The Truth About the Health Care Bills - Michael Connelly, Ret.

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.

I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.
What I found was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.
However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.
The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.
This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendmentsmay provide.
If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However , that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.
So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law. It doesn't stop there though.
The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;
The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.
For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

It is now apparent that people are not watching the evening news because the report had filmed Obama going to Supreme Court building on two different occasions. The las time he must have been delivering the check to Judge Roberts to throw all of us under the bus. Shortly after the announcement of Roberts upholding Obamacare I saw a film of he and his family vacationing in a foreign country. . Put it together folks - Roberts was paid an enormous sum and had to visit a foreign country to deposit his check. I saw it with my own eyes but can't recall the news channel - It was either CNN or Fox and probably Fox because they are the only ones who tell it like it is.
There you have it. Don't believe this - Go back to when this all happened and ask the news channel to show it again. See for yourself.................

The bill referenced in this list, America's Affordable Health Choices Act of 2009 (H.R. 3200), was never passed by Congress. A completely different bill, the Patient Protection and Affordable Care Act (H.R. 3590), became the basis for what is now known as "Obamacare." Many of the entries in the list are therefore irrelevant and outdated, as they address aspects of health care reform legislation that were never enacted by Congress (particularly the "public option" for a government insurance plan).

Partly untrue. Mismash (sp?). Always check factcheck.org and/or snopes.com when you see a message that says "pass this on." People like to put bogus or partially bogus stuff out there and waste our time. Sad.
I just got read out by some one that the lawyer was talking from 2009. I was told it miss informed me. I was told to go to snopes.com for the truth. Is this artical correct? I am trying to learn all I can about OBAMA CARE. I want the people to have insurance for care they need but not strong armed into something that allows the gov to run and decide what medical care we get. Thank you for the post.
If in fact they are going to punish people for ignoring this mandate, that is a dictatorship or maybe royal orders as in a feudal system, a kingdom? The bill of rights were written precisely to prevent this kind of abuse of power, now, who is really enforcing the bill of rights aka the 10 ammendments? Unfortunately we are living in a very dark era, with a government taking advantage of every little opportunity to submit every american to their will, to do away with every little freedom left, soon we will be in a state that we have to ask permission to speak, to do anything we used to take for granted, we will be just cattle for them, maybe we always had?. this is really sad that it has to come to this, if people like me dont feel like participating on a program like that, we should not be pushed into it, we have the freedom of chosing our own destiny, even if is to live a life without health insurance, but still afford to go see a private doctor without notifying nanny state that we are sick, or is that what is intended for us to do? they want to control every aspect of our life no matter what it takes, can anybody say privacy and the right to live a private life is gone? Do we have to report our every move in a near future? Submit to every vaccination program so they can give us a dicease and depend heavily on our health plan? Population control? Genocide through a so called health benefit? What brings my attention is that such a complex and elaborate bill was written so one sided and not so much of an opt out type of thing, without raising flags to the authors and executioners of this tax bill, that as people that has read it, sees that is nothing more than a burden put on the taxpayers and a cheat scape to stop all the health care programs that are already available to the public and some of them will be elapsed on dec 31st of this year, by taking all of the people that has health insurance and see that they can save some more money they will lure many of them into their plans and as any insurance plan, will be raised every now and then to keep up with the high cost of living, of course the raise also caused by many new commers into the so called health care system, besides, who is paying for all of this monstrous spending? Our government has no money, no credit, debt ceiling anybody? This to me looks like what they are doing is just sharing the debt or the burden on the taxpayers, remember, misery loves company and it shows, if thats the case include all government employees as an example of solidarity with this bill, that will include of course all of them, no exceptions, congress, senate, justice dept, all of them, welcome them to our nightmare, make every rich member of them contribute according to their income and wealth, I am more than sure we will find instant funding for all of this programs, but then again, all of this do gooders are the exception to the laws and rules. C'mon Lets share the misery, would ya? Put all of them under the Obama care and we will fix anything together, that'll be the day...
