest cattle markets in Utah. No cattle markets in Nevada would take the cattle without a properly signed brand inspection (which the BLM cannot obtain without Cliven Bundy's signature). The BLM paid the owner of the Utah cattle market $300,000 to do the sale ('R' Livestock Connection in Monroe, Utah, owned by one Scott G. Robbins, according to the Utah Business Entity Search).
Utah Governor Herbert stepped in and forbid them from bringing the cattle into Utah without the legally required health and brand inspections (which again, require Bundy's signature) and that no feral cattle are allowed to be imported at all (per Utah statute). Because Bundy claims ownership over maybe 350-500 head of branded cattle, the other 500-700 estimated head of cattle would all be considered feral.

BLM officially backed off, but we suspect they are still secretly shipping them through Utah without any permission to do so, to "private" buyers in Colorado. The contract cowboys that the BLM hired to do the roundup are from Sampson Livestock in Meadow, Utah (traitors one and all).
From what I understand, Cliven Bundy owns both the Water Rights and Grazing Rights to all of the land where his cattle run. If Bundy failed to use them, the Grazing Rights would revert to the BLM and would be retired, while the Water Rights would revert to the State of Nevada, likely to be sold to the highest bidder (which would probably be a bidding war between mineral companies that are behind this action with the BLM and the City of Las Vegas which is thirsty for water and has had multiple attempts to buy water--through eminent domain from Utah farmers and ranchers--from Utah, which were all blocked by the Utah Legislature and Utah Governor Herbert).
Chances are, the BLM has already filed a claim on the water rights so that they can sell to the highest bidder (instead of the state) and are trying to get the cattle off to show that Bundy cannot use the water beneficially (much like what the US Forest Service and BLM both tried to do to Wayne Hage).
Now, for Cliven Bundy, he's not fighting this for his cattle or his own livelihood.
He recognizes that he will probably die before this fight is over. He has said multiple times that he is fighting this to wake people up about the tyranny of the Federal Government and also to help wake up the western states about getting the rights to their own land back from the federal government, which has repeatedly shut down ranchers and closed off land.

1st, get all the ranchers, farmers, Native Americans, and foresters that use the land for positive, sustainable production off of the land;
2nd, grab up all the resources;
3rd, close off the lands to public access including camping, hiking, horseback riding, hunting, fishing, boating, shooting, etc;
4th, sell off the resources to the highest bidder regardless of what that will do to the land, the local environment, or the economy;
5th, collect royalties on the resources in perpetuity;
6th, reduce and eliminate all SLS and PILT payments to the states, impoverishing them beyond belief.)
Anyway, thanks for posting about this. It is important for us to be able to raise the appropriate resistance.
My Response:
Thank you for sending your valuable insight. This contained the details we were all missing. From this we can now firmly conclude:
1. The BLM's actions are not only flatly illegal, they are unlawful, and not only unlawful, they are so unlawful that it took bribing someone with a $300,000 payoff to get them to accept stolen cattle from a Government agency. I do not think that could be topped ANYWHERE else in the world, other than with something like a Mexican drug cartel.
So we have a clear cut case of unlawful and prosecutable actions by the BLM in this case.
2. The real goal is to shut down public access to these lands. Obviously Cliven Bundy was not a jerk, and he let people go back there to explore. I myself have done a LOT of back country exploring, and noticed in the early 2000's that they closed down all the back roads about a half mile before the destination they used to go to to discourage people from exploring the wilderness.
Rather than drive the whole way, you had to get out and walk a considerable distance to scenes such as Swazy's leap, Paul Bunyans Wood Pile, and practically anywhere else you would want to go while out 4 Wheeling. And in the desert sun, that long of a walk was usually tough to do. This resulted in these types of locations no longer being visited, which effectively equaled a shut down.
3. The motives are for profit. Rather than manage the lands responsibly, the BLM is stealing it from it's rightful holders via corrupt actions and legal loop holes, and selling it off to corporate interests. This is cold hard proof that America is not a democracy, or more importantly a Republic, it is in fact a facist dictatorship where corruption rules and rights, freedom and honor are irrelevant.

