Federal Judge Reinstates Unconstitutional NDAA

Late Monday night a federal judge in New York, Raymond Lohier, granted the Obama administration an “emergency” stay that temporarily blocks a ruling by U.S. District Judge Katherine Forrest last week blocking the NDAA.

“Lohier offered no explanation or rationale for the temporary stay. However, the Justice Department has asked the appeals court to block the injunction,” Politico reported late last night.

The Obama administration characterized the ruling by Forrest as unconstitutional.

The Justice Department said the ruling was “unprecedented” and argued that the executive has the right under the Constitution to detain anyone indefinitely without due process. The Fifth Amendment specifically mentions due process of law.

The NDAA also violates the “equal protection” clause of the 14th Amendment stating that all people be treated the same under the law.

The federal government argues that the National Defense Authorization Act did not expand its authority beyond what already existed under the 2001 Authorization for Use of Military Force (AUMF) , as interpreted by judges in Guantánamo Bay habeas corpus cases.

“This pernicious law poses one of the greatest threats to civil liberties in our nation’s history,” writes Brian J. Trautman. Under AUMF, “this law can be used by authorities to detain (forever) anyone the government considers a threat to national security and stability – potentially even demonstrators and protesters exercising their First Amendment rights.”

Documents produced by the Department of Homeland Security and fusion centers and subsequently leaked to the media target numerous organizations and individuals as threats to national security — including supporters of Ron Paul, returning veterans, and other “rightwing extremists.”

In the months ahead, the NDAA will likely become an invaluable tool for the government as the economy finally topples over a cliff and a violent conflagration engulfs the Middle East. Iran has promised to shut down the flow of oil out of the region if the United States and Israel invade. This would undoubtedly have a devastating effect on the world economy and would result in massive protests against the government.

By mid morning on Monday, September 17, as Occupy Wall Street protesters marched around the perimeter of the Federal Reserve Bank of New York, all signs that an FRPD (Federal Reserve Police Department) existed had disappeared. The FRPD patrol cars and law enforcement officers had been replaced by NYPD patrol cars and officers. That decision may have been made to keep from drawing attention to a mushrooming new domestic police force that most Americans do not know exists.

Quietly, without fanfare or Congressional hearings, the USA Patriot Act in 2001 bestowed on the 12 privately owned Federal Reserve Banks, domestic policing powers.

Section 364 of the Act, “Uniform Protection Authority for Federal Reserve,” reads: “Law enforcement officers designated or authorized by the Board or a reserve bank under paragraph (1) or (2) are authorized while on duty to carry firearms and make arrests without warrants for any offense against the United States committed in their presence…Such officers shall have access to law enforcement information that may be necessary for the protection of the property or personnel of the Board or a reserve bank.”

The police officers are technically known as FRLEO, short for Federal Reserve Law Enforcement Officer. The system has its own police academies for training, their own patch and badges, uniforms, pistols, rifles, police cars and the power to arrest coast to coast without a warrant. They have ranks of Sergeant, Lieutenant, Captain and a recruitment ad campaign with the slogan: “It’s about respect and recognition from your peers. It’s you.”

According to a former St. Louis Federal Reserve Law Enforcement Training Instructor, the officers are trained on pistol, rifle, auto-rifle, sub-gun and shotgun with manufacturers encompassing Smith & Wesson, Glock, Remington and Armalite.

The FRLEOs employed by the Federal Reserve Board of Governors in Washington, D.C. are considered employees of the Federal government since the Board is a government entity.

Each of the 12 Federal Reserve Banks, as settled law under Lewis v. United States confirms, is a private corporation owned by commercial banks in its region. An email to several of the Federal Reserve Banks confirmed that they regard their FRLEOs to be privately employed by the bank.

 

The San Francisco Fed ran an ad for Captain Specialist, noting that “you will be charged with gathering and disseminating law enforcement intelligence information to the District.” It also noted that the individual would need to “obtain and maintain top secret clearance.” Typically, that clearance level is reserved for only the highest positions in the Federal government.

