Zimmerman was never indicted -- just as with O.J. Simpson

From: legal_reality
Subj: Zimmerman was never indicted -- just as with O.J. Simpson, and . . . and . . .

12 July A.D. 2013

When the O.J. Simpson homicide case first started, this author seemed to be a committee of one, in the nation, raising the roof that O.J. Simpson had not been indicted.

Exactly as is "taught" by "Perry Mason" and such tv "programmes," what CALIFORNIA does, instead of Indictments, on a "When we want to" basis, is file a Felony Complaint.

At the time, this author was still a "constitution-ist," and, frankly, at the leading edge of "constitution-ists" around the nation.  At that time, the following language was sacrosanct:

"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger[.]"

Murder is a capital offense (in the traditional meaning of "capital," a death-penalty offense).  He wasn't serving in the land or naval forces, or in the Militia, in actual service in time of War of public danger.  So, there was no reason, at all, that he not be indicted in order to be "held to answer for" any charge of murder.

It happened that while the O.J. Simpson case was still a hot topic, there was a continuing legal education seminar (there in Houston) on "Media and the Law."  One of the closing sessions was a panel discussion.  On that panel was a judge who handled high profile cases, a defense lawyer (with high profile clients), and two journalists, one of whom what the CNN anchor on the O.J. Simpson case and the other the anchor on the Susan Smith case.  https://en.wikipedia.org/wiki/Susan_Smith (killed her own sons, claiming that a black man had kidnapped them) (huge, huge, huge media case, equal to the O.J. Simpson case).  Someone really did well to get that panel together.

At the question/answer session at the end of the panel discussion, this author asked his question.  He started by suggesting that the panel would agree that "capital" means "death penalty," and that murder was a "capital" offense, and that such cases require Indictments.  With that intro, the question was posed as to why the fact that O.J. Simpson had never been indicted never made the news?

The carpet in that meeting room was the long-fiber shag, popular in the 60's and 70's in the "hip" apartments and social clubs, and one could still have heard a stick pin hit that carpet.  It was that quiet in that room.

The CNN anchor, who was "the" fellow who anchored "everything" about the Simpson case for CNN, through whom went everything that aired over CNN in that case (and who had at least attended law school), had his jaw dragging the table he was sitting behind.  It would have been great to have had a picture of the panel at the immediate moment of posing the question.  The room was silent so long that the moderator had to say something, and he said, "Well, looks like you've stumped the panel."

Sometime after that, one of this author's objections was received by another who (still) claims to be a "constitution-ist" and who swung away at this author for this author's not being aware of the Hurtado case. See Hurtado v. California, 110 U.S. 516 (1884).  http://supreme.justia.com/cases/federal/us/110/516/case.html.  In the Hurtado case, what we learn is that there is no "federal" requirement that anyone be Indicted in or by any state system.  Hurtado was not Indicted.  If the Fifth Amendment were "admissible evidence of law" in California, Hurtado would have been popped right out of jail.  But, the Supreme Court upheld that no-Indictment-based conviction!  In the face of the so-called Fifth Amendment, how can that be?  Where the Fifth Amendment is so plain, who in the world would even think of a need to look for something like the Hurtado case?  How can this be?  The answer is the exact same answer as learned in The Terre Haute Litigation.  The "constitution" is just flat out irrelevant.  We learn via the 1884 Hurtado case that there really is no Indictment requirement.  Thus, the Fifth Amendment isn't really a limit on any STATE.  It applies to the "national church," but, despite the fact that the States allegedly created that system, binding themselves to it, by oath (certainly by the judicial officers), it just simply is not Supreme Law of the Land when it comes to STATE processes and procedures.

Now that we understand the basics of the Hurtado case, we come back to the statement "claims to be a 'constitution-ist.'"  To "justify" the Hurtado case, i.e., to accept that lesson as true and reliable, is to be a "realist," not a "constitution-ist."  So, while that same person still is quite active as a "constitution-ist," there'll be a day when his own "lessons" will ring true in his own mind, and he'll become a full-time "realist;" hence, he'll stop being a "constitution-ist," and he'll stop promoting the "constitution," altogether.

To the point about the "constitution," if the Fifth Amendment language were binding by oath on the STATE judiciary, then there could be no Perry-Mason-esque "preliminary hearings" that substitute for a Grand Jury.  There could be no "homicide" prosecutions initiated by any charging instrument other than a Grand Jury Presentment or Indictment (on each Count charged).

