Effects of the Affordable Care Act on Economic Productivity

He has written for the Chicago Tribune, the Chicago Sun-Times, the New York Times, and the Wall Street Journal, and is the author of three books, including Side Effects: The Economic Consequences of the Health Reform.

The following is adapted from a speech delivered on October 24, 2014, at a Hillsdale College Free Market Forum in Indianapolis, Indiana.

The topic of my talk today is the economic side effects of the Affordable Care Act (ACA), sometimes referred to as Obamacare. Since most of the economy has to do with labor and work, that’s where I’ll start. But, first a caveat. I’m an economist, and I’m going to talk about some parts of this complex law that have an impact on the labor market. Other parts of it relate to health and medicine, and because I’m not a doctor or a biologist, I’m not going to speak to those parts. From an economic or labor-market perspective, I’m going to explain how the costs of the ACA outweigh its benefits. But I can’t measure or estimate its effects on health care. I leave that to others.

The key economic concept required to understand the labor market effects of the ACA is what economists call “tax distortions.” Tax distortions are changes in behavior on the part of businesses or households for the purpose of reducing their taxes or increasing their subsidies. We call them distortions because they don’t occur for real business or real personal reasons. They occur because of the tax code. A prime example of a tax policy that creates distortions is the ethanol subsidy—technically it is a credit, not a subsidy—whereby gasoline refiners are subsidized on the basis of how many gallons of gas they produce with ethanol. Because of this subsidy, businesses change the type of gas they produce and deliver, people change the type of gas they use—which affects engines—and corn is used for ethanol instead of as feed or food. Nor do the distortions stop there. Arguably, food prices are increased due to the reallocation of corn to different uses—and when food prices are higher, restaurants and households do things differently. There are distortions economy-wide, all for the chasing of a subsidy.

To be clear, just because taxes cause distortions doesn’t mean that we should never have taxes. It just means that in order to get the full picture when it comes to policies like an ethanol subsidy or laws such as the ACA, we need to take into account the tax distortions in order to ensure that the benefits we are seeking exceed the costs.

The Employer Mandate/Penalty/Tax

So what are the tax distortions that emanate from the ACA? Here let me simply focus on two aspects of the law: the employer mandate or employer penalty—the requirement that employers of a certain size either provide health insurance for full-time employees or pay a penalty for not doing so; and the exchanges—sometimes they’re called marketplaces—where people can purchase health insurance separate from their employer. The mandate or penalty is intended, of course, to encourage employers to provide health insurance. And the exchanges are where the major government assistance is provided, since those who purchase insurance in an exchange typically receive a tax credit. As I’ll explain, taken together, the penalty on employers and the subsidies in the exchanges add up to a tax on full-time employment—a tax that you pay if you work full time but not if you work part time or don’t work at all. And the problem with that, of course, is that by taxing full-time work—which is the same as subsidizing part-time work and unemployment—you get less of the former and more of the latter two.

How does this full-time employment tax work with regard to the employer mandate? As I mentioned, the penalty applies only in the case of full-time employees and only to employers that don’t offer health coverage, and it applies only in those months during which those full-time employees are on the payroll. If an employee cuts back to part-time work, the employer no longer has to pay the penalty. The dollar amount of the penalty doesn’t depend on whether the employee is rich, poor, or middle class—if he works full time, the employer must either provide insurance or pay the penalty. And the penalty is indexed to health insurance costs, so every year those costs increase more than the economy and more than wages, the penalty will increase more than the economy and more than wages.

The current penalty is usually described as $2,000 per year per full-time employee. But it’s really more than that, because the penalty, unlike wages, is not deductible from business taxes. So in terms of a salary equivalent, the penalty is closer to $3,000 a head. Needless to say, this penalty reduces competition in the labor market: It discourages employers from competing for full-time employees—which, if you’re an employee, is a bad deal. Also there are a lot of employers who are not going to pay the penalty because they don’t meet the size threshold of 50 or more employees, and employees are going to suffer because these small employers won’t want to become large employers and therefore subject to the penalty.

Furthermore, this mandate or penalty—and by this time it should be clear that we can think of it as a tax on having a full-time employee—disproportionately harms low-skill workers. Think about it this way: How many hours does a worker have to work each week to produce the $3,000-per-year of value to justify keeping his job or being hired? For a minimum-wage worker, that comes to eight hours a week, all year round—one day of work a week for the government due to the ACA alone. Higher-skilled employees can obviously produce $3,000 worth of value in less time, so the penalty will have less of an impact on them.