Witnesses in Ohio and New
Jersey reported a golf ball-sized UFO hovering in the early morning sky that
emitted light on April 10, 2014, according to testimony in cases 55339 and
55342 from the Mutual UFO Network (MUFON) witness reporting database.At 1:15 a.m. today in Mahoning County, OH, the witness looked out a window facing west and saw what first appeared to be a flickering star in Case 55339.
“I retrieved binoculars and discovered it was golf ball-shaped and flickering different colors hovering in the sky,” the witness stated. “It lasted for about 25 minutes slowly moving west.”
The woman woke up her husband to look at the object.
“While I was trying to find out who to contact, I lost sight of it. My camera would not zoom in close enough to video or capture a photo of it.”
Then one hour and 45 minutes later, at 3 a.m. in Hewitt, NJ, an unrelated witness stepped outside and saw a bright object in the sky in Case 55342.
“It looked liked two things attached to each other, but I thought it was a result of looking through tree branches,” the witness stated.
The witness then went back inside and stepped out onto a second floor outdoor deck with an unobstructed view on the sky.
“I found the object,” the witness stated. “It was high in altitude. It was white-ish, with an orange-ish color. It looked like a baseball on top with a golf ball attached on the bottom. It was not the color of the other stars. It was brighter than any object in the sky. At first I thought it could be a planet, except it had two circular objects connected to each. An airplane flew below it flashing lights, green, red and white.”
The object then began to shoot laser-like beams.
“It shot one, two or three beams at a time. Never more than three at a time, and only from one side at a time. On the left, it shot a 45-degree beam upwards. On the left, it shot two beams making a 90-degree angle; one up, the other down. On the right, it shot a 45-degree angle. On the right it shot two beams making a 90-degree angle. One time it shot three beams with the 90-degree angle and one at the center. The beams/rays were 10-15 times the length of the larger circle.”
After about five minutes, the witness became cold and went inside.
“The object looked liked it was over Waywayanda State Park/Clinton Reservoir. This is the first time in 48 years I can say I have seen a UFO. I was a NYC Protestant minister for five years. I have been a NYC teacher for 14 years and I swear this is what I saw.”
Mahoning County, OH, has a population of 238,823. Hewitt is an unincorporated community within West Milford in Passaic County, NJ, population 7,639. Ohio and New Jersey MUFON are investigating.

HOW TO MAKE ALMOND MILK-WHEW
Here is how to make Almond Milk .. :-)
Here is how to make Almond Milk
Ingredients
2 cups (spring) water
1/2 cup raw almonds
Pinch of salt
Few drops or half stick vanilla (optional)
Few drops stevia to taste (optional)
Nut milk bag or cheese cloth
Directions
Let almonds soak overnight in water.(for better digestion).
In the morning rinse and drain the almonds. Then put them in your blender or jar. Add 2 - 3 cups of clean (spring) water and a pinch of salt.
Blend well.
Poor the almond milk in the nut bag. It's easiest if you have a large bowl underneath to catch the filtered milk.
Now holding the bag with one hand, squeeze the milk with your other hand (see the video of victoria above)
Add the other (optional) ingredients and blend briefly if needed.
Tips
If you dehydrate the almond pulp you can use it to make raw cakes and cookies.
Drink the milk as is or use in smoothies, soups or other recipes. Many friends save it in the fridge for about 2 days (shake before drinking), although I prefer to drink it fresh.
You can buy nut bags at most health stores and online. They're about 5 dollars each. You can also use nylons, cheese cloth or paint strainer.
Going to the store to buy soy, rice, nut or cows milk takes a whole lot longer and is much more expensive than making fresh almond milk.
A Vitamix (or any other blender) full with fresh almond milk costs you about 50 cents. You make the almond milk less than 10 minutes.

