Jason J. Bowman of the Association of Citizen Prosecutors, the group who is bringing the motion forward after months of research and discussion with victims, outlines in his affidavit how these fraternities were formed and their crimes against the indigenous people of Canada.
With the formation of The Indian Act, the systematic genocide and criminal mistreatment of Indian people by the government of Canada became legal under the Dominion of Canada. In his research Mr. Bowman discovered shocking secret connections between the Vatican, the United Church, the British Monarchy, the Freemasons, the RCMP, big pharmaceutical companies and the government of Canada, all of whom are named in the ex-parte motion.
Evidence points to the fact that native children were deliberately exposed to tuberculosis, native women who did not go to church were maliciously sterilized, and thousands of children who were sent to the horrific residential schools were sexually abused, raped, tortured, beaten, used as guinea pigs for testing of pharmaceutical drugs, and even murdered in bizarre rituals.

"The biggest criminal conspiracy in history is being confronted this week in a federal court house in Toronto.

They should bring a lawsuit on big pharma right here in the USA regarding the children that were in the system that had to be administered blackbox medications due to HIV/AIDS when some of the children were at risk-- not even tested for the virus. Nothing ever came of that either,although the investigation was "suppose" to be done in 2008. No one was brought to justice. It's time for justice to be served for the little ones they harmed. Here is the kicker: many of the children were with the catholic church.
Foster Children as Test Subjects
I question how doctors and pharmaceutical companies know what the side effects and benefits of prescriptions that children use. Who are the unlucky candidates that test the products and experience such things? Foster care children have protection laws in place to protect them; however, independent advocates should always be present when potential toxic drugs are a part of drug trials (Solomon, 2005).
Law Passed to Protect Children
The government passed laws in 1983 giving special protection to children in the foster care system. The researchers were supposed to appoint independent advocates for the children utilized in the drug trials (Solomon, 2005). Instead, the researchers gave blanket permission to enroll the children in the approved studies (Government Tested AIDS Drugs on Foster Kids, 2005). The ACS guidelines waived the foster children’s right for consent, “Separate consent need not be obtained for each child” (Sharav, 2005).
GlaxoSmithKline is one of the pharmaceutical companies that supplies the drugs for the research, said the FDA encourages the testing, and stated, “Clinical trials involving children and orphans are therefore legal and not unusual.” In addition, another GSK spoke person said, “Development follows the most efficient pathway in low cost/low tax locations and access to patients,” and they object to the excessive standards in Europe comparing to the United States (Ho, 2005).
Advocates
New York City has many children in the foster care system at risk for HIV and AIDS. Researchers in the early 1990’s did not understand the virus or ways to treat it. The foster care children make perfect candidates for testing the new drugs since a large number of children did not have the appointed advocates that did make perfect test subjects (Government Tested AIDS Drugs on Foster Kids, 2005). The doctors, Administration of Children Services, and other government agencies should be protecting the innocent children who already have circumstances in their life that are difficult. Children exploited had fewer rights than prisoners (HHS Official Says Rules Protect Foster Kids in Drug Trials, 2005).
Physicians Thought Children Benefited
The physicians thought it was a good idea to test the drugs on foster children. “Hundreds, perhaps thousands of children benefited…To have withheld promising drugs from sick children…in foster care would have been inhumane” they argued that if children were harmed, “where is the evidence?” (Kaufman & Scott, 2005).The Alliance for Human Research Protection investigating the case charges the foster children drug trials in “violation of federal codes 45 CFR 46.409 and 21 CFR 50.56” (Sharav, 2005).
During the 2005 investigation, Dr. Arthur Caplan claims there was no benefit to the children because it did not provide therapy (Sharav, 2005). The foster care children that were in these clinical trials are considered Phase I, which determines the toxicity of the drug, and Phase II tests whether the drug affects the disease (Sharav, 2005). So if these drugs were there to benefit the children, why use thirty-six different Phase I and II trials? Why would they not use medicines that were already FDA approved for children? The medications used during the study from the early 1990’s through 2002 have black box warnings on them. The strictest warning the FDA can give, even in medical need (Kaiser, 2006). The combinations of medications have shown adverse side effects on adults.
