Eleven Attorney Generals wrote to the Department
of Health and Human Services accusing it of illegal executive actions.
The seven-page letter, marked Dec. 26, pointed
specifically to President Obama’s healthcare “fix” which he announced in November:
The fix is flatly illegal under federal
constitutional and statutory law. We support allowing citizens to keep their health insurance
coverage, but the only way to fix this problem-ridden law is to enact changes
lawfully: through congressional action.
The United States Constitution’s Take Care Clause found in Article II, Section
3 states the President "shall take Care that the Laws be faithfully
executed."
Not only did Obama disregard the faithful
execution of his signature legislation, but he ignored the Constitution by not
getting the permission of both houses of Congress before putting into place a
new rule, according to the Attorney Generals.
More broadly, we are deeply concerned that this
Administration is consistently rewriting new rules and effectively inventing
statutory provisions to operationalize a flawed law. And the irony, of course,
is that the changes being put forth to fix the disastrous exchanges will
ultimately destroy the market and increase health insurance premiums for
consumers who played by the rules.
The undersigned Attorneys General support
allowing citizens to keep their health insurance coverage. However, the only
way to fix this problem-ridden law is to enact changes lawfully: through
congressional action. The illegal actions by this Administration must stop.
Ken Cuccinelli of Virgina, Greg Abbott of Texas
, Buddy Caldwell of Louisiana and Patrick Morrisey West Virginia were among

Recently Barack Obama attempted to sign up to Obamacare
on Washington DC exchange. He was denied as his identity could not be
confirmed. Subsequently Obama’s aide submitted
application to the DC exchange in person and there is no evidence whether in
person application was ever approved. Subsequently White House communications
officer stated to reporters, among them FOX news White House correspondent Ed Henry, that Obama could not sign up on the web site as his
identification information was scrubbed from the
databases.
Attorney Taitz submitted FOIA
request for information, which was granted, see attached response from FOIA
officer Mary-Beth Senkewitcz, who confirmed that
Washington DC Healthcare Exchange does not have
any order by any judge directing them to remove Obama’s
identification information from their database.
Further, Ms. Senkewitcz
stated that there is no mechanism to protect US tax payers from fraud and use
of ACA (Obamacare) by illegal aliens or people
using stolen Social Security numbers. Moreover, there is no reporting
requirement for employees of the Exchange to report identity fraud, identity
theft and use of stolen IDs by individuals
signing up for ACA.
Attorney Taitz has been vindicated as for 5 years now she has been working on
the issue of Obama’s use of a stolen CT Social
Security number 042-68-4425 of Harry (Harrison) Bounel, as well as Obama’s
use of fabricated IDs.
The fact that Washington DC exchange refused Obama’s attempt to sign up for his own signature
program due to the fact that they could not verify his identification, is a
sign from God, is a vindication of work of Dr. and Attorney Orly Taitz
and it is hilarious that it looks like Obama’s
own achievement program will do him in, will have him exposed and prosecuted.
Attorney Taitz has a number of challenges against
Obama going on now. Yesterday she filed pleadings

In regards to your new 2014 passport program:
Bad guy is a relative term...lol....If a person has not injured a
person or property he has committed no crime, in the eyes of lawful
minded people. Even if our statutory system tries to state
otherwise. Ironically most governments (control of your mind), are
guilty of the some of the most heinous crimes one could imagine.
There should be no restrictions for any freeman absent of injury to
his fellowman to be limited from his god given right to be or go
where ever he/she chooses. I push for the day where no borders
exist and we are able to travel freely unabridged, unmolested, by
the system governments.
It is time to push for all borders to be removed and let free men
be free. Time has come to remove all those that stand in the way of
true freedom. Passports, visas are slave tools and more control no
matter from what country. Why does anyone need to provide so much
personal information about themselves to the government to travel.