Subsidized Health Insurance Exchanges

What of the tax distortions that come from the subsidized health insurance exchanges or marketplaces? To begin to think about this, imagine paying full price for your health care. How does full price work? Well, you pay the full price. The health care provider doesn’t look at your tax return and adjust the bill accordingly. So we would never call paying full price for health care an income tax of any kind. Or imagine there is a discount on the full price—for instance, 30 percent off for everybody, regardless of income. In that case it’s still not an income tax. No matter how much you earn, you pay the same price. But what if the discount (or subsidy) is tied to your employment situation? Not to your income, but to your employment situation. That’s how the exchanges work. If you have a full-time job with an employer that offers coverage—which is the case for most employees in our economy—you don’t get the subsidy offered through the exchanges. If you want to get the subsidy, you need to become a part-time worker or spend time off the job. In other words, this discount, too, is a tax on full-time employment. Of course, no politician ever calls it a tax. But when you are in a group of people that doesn’t receive a subsidy that people in another group receive, that’s a tax.

So far I have oversimplified things, because there isn’t just one subsidy for everybody in the exchanges. The subsidy depends on your income. So there’s also an income tax built in. The more you earn, the less of a discount you get. Indeed, if you earn enough, the discount disappears. The folks analyzing this law in Washington made the mistake of focusing only on the income-tax aspect of the subsidy. There will be only eight million people in the exchanges, they figured, so eight million people now have a new income tax. That’s no big deal, they thought. They were oblivious to the fact that they were implementing a full-time employment tax on the majority of American workers. In all of the economic analyses of the ACA, there was no mention of this full-time employment tax—despite the fact that it’s the single biggest tax in the law.

In describing the size of this tax, again I find it useful to think in terms of how many hours per week somebody has to work to create enough value to replace the government subsidy he is losing because of his full-time status. There are a number of full-time workers who may have to work ten, 20, or even 30 hours a week to create the value they would get for free if they worked part time or didn’t work under the ACA. In the old days, working part time meant you earned less, and your family had less to spend than if you worked full time. Under this new system, on the other hand, if you have a family of four and make $26 an hour, dropping to part time can actually improve your financial condition by qualifying you for well over $1,000 per month in subsidies through the health care exchanges—an amount that exceeds what you would make by working the extra eleven hours per week. This is an economically perverse situation.

We have decades of research showing that when you tax something, you get less of it. So if you tax labor, you get less labor. By that I mean on average—I don’t mean that every worker responds to every labor tax. That’s obviously not the case. But on average, if you tax labor you get less labor. As a result of the ACA, then, we are going to have fewer people working and less value created overall.

Nor will the loss of productivity end there. As with the ethanol example, there will be more and more tax distortions from the ACA as it continues to roll out. Businesses will change the way they do business, whether it’s by bending over backwards to stay below 50 employees or by having more part-time employees and fewer full-time employees—not because these policies create value or satisfy customers, but because they avoid penalties or enhance subsidies. The Chicago Cubs baseball team changed over to more part-time employees this past summer, and as a result there was a day when the grounds crew couldn’t handle the weather—reducing the value of the game for the fans in general. Incentives and disincentives in the tax code ripple through the economy in unimaginable ways.

This has not been well understood. Some analysts, for instance, have argued that not many employers, relatively speaking, are going to end up paying the penalty, so the harm of the penalty will be limited. And that’s just wrong. Adam Smith pointed out in The Wealth of Nations that if there’s a type of employment that’s evidently either more advantageous or less advantageous than other types of employment, so many people would crowd into it in the former case, or desert it in the latter case, that its advantages would soon return to the level of the other types. In terms of the ACA, whereas only some workers will experience the penalty directly, it will be felt across the economy because workers will move out of the penalized businesses—and customers will do the same, since those penalties are passed on to them in the form of higher costs. We’ll all experience it. Economists and politicians who looked at this law made the mistake of basing their analyses on models in which nothing matters except what happens directly to the individual worker and his employer. That is not how economics works.

In summary, the ACA has three major taxes in it. Two are taxes on full-time employment and the other is a tax on income. They may be implicit, they may be hidden, politicians may not call them taxes, but that’s what they are. Their economic impact on workers varies widely, affecting low-skill workers the most. They create all kinds of productivity problems and will have visible and permanent effects on the economy. I have estimated that employment will be three percent less over the long term because of the ACA, and that national income—or GDP, if you like to think of it that way—will be two percent less. If you look at the productivity costs alone—forgetting the fact that there will be a number of people not working anymore—they come to $6,000 per person who gets health insurance because of the law. And I’m not beginning to count the payments needed for health care providers.