Side Effects of Medications
The side effects of the medications are extreme. One of the most powerful drugs used in the trials was Nevirapine, labeled the flesh eater. This medication causes “definitive characteristic is massive epidermal sloughing at the derma-epidermal junction, leading to denuded dermis” (Dunne, 2000). In lemans terms, the skin actually detaches from the body.
Dapsone is approved for adults, not children. The side effects of this drug can cause liver damage, anemia, interacts with other antibiotic medications, peripheral neuropathy, nausea, vomiting, leg pain, and headaches (Government Tested AIDS Drugs on Foster Kids, 2005). With reactions such as these, how can you explain to a child in good conscience that these medications are good for them? These were just two of the drugs that children had to suffer for research. Some doctors administered high doses of up to eight different medications a day to the children. The harmful side effects of the medications starting showing on the children, but the doctors kept telling the nurses and foster parents the reactions were from the disease, not the medication (Scheff, 2004).
The drug Aldesleukin, used in the drug trials, has devastating side effects including low blood volume, leaky capillaries, congestion of the lungs, and affects every organ in the body, heart attacks, gastrointestinal bleeding, paranoia, hallucinations, and even death (FDA Drug watch, 2007).
Didanosine side effects include liver damage, muscle pain and weakness, pancreatitis, pain in the hands and feet, flu symptoms, uneven heart rate, problem with vision, and abdominal pain. Drug interactions can occur with this medication (Scheff, 2004).
Lamivudine side effects include headache, bone and joint pain, hair loss, swollen lymph nodes, liver damage, itching, sleep disorders, mouth sores, wasting disease, and pancreatitis. Patients are closely monitored when in conjunction with other medication (Scheff, 2004).
Ritonavir side effects include bedwetting, dizziness, fatigue, fever, confusion, diarrhea, and serious reactions including death occur when taken with some other HIV medications. Long-term use of the medication is unknown (drugs.com, 2007).
FDA drug watch indicates Stavudine medication should only be given if the benefits out weight the risk. Hepatic failure has resulted with possible allergic reactions, pancreatitis, and adverse conditions when used with other medications (2007).
FDA drug watch has Zidovudine on the list also. This is a generic form of the drug AZT. Symptoms resulting from taking the medications include nausea, diarrhea, organ failure, internal bleeding, and death. (2007).
Looking at the horrible side effects of these medications just alone is disheartening. I cannot imagine what these poor children were thinking as they either were forced or coerced in taking these medications. The worst part of this whole process is these defenseless children did not have the independent advocates to say no.
Feeding Tubes
Children that did not like taking the drugs during the trial would fight so the doctors installed a feeding tube in their stomachs, forcing the poisonous medications into their small bodies. If the foster parents objected to the medications, the child welfare would just take them away (Scheff, 2004).
HIV Vaccines
The more research I did, the more I thought I might be living in NAZI Germany. The physicians gave one-month-old babies HIV vaccines that had no proof of working. These vaccines did not even have testing done on adults (Sharav, 2005). The horrific part of these trials is children under eighteen months –old can have positive results from an HIV infected mother but can still be HIV negative (Sharav, 2005). The range of contracting the diseases varied from five to forty percent of the infants born would actually contract HIV or AIDS (Crowe, 2007).
So who benefits from these tests? If an infant is exposed but not tested accurately because of the mother’s anti-bodies, are they at more risk of infection to the real virus through the vaccine? Why would the researchers even consider something like that knowing the facts of maternal infection rates?
One hundred and fifty seven HIV negative foster care children also enrolled in the studies for the vaccinations. The HIV Phase I vaccine trial, ACTG #230 accepted healthy volunteers for the study. Newborns as young as three days old or less participated in this trial. This trial never made it to the advance stage, it was discontinued (Sharav, 2005). The article does not indicate why the trial discontinued, but I wonder if any of the infants exposed through vaccinations actually became HIV positive.
The Best Interest in the Child
The Vera Institute, who is investigating the trials, reputed the idea physicians gave Foster care children to access to the medication for lifesaving procedures. The physicians could not argue that Phase I and II trials are not considered lifesaving procedures. The Institute also argued that the physicians who have a stake in the trials blur the treatment between research and treatment (Sharav, 2005).