A recruitment ad for the Richmond Fed indicates their FRLEOs would be plugged into the nation’s criminal databases: “The Law Enforcement Unit has an immediate opening for a Communications Center Operator, reporting to the Center leadership team in Richmond, Virginia. The pay is $32,458 — $40,573…[the officer will query] “information from a variety of law enforcement data bases for information, wants/warrants, intelligence, driver’s license and vehicle information, etc.” The Cleveland Fed notes that the job “may include, but would not be limited to: use of deadly or non-lethal force…”

FRLEOs now even have their own Federal Reserve Policemen’s Benevolent Association, Local 385. The group’s Facebook page [3] carries the statement that it is a “government organization.” The site says the group “was established to create a fraternal organization for its membership and to act on behalf of the members as a liaison between the New Jersey State PBA and all other police agencies within the state and the country.” The connection to New Jersey likely stems from a now deceased police officer, James Rose, from Moonachie, New Jersey, who was a FRLEO in New York and helped to establish Local 385. In addition, the Regional office of the New York Fed is located in East Rutherford, New Jersey.

In addition to regular policing functions, the Federal Reserve police have been observed in airports with rifles, functioning as dignitary protection teams. Various recruitment ads confirm that this is sometimes part of the job.

Buttressing the private nature of the Federal Reserve Banks, the Maiden Lane building that the Occupy Wall Street protesters were swarming around this morning, chanting “F*** the Fed,” was purchased on February 28, 2012 by the New York Fed, which had previously been leasing the building. According to the press release the “Federal Reserve Bank of New York (New York Fed) today announced that it has acquired the building at 33 Maiden Lane for $207.5 million from Merit US Real Estate Fund III, L.P. and established a new, wholly owned limited liability company called Maiden & Nassau LLC to serve as owner of the building.”

The Federal Reserve Building up for sale at 301 Rosa L. Parks Avenue in Nashville has this slogan engraved on the building: “Federal Reserve System Through Which Our Banks and Government Join Hands to Further the Enduring Prosperity of American Commerce, Industry and Agriculture.”

There is nothing in that motto that shows a concern for the average American. And that’s the problem inherent in the continuing venting of anger against Wall Street banks and their perceived crony patrons at the Fed who gave them trillions of dollars in low-cost bailout loans and then fought a court battle to keep the loans a secret. That domestic policing functions have now been added to the mix can only create more suspicions and hostility.

There is also the obvious question as to why the expense, training and potential liability of armed police would be necessary when all of the Federal Reserve Banks are in cities with large municipal police forces. With private bankers sitting on the Boards of each of these Reserve Banks, many of whom are officers of banks under criminal investigation, there is the serious need for Congressional investigation into how the Nation’s criminal databases are being used by the private sector as well as the further chilling of protest and dissent from another new sheriff in town.

And volcanoes flooded early Mars with H2O, meteorite study hints. Mars could have entire oceans’ worth of water locked in rocks deep underground, scientists say. The finding suggests that ancient volcanic eruptions may have been major sources of water on early Mars—and could have created habitable environments. According to a new study, Martian meteorites contain a surprising amount of hydrated minerals, which have water incorporated in their crystalline structures. In fact, the study authors estimate that the Martian mantle currently contains between 70 and 300 parts per million of water—enough to cover the planet in liquid 660 to 3,300 feet (200 to 1,000 meters) deep. “Basically the amount of water we’re talking about is equal to or more than the amount in the upper mantle of the Earth,” which contains 50 to 300 parts per million of water, said study leader Francis McCubbin, a planetary scientist at the University of New Mexico in Albuquerque. And if water exists today in the Martian mantle, that means the red planet likely had a lot of water in its interior all the way back to the moment the planet formed. “We don’t have to rely on sources like comets and asteroids to bring in water afterward,” McCubbin said. And if that’s the case for Mars, it’s probably the case for the other rocky planets—Mercury, Venus, and Earth—as well as for some large asteroids. “Earth is not unique,” McCubbin said. “We should be finding water nearly everywhere in the solar system.” Water Boiled Out of Mars Lava McCubbin’s team found water while analyzing meteorites that had been blasted off the Martian surface byasteroid impacts and sent careening to Earth. The meteorites are basaltic, which means the rocks must have formed from deep magmas brought to the surface during volcanic eruptions. By carefully examining a mineral called apatite, McCubbin’s team found hydroxyl ions—a form of water that contains an oxygen atom bound to a hydrogen atom. The presence of hydroxyl means that standard water—oxygen bound to two hydrogens—was also present in Martian magma. But because the hydroxyl is more tightly bound to rock than ordinary water, the ions remained behind when the rest of the water boiled out of the cooling lava. From the amount of hydroxyl in the meteorites, it’s possible to reconstruct how much water is in Mars’s interior, McCubbin added. “We’re using apatite as a hydrometer to record how much water was in the rock before it degassed,” he said. For instance, similar studies of lunar apatite in 2010 found that the moon’s interior is a hundred times wetter than previously thought. Furthermore, he said, the Mars meteorites examined in the new study came from extremely young basalts, only 150 to 350 million years old. That means all large Martian eruptions throughout the planet’s history probably carried substantial water to the surface—including eruptions that happened during the Noachian, the period when ancient Mars was warm enough to have possibly hosted liquid water on the surface. For 2009 though, Nancy Pelosi & Harry Reid bypassed George Bush entirely, passing continuing resolutions to keep government running until Barack Obama could take office. At that time, they passed a massive omnibus spending bill to complete the 2009 budgets. And where was Barack Obama during this time? He was a member of that very Congress that passed all of these massive spending bills, and he signed the omnibus bill as President to complete 2009. If the Democrats inherited any deficit, it was the 2007 deficit, the last of the Republican budgets. That deficit was the lowest in five years, and the fourth straight decline in deficit spending. After that, Democrats in Congress took control of spending, and that includes Barack Obama, who voted for the budgets. If Obama inherited anything, he inherited it from himself. In a nutshell, what Obama is saying is, "I inherited a deficit that I voted for and then I voted to expand that deficit, four-fold, since January 20th". There is no way this will be widely publicized, unless each of us sends it on! PLEASE DO YOUR PART !!!

