President Obama calls for judges to ignore the law.....

The Alabama Supreme Court has agreed to expedite our petition requesting that probate judges cease the issuance of same-sex marriage licenses. Meanwhile, our lawless President has incited Alabama's probate judges to, in essence, ignore Alabama law!

In less than a week, the Alabama Supreme Court is expected to rule on the status of same-sex "marriages" after judicial chaos ensued following the ruling of one federal judge.

Alabama's High Court has requested input from probate judges who have been affected by the conflict created by U.S. District Court Judge Callie Granade's ruling against Alabama's marriage laws. Contrary to fallacies being reported by the media, her ruling does not automatically create a law that validates same-sex marriages. And, Judge Grande does not have authority to order Alabama probate judges to issue marriage licenses to same-sex couples.

Alabama Chief Justice Roy Moore issued an Administrative Order reminding state probate judges that no single federal judge has jurisdiction over all of the Alabama probate judges.
 
Liberty Counsel has filed a lawsuit to stop probate judges from illegally issuing these licenses until after the Supreme Court announces their ruling this summer. Our mandamus petition asked the Alabama Supreme Court to order the probate judges to cease issuing marriage licenses to same-sex couples until the U.S. Supreme Court rules on same-sex “marriage" this summer.

Last week, President Obama weighed in on the matter when he said, "When federal law is in conflict with state law, federal law wins out." He erroneously believes that Judge Granade's ruling trumps Alabama law!  Not so, Mr. President.

Appearing on Fox News Sunday, Judge Moore schooled the President on the creation of law versus judicial activism, which Moore referred to as a "fundamental misunderstanding."
 
"Well, I'd like to tell President Obama that he is not entirely correct. Federal law does trump state law, but what this Harvard professor, who is president of our United States, does not understand is that a trial court's decision about the constitutionality of a federal question, is just that. It's an opinion. It may be law of the case, before her. It is not overturning the Alabama Constitution.

Legislators are to make law. Congress is to make law. The United States Constitution is law. So is the Alabama Constitution."

We have a fundamental misunderstanding in our country that federal courts, by their mere utterance, make law. They do not make law, sir. They make law of the case applicable to the parties before them."

America must adhere to the rule of law, not the arrogant creation of "laws" by judicial activists, like that of U.S. District Court Judge Callie Granade.

Liberty Counsel is standing with Chief Justice Moore, against this flagrant activism, and in defense of the probate judges in Alabama who are refusing to issue licenses to same-sex couples.
    
    To All, this is a critical time in the fight for "natural" marriage. Too many states have already acquiesced to highly aggressive homosexual organizations using the Supreme Court's earlier ruling as a battering ram to unnecessarily overturn their state laws confirming natural marriage as "a union between one man and one woman."

Judges already ignore the law. Judges enforce statutes, which are an abrogation of law. An abrogation of law is color of law; not law. Common law equals "lawful" and statutes equal "legal." There is a big difference between the two. Statutes are only lawful if the are consistent with the Common law, i.e. there is an injured party. Under Common law statutes are toast, if there is no injured party.