How the US Government Betrayed the Constitution and invented an
Imaginary Fascist One
The idea of having a strong Federal government was controversial in
the early United States, and one of the ways Federalists reassured
Americans that it wouldn't become tyrannical was to append a Bill
of Rights to the Constitution.
That attempt to prevent despotism has failed, because the Federal
government and its various agencies have set aside the Bill
of Rights as a dead letter, substituted for them a bizarre set
of interpretations of law, and either avoid having the courts
adjudicate their fascist fantasies or managed to have appointed
to the bench unethical or authoritarian judges that will uphold
virtually anything they do.
How corrupt our system has become is evident when even the New
Yorker emphasizes that a secret Senate report found that torture in
the Bush years was "unnecessary" and "ineffective." Not that it was
"unconstitutional."
The Eighth Amendment of the US constitution forbids 'cruel
and unusual punishment.' US courts have found that the Framers'
injunction was intended to be dynamic, and did not only forbid
those things thought barbaric in 1789 but those things contemporary
Americans would find cruel and unusual. As Cornell Law school put it,
in Weems v. United States it was concluded that the framers
had not merely intended to bar the reinstitution of procedures
and techniques condemned in 1789, but had intended to prevent the
authorization of "a coercive cruelty being exercised through other
forms of punishment." The Amendment therefore was of an "expansive
and vital character"41 and, in the words of a later Court, "must
draw its meaning from the evolving standards of decency that mark
the progress of a maturing society."
If a sheriff in a small town arrested a shoplifter and waterboarded
him 54 times, the sheriff would go to jail. Federal officials? Not
so much.
Let us just underline the Supreme Court's diction here in Weems. The
Framers had sought, they said, to forestall "a coercive cruelty
being exercised through other forms of punishment."
Coercive cruelty. Coercive cruelty was the hallmark of treatment of
Federal detainees in the Bush era. That was what Abu Ghraib, Bagram
and Guantanamo were about. Some prisoners were likely victims of
manslaughter by coercive cruelty (it is hard to know when to stop).
Waterboarding is illegal (not to mention setting German shepherds
on people to viciously bite them). Professor of Law Wilson R. Huhn
writes:
"Three major treaties that the United States has signed and
unambiguously ratified prohibit the United States from subjecting
prisoners in the War on Terror to this kind of treatment. First,
Common Article 3 of the Geneva Convention Relative to the Treatment
of Prisoners of War, which the Senate unanimously ratified in
1955, prohibits the parties to the treaty from acts upon prisoners
including "violence to life and person, in particular murder of
all kinds, mutilation, cruel treatment and torture; . . . outrages
upon personal dignity, in particular, humiliating and degrading
treatment."[18] Second, the International Covenant on Civil and
Political Rights, which the Senate ratified in 1992, states that
"[n]o one shall be subjected to torture or to cruel, inhuman or
degrading treatment or punishment."[19] Third, the United Nations
Convention Against Torture and Other Cruel, Inhuman or Degrading
Treatment, which the Senate ratified in 1994, provides that "[e]ach
State Party shall take effective legislative, administrative,
judicial or other measures to prevent acts of torture in any
territory under its jurisdiction,"[20] and that "[e]ach State Party
shall undertake to prevent in any territory under its jurisdiction
other acts of cruel, inhuman or degrading treatment or punishment
which do not amount to torture . . . ."