As a nation we have stood by while our children are poisoned with mandatory vaccines, chemicals in their favorite foods and vile mental conditioning in the public school system and the idiot box we allow them to watch. We have accepted without objection the idea that our government or any other on earth can provide personal security or protection and traded the certainty of liberty for the illusion of safety and security. What Is Next on the anti-firearm agenda?

I’m sure the television news told you all about the U.N. Small Arms Treaty being passed. (See Last Post) No??? The Rothschild Zionist network at ABC, NBC, CBS, CNN, FOX and MSNBC were busy following the Protocol 12; Control the Press to the point that even newspapers didn’t report the event on the last page. The reason television news and newspapers are not informing the American citizens is to prevent the militias of the several states from forming and beginning to train. A very cleaver idea; don’t you think? They want to keep you in the dark until it is too late.
The old argument that the Senate will not ratify this treaty, can easily be debunked, when you remember that the Senate did not pass the U.N. Agenda 21. In fact they refused to pass it, but it got passed by an Executive Order of Bill Clinton. The same will be true with this treaty and it really doesn’t matter who wins the presidential election.
You cannot enter into negotiations on a treaty and not sign the results of the consensus. It’s an old trick of the globalists to get the opposition into negotiations. It works at the local level and the global level. The United States entered into the negotiations on the U.N. Small Arms Treaty and now we are stuck with it.
With the passage of the United Nations Small Arms Treaty, what can be expect in the future? The globalists have 6 years to disarm us, at two year intervals. Expect legislation, more false flag operations and continued dumbing down of America’s youth, and the world’s youth, to accept the yoke of global government.
Enter H.R. 6241 and S. 3458, identical bills in both houses that are currently in committee; titled Stop Online Ammunition Sales Act of 2012 . When passed, in person sales of ammunition will be required, as well as registration of amounts exceeding 1,000 rounds, or 1,000 rounds over a week period. The idea behind this legislation is to make you pay more in the future for ammunition and to register sales. It will also limit your selection to what ever is available at a local store.
Another bill before Congress, sitting in committee is Gun Show Loophole Closing Act of 2011. It is H.R. 591, in the House and S.35 in the Senate. It would permanently ban Gun Shows if passed.
In a disgusting display of needed donations, Gun Owners of America has this one listed as an ex post-facto Bill, which it is not. It is H.R. 308 in the House and S. 32 in the Senate. It is titled Large Capacity Ammunition Feeding Device Act . It would prohibit the transfer or possession of a semi-auto clip that can hold more than 10 rounds of ammunition. When this Bill passes, clips that hold more than 10 rounds will have a serial number and be sold strickly for police, the government agencies and military.
Right now the gun rights groups: N.R.A., G.O.A and National Gun Rights Org. are looking for money. They think they can outspend Rothschild, Soros and the Rockefeller Fund to secure your rights. That is impossible, spend your money to stock up while you still can. All firearms groups know it their last ‘Hoorah’ for fund raising and they know it, they have not even admitted they have lost.
Here is another one held up in committee, Fix Gun Checks Act of 2011. This one penalized states that don’t report enough violators to the National Instant Criminal Background Checks. In the Senate it is S. 436.
Doing a search for ‘assault weapons’ this Bill came up, titled Child Gun Safety And Gun Access Prevention Act Of 2011. This one raises the age of ‘Juvenile’ to ‘under 21′ with penalties for transfer of guns, ammunition, high capacity clips to anyone under 21 who might commit a crime. This one is bound to pass, because of the New Speak in the title. The socialists will love it.