Why is it Ok that Simpson was never indicted?  Because that Fifth Amendment language just simply doesn't exist, for purposes of its application to the STATEs. The Supreme Court taught us this reality circa 1884.  The national system is bound by that language, but the STATEs are not bound by it, i.e., the language that purports to bind the judges in the "States" by oath of office to those concepts is equally non-existent, equally void, equally of no legal effect.

To solidify this notion about the myth of the "constitution," generally, via proof that there is no Fifth Amendment Grand Jury Indictment protection, in particular, it was also at or about the time of the O.J. Simpson case that Col. "Bo" Gritz was facing kidnapping charges (clearly, an infamous type of charge) in CONNECTICUT.  What is that STATE's motto?  Right, "The Constitution State."  Really!?!  Is it because CONNECTICUT is "The Constitution State" that CONNECTICUT went to very deliberate effort to remove the entire notion of "Grand Jury" from that STATE's "constitution?"  "Constitution State?"  Really??  Gritz was held to answer for a capital or otherwise infamous crime in that STATE court system without having been indicted.

"Well, Harrumph!  Harrumph!! 'Constitution' this, and 'constitution' that," is the incessant mantra from a great many (very) intelligent people.

But, what "constitution?"

We do not now have and have never had a "constitution."  Therefore, that language in no way created the national system, and, by that very reason, in no way limits that national system.

"But, but . . . the Supreme Court use that label all the time!"

Yes!  They sure do, as do state and national courts around the nation.  To do otherwise is to allow the lid to blow off the top, and the nation (well, think "the bank") doesn't benefit by that. The "bank" benefits by our proving our continuing unawareness of just exactly how this evil system of theirs actually functions (always remember that "federal" means "federal," and that they really don't want very many people to start putting 2 and 2 together down that path).  In other words, this author has the privilege, and the duty, to be extremely frank.  This author esteems himself as working for YAHUWAH, as a "teacher of Israel," for the benefit of His Kingdom, thus, for the benefit of Americans (and those around the world who prefer to live free from tyranny).  The Court (and all the STATE high courts, and all appellate and trial courts in both system) doesn't have that luxury.  They realize they work for the "bank."  And, the Supreme Court has, on a per-case basis, recognized a few phrases from the "constitution" and incorporated those concepts as doctrines into the operative principles in and for this present system.  Therefore, our duty, on the learning side, is to put together the "hints" made in every single Supreme Court ruling as to where the limits are on how far the "bank" may press the people.  The reflective mind doesn't need to see that many instances where the "constitutional" language would produce one conclusion and the actual ruling goes the other way. There must be thousands and thousands of examples on which to draw to make that very point. To understand the realty is to apply the reality so as then to be able to argue reality meaningfully.  That means letting the courts come up with whatever "cover story" may be suitable for that case.  The reality is that there is no such thing as a "constitution;" the "cover story" uses labels and doctrines that perpetuate the myth that there is such a thing.  To buy into the myth is to avoid full access to the efficiency of our present legal reality.

In time, as wicked a paradigm shift as it is, the minds of those called to learn the reality well enough to apply it adjust to the reality that "the" reason why there's such a mismatch is that the "constitution" simply "never was."   One of the hardest concepts to accept, for anyone, is having "been had."  We'll, we've "been had."  If it helps, this particular "Beast" system is the ultimate of "Beast" systems.  Rome would blush with envy.  Rome would bow to these people out of pure Machiavellian respect.  So, there's never been a more advanced "Beast" system, and this is the one we're up against.  Yet, in those areas where the "Beast" roars the loudest, we find the "Beast's" greatest weaknesses.  For example, the wars going on in the Middle East as we speak exist because this "Beast" is insisting that the world use is "funny money," and those going "rogue" in the view of this "Beast" system are being attacked, militarily.

Want the troops home?  Stop using "funny money." They're "over there" to set up a "branch office" of the Fourth Reich's "funny money"-issuing bank.  They're being blown to bits, shot to hell, vaccinated with all kinds of potions, and exposed to today's level of horrors, in order that the "bank" set up a "branch office" in a place where the people there just simply don't want that.

This is the same "banking" system that is shoving in our faces the fact that Zimmerman is being tried for a capital or otherwise infamous crime without having first been indicted.