The United States has enacted statutes prohibiting torture and cruel
or inhuman treatment. It is these statutes which make waterboarding
illegal The four principal statutes which Congress has adopted to
implement the provisions of the foregoing treaties are the Torture
Act, the War Crimes Act and the laws entitled "Prohibition
on Cruel, Inhuman, or Degrading Treatment or Punishment of Persons
Under Custody or Control of the United States Government" and
"Additional Prohibition on Cruel, Inhuman or Degrading Treatment
or Punishment." The first two statutes are criminal laws while
the latter two statutes extend civil rights to any person in the
custody of the United States anywhere in the world.
The Torture Act makes it a felony for any person, acting under
color of law, to commit an act of torture upon any person within the
defendant's custody or control outside the United States. Torture
is defined as the intentional infliction of "severe physical or
mental pain or suffering" upon a person within the defendant's
custody or control. To be "severe," any mental pain or suffering
resulting from torture must be "prolonged."[29] Under this law,
torture is punishable by up to twenty years imprisonment unless the
victim dies as a result of the torture, in which case the penalty
is death or life in prison."
But somehow employees of the US military, the CIA and other Federal
agencies managed to ignore all that. So yes, unnecessary and
ineffective. But also, illegal and unconstitutional and treasonous.
Then of course there is the National Security Agency's gutting of
the Fourth Amendment ban on unreasonable search and seizure. As long
as the unreasonable search and seizure happens on the internet,
apparently that is all right. What arrogance, what hypocrisy,
what fascism.
An honest appeals court just ruled that the government needs
a warrant to put a tracking device on your car and follow
you around by GPS. But your cell phone metadata also reveals
your movements, and the NSA is scooping that information up,
effectively following you around without a warrant, exactly what
the court just found unjustified. But the Federal government (yes,
the Obama administration) has succeeded in keeping NSA practices
out of the courts.
While few Americans care that the NSA was intensively spying on
the Mexicans, French and Germans, even on German chancellor Angela
Merkel's private cell phone, they should. The Bill of Rights were
once a point of inspiration for human rights activists around the
world. Much of what the youth who led the Arab upheavals of 2011
wanted was enshrined in the Bill of Rights. American ideals and
rule of law were part of America's soft power in the world. The
European Union is suddenly less cooperative because of our allies'
outrage at being spied on. No one wants to be like creepy peeping
toms or vicious torturers, and that is what Americans have become.
Moreover, the NSA foreign spying is racist. Yes, on top of everything
else, it involves a racist hierarchy. The US doesn't intensively
spy on Canadians, British and Australians, i.e. on what were called
in the 19th century 'Anglo-Saxons.' It is only the inferior races
that Washington subjects to surveillance.
But all that is crashing and burning as the US government has
betrayed those ideals over and over again. We're being massively
spied on by our government, our location, the people we call,
the websites we visit, all being monitored constantly. And if
the government decides we are terrorism suspects, we could well be
tortured. Martin Luther King's principle of civil disobedience would
be categorized as terrorism today, and if he were active in our time,
instead of naming a Federal holiday after him, the government would
have MLK waterboarded by police dressed up as military commandos.