In conclusion, I can make you this promise: If you like your weak economy, you can keep your weak economy.

Economic Adviser to the Prime Minister announced the appearance of Mohammed Saleh, Sunday, that the government will adopt the budget in 2014, with some adjustments for 2015, stressing that the budget next year is the most difficult on budgets.

Saleh said in a statement to the Agency / information / The Ministry of Finance has identified the middle of next month to send the budget deadline and is committed to working on it.

He added that "there are a number challenges facing the budget in 2015, including price fluctuations and other changes such as war on Daash and draining funds from the center of efforts to create a priority in preparing the budget for the People's Army and the crowd." 

Asserting that "the 2015 budget is the most difficult in the history of budgets being faced with these challenges amid strenuous efforts to overcome them." 

Saleh pointed out that "the budget will cancel many of the excess expenditure and not subject to political bargaining As in previous budgets," noting that he "will be relying on the budget in 2014 in the preparation of the budget next year, with modifications as per the developments stage and to give priority to projects in the power, water and large."

In my recent article on How The IRS Violates It's Own Code, the facts were carefully presented which definitively proved how the IRS deliberately lies and misleads Americans by unlawfully seizing (stealing) assets by circumventing the law.

This article will prove how the American worker and employer alike have been hoodwinked regarding the withholding process. The purpose behind this chicanery is not to benefit America, but to further enrich the coffers of the private banking cartel aka the Federal Reserve.

There is no need for an income tax, flat tax, sales tax or any other direct tax. All Americans are encouraged to look behind the curtain so that they might fully understand the grand plunder sucking the lifeblood out of our economy. See: http://www.devvy.com. Employers must withhold

So says the Great Deceivers, the Internal Revenue Service. Employers are routinely told that they must, under certain provisions of the tax code, withhold taxes of all sorts from an employee's paycheck. Funny thing though, when sincere Americans request that the IRS send its representatives to public seminars on this issue, the IRS is no where to be found.

Robert Schulz, Chairman of the Board of We the People Foundation for Constitutional Education, Inc., made a swing through 37 cities in April and May of 2003. Before he arrived at each destination, he sent, via certified mail, an invitation to both the IRS and U.S. Attorney's offices to come to his public seminars and correct him if he was giving out the wrong legal facts regarding withholding. What could be more reasonable?

In not one of those 37 cities did either DOJ or IRS send any representative, begging the question, "Why not?" Schulz is a man of honesty and integrity. His invitations to DOJ and IRS were sincere; his only desire was to be absolutely certain that the information he communicated to attendees was legally factual. Instead, he was met with the same usual arrogance in the form of silence. Why do you suppose that is?

Lynda Wall is an expert in the field of withholding and has been assisting employers and employees alike for many years in understanding the law regarding this issue. We the People Foundation for Constitutional Education, Inc. will be holding ournational convention in Washington, DC this coming January and Ms. Wall will give a two hour, comprehensive seminar that will firmly establish in anyone's mind once and for all how the IRS lies to employers about this process and the lawful remedy.

According to Ms. Wall:

"The IRS will tell employers and employees that according to IRC section 3402(a)(1) of their code: ".......every employer making payment of wages shall deduct and withhold upon such wages a tax determined in accordance with tables or computational procedures prescribed by the Secretary."

"However, this is what the law really says: no (federal, state, city or county) municipal corporation shall levy or collect or cause to be levied or collected any tax upon the income, or any part thereof, of any person, resident or nonresident (also known as the "Full Paycheck Law"). Employers are prohibited from taking amounts from pay for federal or state taxes, fees or other charges absent the lawful, knowing, written consent of the employee.

"The Code of Federal Regulations clearly advises the employers at 26 CFR §31.3402(p)-1(a) "An employee who desires to enter into an agreement for withholding...shall furnish his employer with Form W-4 (or its equivalent) for withholding. The furnishing of such Form W-4 shall constitute a request for withholding." Then, 31 CFR §215.2(n)(1) clearly tells the employers they cannot take amounts from the workers' pay for any form of State tax UNLESS the employee VOLUNTARILY elects to have such sums withheld.