Thus, this author's having been through that ringer, and in particular on this very issue of Indictment by a Grand Jury, via his in depth study of the O.J. Simpson case (where were all the "birthers" and "constitution-ists" when O.J. Simpson was being held to answer for a capital crime without having first been indicted?), it's somewhat surprising that this author wasn't cluing in on, wasn't snapping to, the reality from much earlier that Zimmerman was never indicted.

Reaction by "Bmaz" -- "The case is also patently overcharged. As stated above, I think it is more than arguable that the probable cause affidavit does not even support manslaughter, but it is not remotely close to supporting second degree murder. This is an embarrassment not only for Angela Corey, but [also for] the magistrate who signed off on this bunk. It makes the criminal justice system look horrible."

(If we're talking "affidavits" and magistrate participation, then we're talking "Perry Mason"-esque "preliminary hearing" activity, which is pretty close to the exact anti-thesis of a Grand Jury Indictment.  As a nation, even with the "constitution-ists," are we so far "gone" that we no longer recognize the difference?).

Florida special prosecutor Angela Corey plans to announce as early as Wednesday afternoon that she is charging neighborhood watch volunteer George Zimmerman in the shooting of Trayvon Martin, according to a law enforcement official close to the investigation.
It was not immediately clear what charge Zimmerman will face.
Martin, 17 and unarmed, was shot and killed Feb. 26 by Zimmerman, who said he was acting in self-defense. Police in Sanford, Fla., where the shooting took place, did not charge Zimmerman, citing the state’s “stand your ground” law.
Corey told reporters Tuesday night that she would hold a news conference about the case within 72 hours. A news release from her office said the event will be held in Sanford or Jacksonville, Fla.
Benjamin Crump, who is representing the Martin family, said this week that Corey’s office had asked where Trayvon’s parents would be each day this week. They arrived Wednesday in Washington for a civil rights conference organized by the Rev. Al Sharpton, where they are scheduled to speak.
The announcement of a charge against Zimmerman would come a day after Zimmerman’s attorneys withdrew from the case, citing their inability to contact Zimmerman.
Lawyers Craig Sonner and Hal Uhrig on Tuesday expressed concern about Zimmerman’s emotional and physical well-being, saying he has taken actions without consulting them. They also said they do not know where Zimmerman is.
“You can stop looking in Florida,” Uhrig told reporters. “Look much further away than that.”
Corey said Monday that she would not bring the case before a grand jury, which was expected to convene this week. She said her decision to forgo the grand jury should not be viewed as a factor in determining whether charges will be filed.
Corey has indicated in recent weeks that she might not need a grand jury to bring charges against Zimmerman.
The lawyers said they stand by their assertions that Zimmerman acted in self-defense when he killed the 17-year-old, who was unarmed, but they acknowledged that they formed their impressions without meeting Zimmerman.

This intent to stir up racial discord AND to dissuade defense of neighborhoods, as in defense of others, as well as personal self-defense (via guns, anyway), is just one more "in our face" sorts of "Let's prove there's no constitution" matters.  This author knows that today's yellow propagandists have no real ability to think on their own, so this author in no way expects competent legal analysis of legal matters by the yellow propagandists.  However, the self-proclaimed "constitution-ists" in the house are a different story.  Where is all the high and mighty brain power on such an obvious issue? Where's the uproar, the outrage, that Zimmerman was never indicted?  It says, right there, in the Fifth Amendment, that no one, which surely includes Zimmerman, shall be held to answer for (compelled into trial over) a capital or otherwise infamous crime, unless and until he's first been charged by a Grand Jury, whether by Presentment (one of the Grand Jurors is an actual witness) or Indictment (the Grand Jury investigated and entered a True Bill against the defendant).

If the "constitution-ist's" "constitution" is so easily rendered asunder, what, then is their "constitution?"  If it may be so easily rendered asunder, it's not a "package deal," which it must be, if it is the Supreme Law of the Land.  Since it's clearly not a "package deal," an "all or nothing" set of ideas, then it simply is "nothing."

Where are all these 2d Amendment Sheriffs groups while Zimmerman is being "held to answer for" a capital offense, in flagrant despise of the Fifth Amendment language?

Where's the ACLU?

Where's the Heritage Foundation?

On and on and on.  Where are these big "constitution-ist" voices decrying the fact that Zimmerman was never indicted?