In regards to your new 2014 passport program:
Bad guy is a relative term...lol....If a person has not injured a
person or property he has committed no crime, in the eyes of lawful
minded people. Even if our statutory system tries to state
otherwise. Ironically most governments (control of your mind), are
guilty of the some of the most heinous crimes one could imagine.
There should be no restrictions for any freeman absent of injury to
his fellowman to be limited from his god given right to be or go
where ever he/she chooses. I push for the day where no borders
exist and we are able to travel freely unabridged, unmolested, by
the system governments.
It is time to push for all borders to be removed and let free men
be free. Time has come to remove all those that stand in the way of
true freedom. Passports, visas are slave tools and more control no
matter from what country. Why does anyone need to provide so much
personal information about themselves to the government to travel.

How the US Government Betrayed the Constitution and invented an
Imaginary Fascist One
The idea of having a strong Federal government was controversial in
the early United States, and one of the ways Federalists reassured
Americans that it wouldn't become tyrannical was to append a Bill
of Rights to the Constitution.
That attempt to prevent despotism has failed, because the Federal
government and its various agencies have set aside the Bill
of Rights as a dead letter, substituted for them a bizarre set
of interpretations of law, and either avoid having the courts
adjudicate their fascist fantasies or managed to have appointed
to the bench unethical or authoritarian judges that will uphold
virtually anything they do.
How corrupt our system has become is evident when even the New
Yorker emphasizes that a secret Senate report found that torture in
the Bush years was "unnecessary" and "ineffective." Not that it was
"unconstitutional."
The Eighth Amendment of the US constitution forbids 'cruel
and unusual punishment.' US courts have found that the Framers'
injunction was intended to be dynamic, and did not only forbid
those things thought barbaric in 1789 but those things contemporary
Americans would find cruel and unusual. As Cornell Law school put it,
in Weems v. United States it was concluded that the framers
had not merely intended to bar the reinstitution of procedures
and techniques condemned in 1789, but had intended to prevent the
authorization of "a coercive cruelty being exercised through other
forms of punishment." The Amendment therefore was of an "expansive
and vital character"41 and, in the words of a later Court, "must
draw its meaning from the evolving standards of decency that mark
the progress of a maturing society."
If a sheriff in a small town arrested a shoplifter and waterboarded
him 54 times, the sheriff would go to jail. Federal officials? Not
so much.
Let us just underline the Supreme Court's diction here in Weems. The
Framers had sought, they said, to forestall "a coercive cruelty
being exercised through other forms of punishment."
Coercive cruelty. Coercive cruelty was the hallmark of treatment of
Federal detainees in the Bush era. That was what Abu Ghraib, Bagram
and Guantanamo were about. Some prisoners were likely victims of
manslaughter by coercive cruelty (it is hard to know when to stop).
Waterboarding is illegal (not to mention setting German shepherds
on people to viciously bite them). Professor of Law Wilson R. Huhn
writes:
"Three major treaties that the United States has signed and
unambiguously ratified prohibit the United States from subjecting
prisoners in the War on Terror to this kind of treatment. First,
Common Article 3 of the Geneva Convention Relative to the Treatment
of Prisoners of War, which the Senate unanimously ratified in
1955, prohibits the parties to the treaty from acts upon prisoners
including "violence to life and person, in particular murder of
all kinds, mutilation, cruel treatment and torture; . . . outrages
upon personal dignity, in particular, humiliating and degrading
treatment."[18] Second, the International Covenant on Civil and
Political Rights, which the Senate ratified in 1992, states that
"[n]o one shall be subjected to torture or to cruel, inhuman or
degrading treatment or punishment."[19] Third, the United Nations
Convention Against Torture and Other Cruel, Inhuman or Degrading
Treatment, which the Senate ratified in 1994, provides that "[e]ach
State Party shall take effective legislative, administrative,
judicial or other measures to prevent acts of torture in any
territory under its jurisdiction,"[20] and that "[e]ach State Party
shall undertake to prevent in any territory under its jurisdiction
other acts of cruel, inhuman or degrading treatment or punishment
which do not amount to torture . . . ."
The United States has enacted statutes prohibiting torture and cruel
or inhuman treatment. It is these statutes which make waterboarding
illegal The four principal statutes which Congress has adopted to
implement the provisions of the foregoing treaties are the Torture
Act, the War Crimes Act and the laws entitled "Prohibition
on Cruel, Inhuman, or Degrading Treatment or Punishment of Persons
Under Custody or Control of the United States Government" and
"Additional Prohibition on Cruel, Inhuman or Degrading Treatment
or Punishment." The first two statutes are criminal laws while
the latter two statutes extend civil rights to any person in the
custody of the United States anywhere in the world.