The author and I would be friends, because he fully understands how controlled the press is and comments about Roman Circuses on the television.      I was impressed that the Bible withstood my toughest attacks on it like the enemies of God would try to discredit it. I know how to mimic the other side's thinking when necesary. That is a valuable skill to have such as in military intelligence. Duplicating the Communist side of thinking, I foresaw the reason to set up the Slavic Royal Alliance Ruse years ago and anticipating what was necessary to make it work, the entire plan worked like clockwork when the crisis came soon afterwards. When the former employee of National Detective Agency in Wash., D.C. talked with "Comrade Girty" who was the secret head of the entire Communist spy system and KGB apparatus in America, he tricked this Soviet spy boss into thinking that he was a Communist sent from New York City headquarters by talking about that military cadet who tricked Moscow with his "Slavic Royal Alliance Ruse." Girty fell for it and told him of nearly the entire Communist setup in America. Girty did admit to him which he later reported to J. Edgar Hoover at the F.B.I. that but for this Slavic Royal Alliance Ruse, Moscow would have defeated America and won the Cold War. Moscow did order my murder after that in rage that I had cost them victory in the Cold War when they had cracked White House security and knew all the secret military plans of America. They couldn't set up their plan again for the military defeat of America and then takeover of the entire world for Communism. Now many Christians would criticize me for showing the initiative to save America from a pending nuclear World War III or else military takeover of Wash., D.C. from within by the Girty mentioned "100 Columns" of the Communist Party in America. They were 100 American leaders who were secret Communists, around 34 were leaders inside the federal government including six members of Congress, and the rest national leaders but outside of government. All this was reported to J. Edgar Hoover at the F.B.I. by this then employee of National Detective Agency who had been briefed by me before on the details to the Slavic Royal Alliance Ruse and I had met this Girty who had to be a double-agent for Soviet intelligence as he knew about my contact with the I.R.A. which Washington intelligence did not know about. So my Slavic Royal Alliance Ruse not only saved America from military defeat by the Soviet Union according to Comrade Girty, head of the Soviet spy ring in America and unknown to the F.B.I. until exposed by my Slavic Royal Alliance Ruse which flushed him out and exposed his identity. It also created giant cracks in Communist security such as information on "The 100 Columns" in America which the F.B.I. had never heard of until Girty talked too freely and told all!