"Consensual taking from pay occurs ONLY when an employee voluntarily elects in writing to volunteer to participate in any (federal, state, city or county) municipal corporate tax, program, insurance (disability, Medicare), trust (social security), including non-judicial tax levy, garnishment for taxes, tax offsets, tax interest or penalty and the employer consents such a request."

The fruits of your labor belong to you

Pursuant to 26 CFR §31.3402(p)-1(b)(2), either the employer or the employee may terminate the withholding agreement (W-4 or its equivalent) by furnishing a signed written notice to the other. An employer cannot lawfully take amounts from the worker's pay without the risk of being sued after the worker submits his/her written notice to terminate the withholding agreement (W-4 or its equivalent).

According to Ms. Wall, when the employer's tax professionals (CPA or attorney) are the ones negligently advising the company to convert and transmit the worker's property (pay), those incompetent tax professionals are at risk of being sued for negligence, malpractice and misfeasance. Sheds a whole new light on things, doesn't it?

State laws protect workers from non-consensual taking from pay without the worker's explicit, knowing, voluntary, written consent. Only the worker or contractor/payee can make the determination whether or not he/she wants to volunteer to participate in government taxes, fees or other charges (i.e., social security trust contributions [FICA], social programs [Medicare], benefits [disability]) as well as non-judicial liens/levies, penalties and interest.

By all means, every employee and employer should go to the law library and verify the information above. It is accurate, it is factual and it is the law on the books. Don't take the word of the IRS for anything. Check the facts for yourself. Then sit down and have a heart to heart chat with your tax professional and find out why he/she doesn't know the law. After all, they're supposed to be the experts looking out for you, the client.

Unlawfully penalizing employers

The IRS threatens employers with huge fines if they don't withhold payroll taxes. Funny thing though, according to a September 15, 2003 letter from GAO (General Accounting Office) to Congressman Elton Gallegly regarding W-4's and reporting, this little nugget of truth stands out:

"Under current law, IRS does not have statutory authority to impose a penalty to enforce employer compliance with the reporting requirement. The reporting requirement was promulgated in Treasury regulations."

How many employers has the IRS defrauded for untold millions of dollars in fines when in fact, they had no legal authority to impose or enforce such penalties and fines?

Tax cheats

The IRS likes to use a lot of rhetoric about "tax cheats" who won't "pay their fair share." When one lifts the curtain and exposes the lies and fraud being conducted every day by the IRS, one would venture to say that the real "tax cheats" are those who work for the IRS.

Employers are being fleeced to the tune of approximately 30% of their operating budget in "payroll deductions." The worker over a ten year period with $200 of taxes withheld each pay period, would get clipped for $104,000! For what? Certainly not to fund our military, social security or any other legitimate, authorized expenditure by Congress. Those expenditures are funded through borrowing by Congress. Debt is not prosperity.

The American workers and employers have been cheated long enough. If someone owns the fruits of your labor, stolen from you by deceptive and deceitful methods, then you are a slave. The withholding issue was sold under the guise ofpatriotism because the American people did not want this new taxing scheme back in 1942. Sixty-one years later, the American people still don't want this fleecing of the fruits of their labor which does not benefit them in any way. This process only encourages addictive over spending by Congress and more borrowing from the central bank. Again, debt is not prosperity.

We the people have two choices: You can either stay on your knees to this tyranny or you can get the facts and then enforce your rights using the law.

What future will you pass on to your children and grand babies? Freedom or indentured servitude?

