HOPEWELL, Va. (WTVR) – A Hopewell circuit court judge has ordered that a Marine veteran detained over anti-government Facebook posts be released from a psychiatric hospital.
CBS 6 News’ Catie Beck said the judge dismissed the case Thursday against Brandon Raub. The judge said the original petition for Raub’s detention contained no facts. In other words, there was no information on why Raub was being held — and the judge deemed this violated his civil liberties. 
As a result, the judge ruled law enforcement has no grounds to hold Raub.
Beck said the judge is in the process of writing an order for Raub’s release. He is expected to be released from a the hospital in Salem, Virginia Thursday afternoon.
The decorated U.S. Marine veteran was questioned by FBI agents about his Facebook postings and then hauled away from his Chesterfield County home in handcuffs last Thursday.
CBS 6 checked his criminal history and found it to be clean. And Brandon Raub’s mother told CBS 6 News’ Mark Holmberg that her son he had no mental health history. [READ MORE: Mother of detained Marine vet says he’s a patriot, not a threat]
“He never was violent or psychotic or anything like that,” Cathleen Thomas told CBS 6. “There were just conversations we had back and forth, very deep.”

Cell phone video shot by a friend that showed Raub being thrown to the ground and then put into a police car has gone viral on Youtube. His story, portrayed as a patriot whose free speech rights have been violated, has shot across the country.
A number of protestors gathered outside John Randolph Medical Center Monday, where Raub was being detained. Earlier this week, a judge approved a motion to transfer Raub to the Veterans Hospital in Salem.
The Rutherford Institute, a Charlottesville-based civil liberties group whose lawyers represented Raub, argued his arrest was was improper and unlawful. However, federal agents contend that Facebook posts made by Raub were “terrorist in nature.”
A former Marine who served two tours in Afghanistan with Raub told CBS 6 News’ Catie Beck Monday that Raub is a courageous and patriotic young man with showed no signs of posttraumatic stress disorder. Additionally, the man said he believes a mental evaluation would find Raub sane — and not someone who is capable of a terroristic threat.

I think Col Russell Herrman would have wished they'd not taken him to one of those Veterans Hospitals where they tortured him for days in there. Everyone has a right to speak except those that speak. That seems to be the new motto. Romney a crook. Obama loaded to the gills with illegal vatican bank accounts....and, our television news inundates us with misinformation and misdirection from their puppet masters. We're running out of time here in this dimension. How will God gaze upon us the greatest creation as we crawl to him approaching ascension knowing we're more then conquers through the blood of Jesus but we act like morons afraid of everything. Do something positive to help this planet even if its just pointing at the media bobbleheads on CNBC, CNN, FOX, MSNBC, etc and say with your divine authority reveal the truth now.

This young man needs to go after these de facto agents! They did not have a lawful arrest warrant with an injured party as required by the US Constitution. Therefore the procedure that was taken, as is almost always the case, was a violation of Due Process of Law!!
He needs to file a Title 42 lawsuit against these agents and the judges and lawyers that violated his rights!!!!

I agree 100%. In disgustingly unlawful incidents like this, every name of every irresponsible reckless individual involved should be blathered...I mean BLATHERED AND BLABBERED across the country so they can be shamed and embarrassed for being involved. That means the names of FBI agents, local law enforcement and on and on in newspapers, on-line, TV, etc. And not buried ia a paragraph with hundreds of words! Listed and entirely capitalized to show their ignorance, criminal behavior and treason.

One more thing...this is exactly why that 2700 page Healthcare Act was passed! This enables them and puts "THEM" in a position to do away with dissidents at all levels at any time for any reason! That could include not only the mental illness thing but torture and even death if the death squad deems it necessary. That includes the right to getting into your bank account! What kind of tyranny is this???? Every freaking senator and representative who voted for it should be charged with treason and dragged from office. And what NITWITS would vote for something they never read??? Duh!

Did the Commander in Chief Obama order Brandon to be placed in the Mental Hospital and have him Doped Up?
If so then Criminal Charges on Obama should be filed as Obama made a medical decision in which only Certified Doctors can make, therefore Obama made a medical decision per ObamaCare prior to it even being initiated!