     Just before I set up this Slavic Royal Alliance Ruse on Soviet intelligence, I had met this strange man when walking my dog. I had a few weeks prior briefly died and bargained with Jesus Christ for my life back. I made promises which I have always honored since then and my life was given back. This strange man stopped me by telling me that I had had a recent brush with death, but the Lord let me live. I had not even told my parents about this brush with death where I saw what death is all about. I in later years talked with Dr. Richard Eby of Victorville, VA who had died for up to 18 hours according to a hospital in Chicago, Illinois and then shocked the hospital by suddenly coming back alive. Dr. Eby said my description of death from my "scientific" observations on it matched his observations from his "medical" training as a doctor. We became best friends due to this common bond. Dr. Eby's main message for mankind he said Jesus in Paradise told him to take back with him was that the Christians were not ready for the return of Jesus, but needed to straighten up so they would be ready when Jesus does return. Dr. Erby confided to me in later years that the Christians were not reforming as Jesus wanted them to, so Dr. Eby asked Jesus to take him away before the return of Jesus as the lack of reform of Christians would Dr. Eby seemed to imply delay the return of Jesus to earth. Pastor Dan of Nigeria who was dead in a morgue for 3 days and then revived to life said Jesus returned him to earth to tell them that they must get ready for His return to earth as they were definitely not doing the Will of Jesus to be ready for His return. Pastor Dan talked of being in Paradise while dead. Christian TV hosts would change his testimony to Pastor Dan said he had been for 3 days in Heaven. Pastor Dan was accurate and never said that. Getting back to this strange man who met me when I was walking my dog while home from the military academy, he talked of many amazing things. He caught me so much by surprise I forgot to ever ask him his name. Almost every important thing he has predicted for my life has now come true. This is the final test to see if the final part of this wide spreading prophecy all comes true as most of it has already. He said that America was not right with God and therefore God would not save America from pending national death. However, God would allow me if I wanted to do it to save America from pending national death. He was referring to my Slavic Royal Alliance Ruse which did work! He described the strengths and weaknesses of both the Catholic and Protestant churches. When I have told Christians what he said, all have commented that this made very good sense to them. He did predict a later clash with Wash., D.C. I win it and the American people would live and become a Christian people again before God instead of lip service but not in reality Christians. If I would not fight for Christianity in America against Wash., D.C. which God fiercely opposed by this time, then God would let America fall and be destroyed. For reasons not explained to me, God approved of me to fight for the survival of America and God would not stop me. But if I was not willing to help the American people stand up for the cause of God in America, then America will fall and great will be the Wrath of God upon America in that day. Those words are approximate as this happened a lot of years ago and I remember the message from then, but not all the exact words now. If I were addressing a truly Christian nation now, I would repeat the special gifts that God has given to all races each unique in creation by God, but Christians act too much like pagans and I sometimes I cannot tell which is which as there is no difference between them too much of the time, so what was stated on races by this strange prophet, I cannot repeat. I will repeat this much of what this prophet said. If churches help you become a better Christian, then they are of value to you to become closer to God.  If they do not help you become a better Christian in life, then they are of no value before God or to you.

      Mitar Tarabich (1829-1899) who came from Kremna, Serbia is an amazing modern prophet. Everything he predicted came true and he predicted the big events of mankind correctly and in correct time periods right up to now. About the only thing left to be fulfilled is a better answer than oil for the energy needs of future mankind. And the only nation guaranteed survival in a horrible World War III and spared from the harm of this World War III horrible beyond human imagination is the nation with the community with the three crosses in the mountains. When the World War III was over, they would be the blessed people on the face of the earth. Does it take an Albert Einstein genius to figure out when everything this Mitar predicted all came true and he predicted the big events correctly for mankind when no one else did on earth, it might even be smart to listen to his tip how not to get clobbered in a pending World War III? Be sure that you are the nation with the community with the three crosses in the mountains which is my Camelot Project in symbolism. You survive because God told you that He would bless the nation with this community and protect this nation from being annihilated in a coming World War III.

     Complex religious issues are involved and so I will keep this simple as the debates go endless otherwise on this.You had the apparition of the Virgin Mary at Fatima, Portugal in 1917. This reported Virgin Mary said that there would be a movement shortly taking over Russia which would be incredibly evil. This was 1917 and Communism soon took over Russia. World War I had been a punishment from God becauseman  loved sin and did not want to live by the teachings of God given to mankind. If mankind did not return to God, then later there would be a World War II more horrible than World War I. If mankind did not get the message yet, then there would be a World War III and entire nations would be annihilated. We had the Miracle of the Sun at Fatima where for 22-32 miles radius people saw what appeared to be the sun spin out colored shafts of light across the sky for around 10-12 minutes and then it looked like the sun plunged towards the earth. Around 70,000 to 100,000 people at Fatima saw this and people screaming out that this was the end of the world. The sun returned back up in the sky and now it was a sunny day after having a constant rain for many hours before. Clothes that were drenched were now totally dry. Deep puddles of water and mud people stood in at Fatima were now all dried up and gone in 10-12 minutes flat. Many incurable people were instantly cured of these incurable ailments in what people judged had to be Miracles of God. The event was supernatural. Beyond that, you investigate and find out the whole story. The message was bigger than what I reported here, but this was a major part of this message delivered there. The Virgin Mary was reported was appealing to mankind so there would not be this World War III where entire nations would be annilated. This event in 1917 discredited the atheistic Marxist government of Portugal and it toppled from power later on due to this event which all Portugal had seen or else knew about.