The physicians and the federal health officials defend their research. Where is their evidence that any children were harmed? I would like to ask, where are the missing records? If this research only helped these vulnerable children there should not be secrets. The AP reported, “At least ten children died from a variety of causes…four from blood poisoning while researchers were unable to determine a safe, useful dose.” Other foster children had serious toxicity taking daily doses instead of weekly doses (Government Tested AIDS Drugs on Foster Kids, 2005).
Missing Records
During a hearing with congress, some of the missing records of the foster children appeared in a closet in one of the political offices (Sharav, 2005). How can researchers and other public officials still have their jobs when they could not even keep track of the medical records of the foster care children?
How Many Children Exposed
How many foster children participated in the drug trials? The Administration for Children Services thought the number of foster care children in the trials was 465 which when the trial first started the amount of children was under 200. During the two years of investigation, the number has grown to over 714 (Lucadamo, 2007). These drug trials derive out of chaos and secrets. The investigators are having a hard time finding all of the children that were involved in the studies because some of the physicians are claiming physician and patient confidentiality (Sharav, 2007). Where was the confidentiality when foster children’s medical records appeared in a closet?
Why Stop the Drug Trials
If the treatment was indeed working for these foster care children, why quit the trials? The researchers never gave an answer. However, one Phase I trial was terminated in 1997 from a Glaxo Wellcome drug, because trials that show a high toxicity level are terminated (Nobel &Sharav, 2004).
Given the facts of this case, it is safe to say the researchers, pharmaceutical companies, and physicians look for test subjects to use just to see if the drugs could work and if the drugs did, they could find the level of toxicity to gain FDA approval.
Seven different states allowed the drug trials on foster care children. Most of these children did not have independent advocates looking out for the best interest of each individual child. “When you have the most vulnerable subjects imaginable-kids without parents -you really do have to come in with someone independent, who doesn’t have a dog in this fight” (Solomon, 2005). Other states would not let clinical trials in to test on foster children for fear of exploitation.
Physicians still argued, “To say as a group that foster children should be excluded from clinical trials would have meant excluding these children from the best available therapies at the time…from an ethical prospective, I never thought that was a stand I could take” (Solomon, 2005). Using the best therapies out there is no argument but not having advocates appointed to the children makes me wonder how could a physician who, while researching the drug trials could say that with a clear conscience.
Learn from the Experience
“We learned something from our experience. It is a more individualized review we will be conducting.” Assistant commissioner for child and family health at the Administration for Children’s Service had said (Government Tested AIDS Drugs on Foster Kids, 2005).
Did the remuneration truly out-weigh the risk? For some children it did. The research permitted two of the HIV medications go through FDA approval resulting from the mass study. By the year 2000, the transience rate among children with HIV and AIDS dropped to thirteen, whereas the previous year the death toll ran up to one- hundred (Kaufman & Scott, 2005).
This is a marvel for such statistics! At what cost to the foster children? The children are victims who lost eyesight, skin, organ failure, and death from the lethal amalgamation of drugs. Consider the pros and cons of this situation, it is clear to see without appointing the advocates for these children; the professionals connected to the study were just looking for guinea pigs to pass through to the FDA.
Break-through research should not cause the death of a child. Children depend on state- run institutions to take care not harm them. Yes, many children that were not in the foster care system are able to live better, longer lives. However, please tell the children in the trials that it is in the best interest humanity.
Accountability
Doctors, researchers, Department of Children Services, even the pharmaceutical companies must stand trial for the damages they create. They ought to have answers for their crimes in criminal court, apologize to the children, and never again have the chance to work in medicine or children again.
The investigation in this case is ongoing. The Vera Institute does not have all the data since the drug trials had a secret cloud over it, never allowing people to know the whole truth of the studies and the amount of children that were involved. The silent cries of the children are deafening, and will not cease until the people involved pay for their crimes they committed against children and humanity.
I still can’t see how the researchers had gotten away with it. “If the researchers declined appointing independent advocates, under federal law the researchers and oversight boards must conclude…experimental treatment affords better risk possibilities…” (Solomon, 2005).
