Dear
Governor McCrory, Mr. Roy Cooper, General Assembly Members,et.al.,
The
Charlotte Observer has allowed an attorney by the name of Bill Hammel to post
an article about the following:
4 Bothersome Things About HOAs.
After
he listed the four bothersome things, he also attacked two associations by
actually naming them who had association members HE PERCEIVED without evidence, to
have caused problems. The Charlotte Observer editor did a poor job to not
allow interviews of the total truth before they incredibly allowed such
attorneys to post this. So I am attaching right now some of the hard
evidence to prove FRAUD. Mr. Cooper do you approve of this article sir
? I mean you are our Attorney General who sent me an email in 2006 saying
you were forming a grand jury for such types of corruption. Every one has their
opinion. My statements are based on facts because I am not in Junior High
School bullying the smart people on the play ground. It is more so the
attitude of the heat that counts. To do right unto others.
This
is quite amazing that Mr. Hammel has so low of any ethics or such little
fair play that he would print specific statements about me being jailed without
his knowing that I only called the new property manager not named as a party to
my HOA president's retaliatory lawsuit, just to get my air conditioner
fixed. No one should EVER in one million years be held in contempt for
basic property needs. Shame on Mr. Hammel !!!! Did someone put you up to
this Mr. Hammel ? Because it looks like it.
This
habea corpus wrongful jailing came about from a judge that issued
such unconstitutional orders that he violated my first
amendment, property rights, and 14th amendment rights by saying and
writing in one order that "I could not even file anything" in my own
defense. Then how can I be sued ? I live on disability of only
$1,049.00 a month. I was also threatened in open court by this same judge
saying he should jail me if I spoke. HELLO. He also stated
that my rights were NONSENSE. It is on the court transcripts
sir. Do you want for me to fax these transcripts to your office before
you open your mouth in a newspaper article ? Yes I think the public
needs to see this. Of course I reported him to the proper authorities and
he no longer serves on the bench. This is inexcusable abuse. I did purge
the contempt and jumped through hoops like a stupid monkey just to get my air
conditioner fixed. The Sheriffs did not pick me up for eight months due
to them telling me they hated HOAs. HELLO. I could not find an
attorney that I could afford to get a Motion to Set Aside the wrongful order
for arrest after I purged the contempt. Of course the insurance attorney
mislead the judge , because she only cares about filling her pockets with
money even if she has to lie to do it. SO MR. HAMMEL LET US GET OUR FACTS
STRAIGHT SIR. I mean you are an attorney aren't you ? Right ?
This
article is definitely is a political ploy to mislead the public by unethical
and unfair attorneys who simply do not do their homework and have NOT shown the
evidence and what is worse, show no consideration for the effect this kind of
article may have on the residents for resale value. HOW NICE MR.
HAMMEL. I will see if I can return the favor in your HOA.
Is there any "scoop" there sir ? IN fact let us do
it. Turn around is fair play. Don't you think
? What Mr. Hammel did with The Charlotte Observer
allowing him to print this without me even being interviewed is totally
unfair, unethical and a case for libel slander. Forget leaving out my
name. Anyone can search the court files you total jerk of a human being.
I am surprised that no one from these named communities were allowed to
comment to The Charlotte Observer or even contacted for any input before this
was printed. I am sure The McClatchey Company would not appreciate
such reporting.
I hope The Charlotte Observer will consider what I have to say now
as I am sending this email to several in our General Assembly and to the public
who have had to suffer from bad HOAs. We had over 200
homeowners attend the forums at the House Select Committee from 2010 to 2012 to
state that board like mine, simply are not transparent nor do their job.
That is why HOUSE BILL 883 should be passed mandating education of all board
members. Also the evaluation of judges program that I was somewhat
instrumental in starting back before September of 2007 I think should have something
to say about such attorneys and never allow them to be anonymous reporters of
the ratings over our judges.