     If I were to have believed the logic of critics of what I have already said who say the Bible backs them, not me, then you all in America would now be dead or else enslaved already under a Soviet created Communist government and nation of what was once America. The Slavic Royal Alliance Ruse which you said was wrong in principle if I follow your criticisms of me from your claimed position of Bible, I should not have done and instead let all of you die or else be enslaved for life. I will give the Roman Catholic Church credit on one important point. They teach it is part of Christianity that we have the God-given right to the national defense of our nation. This agrees that God commanded Israel at times to take up arms and defeat their enemies out to defeat them and destroy Israel forever. Of course, war should never be a "politician war" created for fraudulent claimed grounds, but we are allowed even as Christians to resort nationally to force of arms to protect our families, our nation, and even fellow Christians sometimes from immiment massacre and annihilation. Right now, the argument of my would-be Christian critics is let the 8 million Coptic Christians all be massacred as the Muslims plan to do once they have organized their United Nations of Islam planned for soon. Kill off all the Christians in Lebanon and all Christians in other parts of the Middle East.

     Americans, you had better take your enemies seriously as they take themselves seriously. They plan to soon annihilate or else at least mass massacre a huge number of Americans soon if you don't care and just wait for the enemy to carry out his plans against America. Our marshmallow Obama is a joke to serious military leaders in other nations. Weakness tempts attack on America. Ronald Reagan was a good Christian when he said, "Peace through strength!"

     As for your national economics, Obama economics stink to high heaven! They are nonsense approaches to the economic problems of America and not based upon economic reality. You are losing your industrial base to America and since you the American people act like you don't understand what keeps industry in America, you are uneducated in economic principles, better pass my Omni Law and fast. I trained under six of the most brilliant economists of America and Europe. And once the Omni Law is passed, I will bring in top economic talents with me and we will get the American economy moving fast and in the right direction after that. You American people have God-given talents in you which can boom the American economy. But you cannot do anything to help the American economy until you get this poorly disguised Obama Communist dictatorship from Wash., D.C. out of your face. Prosperity does not bless nations who do not believe in freedom for the talented in their nation to do their job for their nation. I see so much genius in America and wasted until we break the police state mentality in Wash., D.C. and teach them what a system of law based upon freedom really is as they have forgotten now what 1776 was all about.

So what you have done, dear heart, is that you have dropped not a pebble, not a stone, not a rock, but a very big boulder into what is really a very small pond. I want you to understand this. There are beings who may never, ever watch this video. Or the videos that spin out from this project. And the bringing forward of that reality, the declaration of it in such a succinct, clear, non-invasive way – because your video has come in peace and for me that was very important, that it be low-key, that it not have any element of fear, that it be infused with love and celebration and joy and you have made very sure of that so – that is all becoming communicated to the subconscious, and the unconscious of the collective. So the entrainment is changing.

So understand that piece. But in the physical reality of the leadership it has been reserved and it is, can we say, being pushed up the chain of command. White House demands military prisons for Americans under NDAA

The White House has placed an appeal for an emergency stay to reverse last weeks ruling made banning the president’s power to indefinitely detain Americans without charge!