They're silent.

Is that because they've read the Hurtado ruling and are "realists" on this issue?  Or is it because the concept of Grand Jury Indictment is presently so foreign to the mind that the difference is simply no longer recognized?

And, if they're "realists" regarding the situation that no STATE has to indict in order to try someone for any capital or otherwise infamous crime, why does not perspective not spill over into any other matters, into all other matters?

Being played out before the nation, as happened with the defiance of the Grand Jury Indictment in the O.J. Simpson case, as happened with the defiance of, and turning on the ear of, the concept of extradition in the Murrah Building bombing cases (which cases were literally exported away from the one State having jurisdiction of the alleged crimes), as happened with all the "war on terror" executive decisions to send military troops without any legislatively-asserted Declaration of War, as happened when "funny money" replaced Money (gold and silver Coin), as happened with the handling of the investigation of the JFK assassination (the one investigative body in the nation with authority to investigate that murder is the Dallas County Grand Jury; there is no authority in any Warren Commission), as happened with the fact that the obama-nation truly was born in Kenya, as has happened with the replacing of the "electoral college" with this quasi-popular vote election mechanism for the executive officers, and as is happening in the case against Zimmerman, what we're witnessing is systemic "bragging" about the non-existence of any "constitution."

For so long as our minds are in the prison of myths promoted by the "bank" and their yellow propagandists, the "bank" doesn't even have to engage the debate on the point.  The sooner we come to terms with our reality, the sooner we're in a position to turn the tables on the "bank" that pretends also to be providing "governmental" services.  They don't like "the" debate, the argument that exposes the fundamental legal mechanism in operation at the moment.  To draw "them" into that debate is first to marshal all relevant commercial FACTS in favor of oneself (and one's business enterprises).  Once the commercial FACTS are mastered and are pointing in the exact opposite direction from that which benefits the "bank," that's the time to engage "the" debate.  To engage the debate without first learning and applying the reality so as to know which FACTS to marshal and how to do so is to ask to get clobbered.

To realize that there's no problem in the eyes of this system over the fact that Zimmerman has not been indicted is to realize that there is no "constitution."  To realize that there is no "constitution" is to come to terms with the fundamental concept driving this present system, which is this: "federal" means "federal."  That system functions "by agreement."

That should make good and perfect sense in light of the reality that we're not dealing with a "government."  We're dealing with a "bank" that pretends to provide "governmental" services.

GOP Rep. Intends to ‘Investigate, Identify and Prosecute People Within the Administration, Up to and Including the President’

This GOP Rep. Is Exploring Potential Criminal Charges Congress Can File Against President Obama
Rep. Jason Chaffetz, R-Utah, seated at right, waits for the start of the House Judiciary Committee for a hearing on America’s Immigration System on Capitol Hill in Washington, Tuesday, Feb. 5, 2013. Other members waiting for the hearing to start include, from left, Rep. Trent Franks, R-Ariz., Rep. Tom Marino, R-Pa., Rep. Doug Collins, R-Fla., Rep. Raul Labrador, R-Idaho, Rep. Ted Poe, R-Texas, Rep. Trey Gowdy, R-S.C. Credit: AP

Rep. Tom Marino (R-Pa.) in a Thursday radio interview revealed he is exploring the potential options that would allow Congress to file civil or criminal charges against members of the Obama administration and even President Barack Obama himself.

Citing the Obama administration’s delay in the implementation of the employer mandate found in “Obamacare,” Marino told radio host David Madeira that the president continues to show a disregard for the law. He also argued Attorney General Eric Holder is never going to hold the Obama administration accountable.

“If the chief law enforcer of the country [Holder] will not enforce the law,” said Marino, “and the president decides to break the law because he doesn’t like it, there has to be another mechanism by which we in Congress can … see if there are criminal charges we can file.”
Marino is looking to “investigate, identify and prosecute people within the administration, up to and including the president if it comes to that,” according to Sarah Wolf, Marino’s spokeswoman.

While Marino is a longtime critic of Obama, he maintained that his cry for legal action stemmed not from personal distaste for the president but from a greater respect for the nation’s well being. “We’re beyond the point of showing that he’s incompetent,” Marino said. “He really doesn’t care about where this country is going unless it’s his plan, so we have to step up.”