Violates Patient Privacy Laws to Bring Down Dr. Burzynski
USA Today inadvertently revealed that the FDA has released private medical
records to the media—without patient consent. Action Alert!
As we report in our
article, “Inside
USA Today’s Smear Campaign Against Dr. Burzynski,” USA Today recently
published a series of misleading articles, vilifying Dr. Stanislaw Burzynski, a
cancer pioneer specializing in hard-to-treat cancers, who has saved many lives.
In the course of their otherwise
reckless “reporting,” USA
Today inadvertently exposed the FDA’s violation of patient privacy
laws, destroying the reputation of a natural health practitioner—specifically,
the sharing of complete patient records without consent.
In the 1980s—and again
in 2012—the Texas Medical Board (TMB) charged this caring and pioneering doctor
with breaking a law that didn’t exist, and tried to revoke his medical license.
By the USA Today’s
own admission, he was cleared each time, and
numerous investigations later—including an appearance before the Texas Supreme
Court—found there was no violation of any law or standard of care.
“With our treatments, we
can save 20,000 American lives annually,” Dr. Burzynski told ANH-USA. “But the
FDA is covering this up with insignificant details….The FDA wants to bury this
information from the public.” This is evident in the FDA’s recently released
warning letter to Dr. Burzynski, and the agency’s apparent cooperation with USA Today.
Part of the FDA’s job is
to issue warning letters to drug, food, and dietary
supplement manufacturers, as well as drug trial sponsors, in order to notify
them of possible FDA violations and encourage voluntary compliance. Warning
letters to drug study sponsors, called “483s,” are the most common: they
account for about 60% of all warning letters. In 2012,
the FDA issued 787 483s.
Although common warning
letters aren’t particularly newsworthy, they can be effectively wielded as a
political tool: warning letters have been used to censor consumer Internet speech and deny
consumer access to at-home DNA testing. But there’s a new, even
more alarming trend in warning letters: these interim letters, which have no legal significance,
are being cited as evidence by state medical boards of practitioner misconduct.
Essentially, warning
letters—which are intended to give practitioners, researchers, and
manufacturers a voluntary avenue to address agency concerns without legal
repercussions—are being used in a coordinated effort by the FDA and state
medical boards to damage the reputations of and pursue legal action against
integrative practitioners. We’ve seen this type of FDA/state medical board
“cooperation” before—but according to healthcare lawyer Rick Jaffe,
a recent 483 sent to Dr. Burzynski and the USA
Today’s unusual interest in it, is an update and expansion of this
highly questionable tactic.
The USA Today’s article—the third in a series attacking Dr.
Burzynski—details the warning letter and the FDA inspection that
lead to it, as if such an investigation and letter were novel and unique. In
actuality, it’s completely routine; Dr. Burzynski is currently following normal
procedure and has recently submitted his response, which among other things details
the incorrect statements made in the warning letter.
The article is a
win/win/win for the media, the FDA, and the Texas State Medical Board: USA Today gets to tout how
it was “right” about Dr. Burzynski (the first paragraph of the story boasts
that Dr. Burzynski was “the subject of a USA
Today investigation”); the FDA—which has failed to successfully
shut down Dr. Burzynski lifesaving clinic—gets to take a pot-shot at Dr.
Burzynski outside of the court; and the TMB garners public support for its
vendetta against the Burzynski clinic. Who loses? Dr. Burzynski’s patients. Read our article on how several cancer
sufferers have been denied his potentially life-saving treatment.
The USA Today article sparked
a media firestorm. In the process, however, they inadvertently revealed evidence
of FDA misconduct and collusion between the FDA and USA Today:
- A
high-level Burzynski Clinic staff member told ANH-USA that one concerned
patient called the FDA to learn more about Dr. Burzynski’s innovative
treatments, and the
FDA sent the patient a link to the USA Today article.
- The
FDA violated Burzynski patients’ privacy. “A lot of our patients were
obviously very irked about the article, and called the USA Today team,” a
Burzynski staff member told us. “The parents of one young patient called a
USA Today
reporter, who then
sent the parents their own child’s confidential medical records—which the
reporter had received from the FDA. The family frantically
called us [the clinic], ‘I just got an email from USA Today, they sent
me our son’s full medical records!’” The reporter had sent not only the son’s medical
records, but those of other patients as well.
The FDA is not supposed to release medical records to the public. The agency has always had inappropriate relationships with state
medical boards and the media, but now they’ve crossed the line to outright
violation of patient rights. ANH-USA is currently assessing the legal
ramifications of the FDA’s actions. In the meantime, it’s time to call for a
full congressional investigation into the FDA’s actions, including its
inappropriate information-sharing with media contacts and state medical boards.

OKLAHOMA CITY (AP) — A satanic group unveiled designs Monday for a
7-foot-tall statue of Satan it wants to put at the Oklahoma state Capitol,
where a Ten Commandments monument was placed in 2012.

"The monument has been designed to reflect the views of Satanists in Oklahoma City and beyond," temple spokesman Lucien Greaves said in a statement. "The statue will also have a functional purpose as a chair where people of all ages may sit on the lap of Satan for inspiration and contemplation."
The Satanic Temple maintains that the Oklahoma Legislature's decision to authorize a privately funded Ten Commandments monument at the Capitol opened the door for its statue. The Ten Commandments monument was placed on the north steps of the building in 2012, and the Oklahoma chapter of the American Civil Liberties Union has sued to have it removed.
Similar requests for monuments have been made by a Hindu leader in Nevada, an animal rights group and the satirical Church of the Flying Spaghetti Monster.
In response, the Oklahoma Capitol Preservation Commission recently placed a moratorium on considering any new requests.