RT – The White House has asked the US Second Circuit Court of Appeals to place an emergency stay on a ruling made last week by a federal judge so that the president’s power to indefinitely detain Americans without charge is reaffirmed immediately.
On Wednesday, September 12, US District Court Judge Katherine Forrest made permanent a temporary injunction she issued in May that bars the federal government from abiding by the indefinite detention provision in the National Defense Authorization Act for Fiscal Year 2012, or NDAA. Judge Forrest ruled that a clause that gives the government the power to arrest US citizens suspected of maintaining alliances with terrorists and hold them without due process violated the Constitution and that the White House would be stripped of that ability immediately.
Only hours after Judge Forrest issued last week’s ruling, the Obama administration threatened to appeal the decision, and on Monday morning they followed through.
At around 9 a.m. Monday, September 17, the White House filed an emergency stay in federal appeals court in an effort to have the Second Circuit strip away Judge Forrest’s ruling from the week earlier.
“Almost immediately after Judge Forrest ruled, the Obama administration challenged the decision,” writes Chris Hedges, a Pulitzer Prize-winning journalist that is listed as the lead plaintiff in the case. According to Hedges, the government called Judge Forrest’s most recent ruling an “extraordinary injunction of worldwide scope,” and Executive Branch attorneys worked into the weekend to find a way to file their stay.
“The Justice Department sent a letter to Forrest and the Second Circuit late Friday night informing them that at 9 a.m. Monday the Obama administration would ask the Second Circuit for an emergency stay that would lift Forrest’s injunction,” Hedges writes. “This would allow Obama to continue to operate with indefinite detention authority until a formal appeal was heard. The government’s decision has triggered a constitutional showdown between the president and the judiciary.”
Attorney Carl Mayer, a counsel for Hedges and his co-plaintiffs, confirmed to RT early Monday that the stay was in fact filed with the Second Circuit.
“This may be the most significant constitutional standoff since the Pentagon Papers case,” Carl Mayer says in a separate statement posted on Mr. Hedge’s blog.
Bruce Afran, who serves as co-lead counsel along with Mayer, tells Hedges that the White House could be waging a war against the injunction to ensure that the Obama administration has ample time to turn the NDAA against any protesters participating in domestic demonstrations.
“A Department of Homeland Security bulletin was issued Friday claiming that the riots [in the Middle East] are likely to come to the US and saying that DHS is looking for the Islamic leaders of these likely riots,” Afran tells Hedges. “It is my view that this is why the government wants to reopen the NDAA — so it has a tool to round up would-be Islamic protesters before they can launch any protest, violent or otherwise. Right now there are no legal tools to arrest would-be protesters. The NDAA would give the government such power. Since the request to vacate the injunction only comes about on the day of the riots, and following the DHS bulletin, it seems to me that the two are connected. The government wants to reopen the NDAA injunction so that they can use it to block protests.”
Hedges, who has previously reported for papers including the New York Times and the Christian Science Monitor, argued that his job as a journalist requires him to routinely interact and converse with persons that may be considered terrorists in the eyes of the US government.
Under the NDAA, Americans “who was part of or substantially supported al-Qaeda, the Taliban or associated forces that are engaged in hostilities against the United States or its coalition partners” can be held in prison cells “until the end of hostilities,” vague verbiage that essentially allows for those suspect of such associations to be decided under the discretion of US President Barack Obama or any federal agent underneath him.
“Because the language is so vague in this law,” Mr. Mayer explains to RT, “if any journalist or activist is seen as reporting or offering opinions about groups that could somehow be linked not just to al-Qaeda but to any opponent of the United States or even opponents of our allies”
“I spent many years in countries where the military had the power to arrest and detain citizens without charge,” Hedges wrote when he first filed his suit in January. “I have been in some of these jails. I have friends and colleagues who have ‘disappeared’ into military gulags. I know the consequences of granting sweeping and unrestricted policing power to the armed forces of any nation. And while my battle may be quixotic, it is one that has to be fought if we are to have any hope of pulling this country back from corporate fascism.”
Monday morning, Hedges once more responded to the White House’s relentless attempts to reauthorize powers granted under the NDAA, asking, “If the administration is this anxious to restore this section of the NDAA, is it because the Obama government has already used it? Or does it have plans to use the section in the immediate future?”
“The decision to vigorously fight Forrest’s ruling is a further example of the Obama White House’s steady and relentless assault against civil liberties, an assault that is more severe than that carried out by George W. Bush,” writes Hedges. “Obama has refused to restore habeas corpus. He supports the FISA Amendment Act, which retroactively makes legal what under our Constitution has traditionally been illegal — warrantless wire tapping, eavesdropping and monitoring directed against US citizens. He has used the Espionage Act six times against whistle-blowers who have exposed government crimes, including war crimes, to the public. He interprets the 2001 Authorization to Use Military Force Act as giving him the authority to assassinate US citizens, as he did the cleric Anwar al-Awlaki. And now he wants the right to use the armed forces to throw U.S. citizens into military prisons, where they will have no right to a trial and no defined length of detention.”
In his latest blog post, Hedges acknowledges, “The government has now lost four times in a litigation that has gone on almost nine months.”