It was also a time where lies and corruption in politics and society had to be met with consequences. Now let’s leap forward into the year 2009 pointing out the consequences of Pres. Nixon’s abandoning the gold standard on August-15-1971; and the liberalization of the financial markets as the starting point and implementation of the present day gambling casino politics. The once all-powerful labour union was lured into a self-destructive course trading the rights and working conditions of the workforce for privileges, exemptions and official positions for functionaries. As the walkout occurred in 2003 it was in a weak and susceptible of blackmail position and therefore ousted from power. One reform followed another on the one side for optimizing and increasing the efficiency of the employees and on the other side downsizing thousands of workers. Two reforms for stepping up five years of our assured pension age under breach of contract and at the same time a multitude of early retirements with fake psychological attests. What that means is that the honest had to work more and longer and the malingerers were rewarded. This was the time when I thought:”I have had enough of it!” My critical mass was reached and I wrote an open letter to the ÖBB-DLG and reported an offence against them a few months after that. (1) Looking back all those years I can safely assert that by taking action and opening a can of worms it is not easy to stand your ground but it is a choice made by your heart not by your brain and as such worth doing it because it is the right thing to do and essential for keeping your self-respect and honour. It is an experience where there is much to learn about your society, friendships and faithfulness. The worst and saddest realisation for me was as all my colleagues, neighbours and relatives not only began abandoning me but actually flipped over against me. Enough said! It’s time to focus and devote the attention to the heading of this article: “The ultimate perversion of justice made in Austria.” Now follow my argumentation and you will see that this headline is not an exaggeration. At first you have to know that all law is contract law. No contract no jurisdiction. But according to the slogan “Austria is different” they vow and confess nonpartisan courts, human rights, the right to live, human dignity, prohibiting slavery and the like but they have no intention at all in keeping anything of it. (2) The court usher and two policemen coerced me to the kangaroo court, the lying judge told them apparently what they have to say and write in order to make the deprivation of liberty officially look like a voluntary act. Circumventing the missing contract they fabricated a psychological result out of thin air meaning without my presence and sent me a payment obligation for it. My refusing to pay for their crimes resulted in an attachment of earnings. That’s how they deprived me of all my rights and are now stealing my property. Let’s have this invention patented as: “The law check card for criminals made in Austria” in conjunction with a newly created global currency called: “The Austrian-Bitch-Coin”. Dear Susan &Staff and the Zapster, I am one of those "old Timers who have been around for 20 some years and communicated many times with Mike and later Poof as we have moved thru the ups and downs along this journey anticipating the life changing process brought by the release of our "packages". Over the years there were times when delivery was expected within days ,not weeks or months etc. and we were advised to be on the ready. Many offered suggestions of how to secure our coming abundance and some of us have gained great knowledge and a wide understanding of the effect and opportunities offered as well as our responsibilities to be good stewards of this coming wealth. We are still here ,still waiting and still look forward to doing great things for our families and our passions. Our friend "Poof" became our weekly inspiration and after losing Mike, we were given information about many things that were involved in bringing such a large worldwide effort to reality and given behind the scene activity that was being undertaken by those on our behalf. Following his passing we were introduced to Zap to help Susan carry the messages and info forward. As such the information and focus seemed to change and discussions about "Projects" and "Global Transactions" entered the picture,yet those of us who have been here for years waiting ,listening and learning about "Our Program" have somehow been lost in the shuffle and the only information we are getting is about Projects and Global Transactions and Zap stated as much in his recent response saying "THE PROSPERITY PROGRAMS ARE NOT OUR THING, AND WE DO NOT PARTICIPATE THERE." He did throw a small morsel by stating that he thinks they will fall somewhere in the overall process and be paid out after the "Global Transactions" in January. Needless to say those of us who have been here participating in exchanges with Poof and in general paying attention ,have been told repeatedly that there is a plan in place and an order of how funding for all programs ,projects, Transactions and RV's will fall. None of that has been exacted ,yet it has always been tied together and it remains my understanding that it will happen in a systematically designed process. I expect we'll soon see new substance-based currencies in a new more transparent banking system, around the world; arrests of certain high-level people; and a return to Constitutionality in America, with similar changes in at least some countries around the world. Poof used to tell me that the Dragon, doing all the 'heavy lifting' on this, was taking great care to make sure everything was being done legally and lawfully, with all the i's dotted and all the t's crossed, specifically so that as things proceeded to unfold, no one would find any grounds upon which to challenge it, disrupt it, or deconstruct it. PRECISELY SO. THAT IS THE ONLY WAY WE ARE GOING TO HAVE LASTING CHANGE. Sounds like, from what the dinarians are saying today, that the public RV of Iraq's (and some others') currencies does not require the introduction of the TRNs Zap mentioned - and so, they're expecting the RV to take place sometime this weekend. That would be fine, and right in line with what Poof used to tell me: "When you _see_ the RV, it will mean the process of Pros. Program deliveries is commencing." If PP payments are to be in the new currency, these pieces do seem to begin to fall into place - RV this weekend, perhaps, followed by new currency in January and then PP deliveries, and other events as well. Regarding TLB's project, it was being said that it would resolve a few weeks after the PP's resolve. As far as I know, that's still how it is expected to go. I think Tommy continued to have faith in his own program's eventual success, but took his own life because he could see the writing on the wall and was in no physical condition to withstand the rigors of life behind bars. He did leave the program in the hands of folks he referred to as "The Fab Five".