This article certainly did NOT defacto address the real problems with the HOA
boards that are just not following the By Laws or being fair and actually
"pick on" a particular homeowner that DOES follow the laws, i.e.
me. Two gossipy women on my board, just did not like it that I
reported them to the North Carolina Real Estate Commission for defaulting in
their duties to not send me a copy of the requested financials or to ever once
meet with the owners as my parents or me as their Power of Attorney to explain
some things. We have lost thousands because of mismanagement. This
was helped along by past association attorney that Mr. Hammel knows very
well along with Mike Hunter. Senator Rucho and I spoke after the
exploitation of my elderly parents and me living on disability and I took this
attorney to the State Bar and sued him and he resigned. He should
have. Humility and caring are part of the human spirit that shows
ethical good will to others. Not some pompous jerks that are out to make
an illegal buck.
This
attorney fully knew that this was extortion as was the case. Yes he
did. We were just too smart to fall for it. He sent my 81 and
84 year old parents who OWE NOTHIING TO the Elizabeth Townes Homeowners
Association, the attached invoices for $8,250.00. You tell me how a
property manager works 28 hours in one day when any fool knows that there are
only 24 hours in a day ? A ten year old could see these invoices were
padded.
Here are some bothersome things about such
attorneys:
1) They lack human understanding or the ability to be fair
to treat others as they would want to be treated by actually OBTAINING evidence,
so much so that they pompously promote their own agenda which is called
MONEY. These attorneys make their money by the misery of others who
cannot pay their dues and go into foreclosure. What Mr. Hammel does not
tell the public is that we have our town home paid off at the Elizabeth Townes
Association and owe no HOA dues and have no liens. We were retaliated
against for the negligence of our HOA president in 2010 when her own home
was in foreclosure at the time she chose to sue us. Check it out at the
Register of Deeds. This is public knowledge. She also tried to buy
our town home in the attached email. Many in our General Assembly have
this illegal attempt by a non profit board member to purchase a paid off home
with threats of trespassing. Do you see the dismissal by the District
Attorney for me only leaving a note asking to view the financials ?
If Mr. Hammel can print things like this in a public paper as the TRUTH MORE SO is a sure defense
I can say these things now in this email that will be sent to many of his
collegues.
2) Such attorneys are incredibly stupid to not
seek to get all the documented facts first and this is unbelievable as they are
in the profession. EVIDENCE and the TRUTH is what the courts are to be
about. God help us if they served on any HOA board.
3) Mr. Hammel does not know me, Jane Jordan, as I am not
ashamed to say who I am. Because I have done nothing wrong Mr.
HAMMEL. I am the one who lives at Elizabeth Townes Homeowners
Association that he fails to state the total truth about or what the
details are on how my 2010 HOA president sent to my 81 and 84 year old parents
invoices sent to us by past association attorney which a ten year old
could see are padded and deceitful as no property manager works 28 hours in one
day, even as Senator Hagan's Postal Inspector she sent to my house agreed with
me it was federal mail fraud but that the amount of $8,250.00 was below his
threshold for prosecution.
YOU WANT TO PLAY HARD BALL MR.
HAMMEL. I BET YOU DO NOT HAVE THE GUTS TO FACE ME. TO CALL ME
AND BE A CONSIDERATE FAIR MINDED ATTORNEY. DID SOMEONE PUT YOU UP TO THIS
MR. HAMMEL in ORDER TO PROVOKE ME ? I BET I KNOW WHO.
I am not going to sue you because
your types are so low you are not worth the time of day. I am of a
much higher ethical standard. Mr. Jim Talley who is the head of your firm
had lunch with me some years ago. He then saw me at the National Prayer
Day years ago. He is a Christian. I would suggest you pray to God
for the attitude of your heart to change.

Now you say that Mr. HAMMEL can NOT work 28 hours in a day?
Here it is, Mr. HAMMEL works 7 hours in a day with average 13 transactions per hour, thus he is to bill for 28 hours.

Yet then the 63 EXTRA transactions gets placed in the management’s pockets for a undisclosed bonus!