The bill is H.R. 4118, and it was approved by the House of Representatives on Wednesday by a 250-160 vote. (See the vote here, with “Yea” being the pro-gun vote.) The bill would suspend the individual mandate of the anti-gun ObamaCare program for one year, thus protecting the privacy of gun owners.
Normally, bills that pass out of one chamber are referred to a committee in the other chamber. But Senator Paul intervened by using a parliamentary technique to bring H.R. 4118 onto the calendar, rather than letting it be referred to a Senate committee.
Now that H.R. 4118 is “on the calendar,” this means that ANY SENATOR can now “move to proceed” to the bill, thereby CIRCUMVENTING HARRY REID’S STRANGLEHOLD over the Senate agenda. This is huge. It is important to gun owners because ObamaCare lays the groundwork for taking millions of Americans — those taking anxiety medications or who have PTSD or ADHD — and feeding their names into NICS’s gun-ban database.
It is important because, already, Obama, by executive fiat, has waived federal privacy laws to clear the way for these gun bans.

At GOA’s request, Senator Rand Paul (R-KY) has bypassed Harry Reid’s stranglehold on the Senate by bringing a pro-gun bill directly onto the Senate calendar.

It is important because it opens the door for “motions to proceed” to other pro-gun bills, including legislation restoring veterans' rights and creating national reciprocity for concealed carry rights (both of which have close to 60 votes).
It is important because it allows us to compile a target list of vulnerable senators who claim they want to "fix" ObamaCare -- just as Nancy Pelosi is trying to use a "discharge petition" in the House on the anti-gun amnesty bill to create a target list of GOP members.
Now, we are asking Rand Paul and other senators to begin circulating a letter of support in the Senate for a “motion to proceed” to the ObamaCare suspension, H.R. 4118.
There are procedural niceties to forcing consideration of the motion to proceed, but our parliamentary experts are working with senators to show them how to accomplish this -- and to get this bill sent to the President.
Well, you might ask, isn't Obama just going to veto H.R. 4118? GOA’s Legislative Counsel Michael Hammond discusses the answer to this question in a recent Red State piece.
But the answer is that sending H.R. 4118 to Obama would put him in a real bind. We believe that Obama will eventually be forced to delay the mandate, and that H.R. 4118 will create an inextricable conundrum for him -- as it will give credit to Rand Paul (and other pro-gunners) in the Congress for having forced the issue.
ACTION: Call or write your senators. Ask them to support the motion to proceed to H.R. 4118, which will suspend ObamaCare's individual mandate for one year.

“My granddaughter has been the target of harassing phone calls, strangers tracking her down and knocking on her door and negative, unwanted attention on the internet. This has gone too far and it needs to stop now. I deeply regret any role I had in creating this situation but now, as a grandparent, I say enough is enough."
“As I have already said, I am reimbursing my campaign for the amount spent on thank-you gifts produced by my granddaughter, a professional and talented artist who produced gifts for my staff and supporters that had a personal connection to my family and my hometown of Searchlight, Nevada. I believe my granddaughter is a very talented individual and I admire her work tremendously, but I've decided that it would be best to pay for her work out of my own pocket. My office is reviewing our records to ensure that we reimburse my campaign for the full amount.
"Landra and I are extremely proud of our granddaughter, we love her very much and we regret any unwanted attention that these stories have brought to her. At every step of this process, my actions and those of my campaign have been in full compliance with the law. At this point, I only wish that my granddaughter be spared from further attacks, harassing visits and phone calls, and other kinds of unwanted attention.”

I have heard from non-family members that Ryan Reid is a talented, sensitive artist. She did not deserve to have this spotlight shone on her. I have great sympathy for her. But heal thyself, grandpa. You brought us to her door.
UPDATE, 5:30 pm: Better open the checkbook again senator. On Dec. 4, 2012, nearly a year before Senate Majority Leader Harry Reid gave his granddaughter the nearly $17,000 for "holiday gifts," his campaign gave Ryan Elisabeth Reid $9,000 for "gifts for supporters."
The total is now about $26,000.
UPDATE, 3 PM: Ryan Elisabeth Reid, Rory Reid's daughter and Harry Reid's granddaughter, lists various "current supporters" on the site for her theater company, which is trying to produce a play at the Smith Center in Las Vegas about Alzheimer's. Among those listed are NV Energy and two of philanthropist Larry Ruvo's foundations.
The problem: NV Energy and Ruvo both say they never contributed to the theater group.
“The NV Energy Foundation has not given a grant to the Sprat Theatre Company," said NV Energy spokeswoman Jennifer Schuricht. "The organization applied for an NV Energy Foundation grant late last year. The review of this grant application, as well as applications from other nonprofits, was put on hold while we completed our merger. The merger is now complete and each of the pending applications will be considered through our Foundation review process."
A spokeswoman for Ruvo told me he had "received a request but decided at this time not to provide money."
And you thought this story couldn't get stranger?
One other "current supporter" listed is Peter Palivos, a businessman once represented by Rory Reid and who has given thousands over the years to Harry Reid and the Democratic Party. Oh, and he has had some issues.