"Anybody can
still make their request, but we'll hold off on considering them until the
lawsuit is adjudicated," commission Chairman Trait Thompson said.The push by the Satanic Temple has rankled elected leaders in this conservative state known as the buckle of the Bible Belt, who say such a proposal would never be approved by the commission.
"I think you've got to remember where you are. This is Oklahoma, the middle of the heartland," said Rep. Don Armes, R-Faxon. "I think we need to be tolerant of people who think different than us, but this is Oklahoma, and that's not going to fly here."
While Greaves acknowledges the Satanic Temple's effort is in part to highlight what it says is hypocrisy of state leaders in Oklahoma, he says the group is serious about having a monument placed there.
The group already has raised nearly half of the $20,000 it says it needs to build the monument.
"We plan on moving forward one way or another," Greaves said.
Another Oklahoma legislator, Rep. Earl Sears, called the group's effort "an insult to the good people of the state."
"I do not see Satanism as a religion, and they have no place at the state Capitol," said Sears, R-Bartlesville.
On its website, the Satanic Temple explains that it "seeks to
separate Religion from Superstition by acknowledging religious belief as a
metaphorical framework with which we construct a narrative context for our
goals and works.
"Satan stands as the ultimate icon for the selfless revolt
against tyranny, free & rational inquiry, and the responsible pursuit of
happiness," the website says.

Atheistic Satanists are a little more complex. They believe the idea of satan represents the inherent qualities of man which Christianity denies. Individualism, pride, and self indulgence are all seen as good things. To be fair, Western culture is, by the definition of Satanism, much more Satanist than Christian. But like most false Christians these Satanists are really just #$%$ who want to do whatever they want. They won't be the ones who will build societies. Just like capitalism has no balance and will destroy itself, they are the exact same way.

of religion; it opens the door for every religious group (regardless of focus)

How 'bout that phrase "or probititing the exercise thereof"??? Strictly speaking you can put up all the Satans you want and all the crosses as well. How 'bout that phrase "or probititing the exercise thereof"??? Strictly speaking you can put up all the Satans you want and all the crosses as well. As a Christian myself, I am not afraid of the competition since my belief supports what I know to be the better cause. My government is forbidden to make the choice for me.....or anyone else.

Pffttt.... New Yorkers. Since when did satan
have three horns? Is that boy smiling or is that the youngest male ever to have
such a full mustache? Look at his left hand... is satan threatening to shoot
someone? Is he a doctor? why is hiding a medical symbol in his crotch? Why does
it look like he's wearing a buddhist monks robe... that's highly offensive
towards Buddhists. Those are wings? Who drew this #$%$... looks like he's about
to get eaten by a giant clam. And why is the satanic "temple" in new
york applying to have their "religious" monument put up while at the
same time proclaiming that they aren't a religion but a group that "seeks
to separate Religion from Superstition by acknowledging religious belief as a
metaphorical framework with which we construct a narrative context for our
goals and works." ...man talk about hypocrisy.
Anywho... this is ridiculous and I couldn't give a #$%$ but in all honesty my wife is watching 10 year old reruns of Friends right now and I've got nothing else better to do. If only I could sit on goat mans lap and think about that little boys smile mustache.

While I can agree to an extent that most
people would be familiar with Satan as being the embodiment of evil and sin,
the state should've considered many factors before allowing a Christian statue
to be depicted in a public place away from an area of worship. It is almost as
if they are wishing to tie the state government with an established religion,
and it is incredibly intolerant. A wise man named Immaneul Kant once came up
with the idea that if an action is not suited for everyone, it is not suited
for anyone (summarized). This is a perfect example. If the Christians get what
they want, the Satanists have a suit against the state for religious intolerance.
If the Satanists get what they want, Christians everywhere will be outraged for
obvious reasons not needing mention. There will be no good outcome to this, and
the state of OK should've known better.

It's nice to know that Oklahoma has bold representatives like Mr. Sears who are unafraid to boldly point out that only REAL churches deserve to be intertwined with state government, thus reinforcing the important constitutional principle of separation of Satan and state.