Senate Majority Leader Harry Reid, asked about the controversy over his campaign paying his granddaughter nearly $17,000, said his decision soon after the story broke to reimburse his campaign was not an admission of wrongdoing.
"No, in fact it wasn't," Reid said Wednesday after being questioned in DC with other senators standing nearby. "We complied with all the rules. I just wanted to avoid, and (pause) I'm just very fortunate I could write that check. So it's all done. Everything was complied with beforehand..I'm not going to answer any...Read my statement."
And then he moved on after dismissing the reporter.
Avoid what, senator? Avoid an appearance of impropriety? Isn't that the usual phrase? Avoid the story lingering, perhaps?
The story may dissipate unless the Federal Election Commission finds that the gifts were not, as rules require, so "nominal." But the stench remains -- grandpa gives granddaughter money from campaign to give gifts (Reid's office won't itemize or describe). And the granddaughter, Rory Elisabeth Reid, gets to keep the money, whether it came from the campaign or from her grandfather, as it should have in the first place. How tone-deaf can he be?
Reid also surely hoped to stanch the bleeding after one day by reimbursing the campaign. The majority leader announced he was doing so within an hour of my post.
But this may not be over quite yet as Adam O'Neal of Real Clear Politics discovered that two well-known Reid supplicants, NV Energy and Caesars Entertainment, donated to his granddaughter's theater company:
His granddaughter has also received financial support for her fledgling New York theater company from two Nevada-based foundations that typically prohibit donations to organizations outside of their service areas. The foundations belong to gaming and energy companies that have also donated to the lawmaker.
Were they asked? Did they do it out of their generous spirits? I've asked both companies for a response.
A short time ago, and this could only happen in Nevada, Ryan Elisabeth Reid's father, Rory, spoke about the controversy on his own TV show called "What's Your Point?" on KSNV-TV. (Disclosure: My program appears there, too.)
It was surreal to watch. Here's the exchange:
"I'm very proud of my daughter," Reid the Younger, looking a tad uncomfortable, answered when prompted about the controversy by anchor Jeff Gillan.
Gillan: "What happened here?"
Rory Reid: "My daughter has a jewelry design company. My parents -- her grandparents -- called her and said, 'Would you make some gifts for our friends, family and supporters?' And she was happy to do it."
Oh? Grandpa and grandma called? How simple. How innocent.
Reid the Younger then suggested to Gillan that he should get "my Dad on the show" and: "He would probably talk about it for 30 seconds and then I would imagine you'd move on to something more important, which is what we should do."
Yes, this is very trivial. Just ask the FEC. Or, perhaps, another jewelry vendor who might have liked that $17,000 but had the wrong last name.
Move on. Nothing to see here.
But Gillan did not move on, saying some would say "this doesn't look good."
Reid the Younger: "I am told the accounting was done appropriately. I am going to take my father's word for it, and I'm not his spokesman. So if you want them, I can get you their phone number, too."
Wow. Really. Wow.
Reid the Younger and Reid the Elder have had their share of problems as the former told people after he lost to Gov. Brian Sandoval in 2010 that his father had misled him about running for another term in 2010. And Reid the Younger had his own campaign finance problems, for which he paid a $25,000 fine.
I understand why Rory Reid might feel a tad uncomfortable talking about his daughter and father on his own program. But the air of frivolity was something to behold. After a break, Reid the Younger said to Gillan, "You know I have another daughter and a son. Are we going to talk about them today?"
Ha ha ha. Isn't this all funny, folks?
As if to put an exclamation mark on a strange morning, Reid the Elder talked today about how his grandkids don't make enough money.