The congressman likened Obama’s action to the Watergate scandal, suggesting that a special committee should be established to subpoena and investigate the individuals involved. More specifically, he said, he seeks to find “a part of a statute that says we have the authority to indict.”

In the same interview, Marino said he is planning a “brainstorming session” with some former prosecutors in Congress about the potential legal measures that can be taken against the Obama administration.

He claims he is not alone in his desire to bring criminal charges against the White House.

Dangerous Times: When America Supports Evil

July 13, 2013

Dangerous Times: When America Supports Evil

When the United States resisted Soviet imperialism over seven decades, liberals lost no opportunity to accuse the country of supporting evil. Then the Soviet Union fell, in good part because its own people realized that free markets and electoral democracy were better for them. In the eyes of Europe and Asia we won because they realized we had the moral advantage. That is why China now has a wealthy entrepreneurial class, and why Russia just introduced a 14% flat tax. No, those places are not ideal, not even close. But they are better than before.

Communist regimes murdered 100 million people for resisting the revolutionary ruling class. By leading the West in opposition, the United States always kept a clear moral narrative.

In every major conflict, the United States has sought not only military victory, but a clear moral logic. The Civil War had two moral goals: To preserve the union and to abolish slavery. Both caused huge arguments in the country.

We are indeed the only country in the world that was founded on a clear moral and political program. The Constitution and Declaration are first of all statements of the moral values and goals of the founders. That wasn't just empty twaddle we see every day in the leftist media; real morality not an ego game. It is a high standard of conduct for ourselves as individuals, and together, as a society.

The United States does not seek conflict; our major wars have had an evident defensive narrative, from 1776 to 1990. We have always had heated debates about the morality of our actions. That is entirely appropriate. But we have never stopped seeking the moral high ground, and often achieved it.

The Obama Administration has lost that narrative.

Obama is the most cynical and amoral president we have ever had, if you look at his actions and not at his words.

In Egypt both sides are now blaming us for their near-civil war, and they are both right. Obama lost the moral high ground when he destabilized Egypt, the greatest Arab pillar of Middle Eastern peace, by forcing Hosni Mubarak to resign. To make it worse, Obama then supported the Muslim Brotherhood, which immediately introduced their own Shari'ah-leaning constitution, squeezing out political rivals, ignored the judiciary, and took over the armed forces.

There is a reason why Brother Morsi was just thrown out of power. Nobody in Egypt trusted him. He received 51% percent of the vote, but he was trying to grab 100% of the power.
In Egypt we are now caught between one kind of evil -- the kind that kills young girls who meet boys without the father's permission -- and another kind of evil, a coup d'etat. Thank you, Mr. Obama.

In Syria this administration is doing even worse things, because now we are supporting Al Qaida rebels against the Assad regime. At least 100,000 Arabs have killed each other in Syria, and there is no end in sight. And we knowingly empowered the worst kinds of Islamic terrorists.
In Libya we threw out the obnoxious but fairly peaceful Muammar Gaddafi without any plausible rationale at all. In Benghazi Ambassador Stevens was smuggling great quantities of Libyan arms to Al Qaida in Syria. We were throwing gasoline on the fire. Where is the morality in that?

And now, in Afghanistan, we are bypassing the elected government of Hamid Karzai to negotiate with the murderous throwbacks of the Taliban --- who protected Osama bin Laden while he was preparing the Twin Towers attack on 9/11/01.

And in Iran --- we are supporting the worst throwback regime in the Middle East.
Obama has meddled everywhere in the Middle East but not in Iran.

That lesson is not lost on other countries in the world: For Barack Hussein Obama it is power that counts. Nothing else comes close.

We've lost the story line.

We can no longer tell the difference between good and evil.
The ACORN organizer manual states it very plainly.

"This is a mass organization directed at political power where might makes right."
We have the most cynical, secretive and manipulative administration in history.
If mainstream America ever wins another national election it will have a lot of damage to repair.

One of Conspiracy theories : Holow earth theory: The Hollow Earth hypothesis proposes that the planet Earth is either entirely hollow or otherwise contains a substantial interior space. The hypothesis has been shown to be wrong by observational evidence, as well as by the modern understanding of planet formation; the scientific community has dismissed the notion since at least the late 18th century.
The concept of a hollow Earth still recurs in folklore and as the premise for subterranean fiction, a subgenre of adventure fiction. It is also featured in some present-day pseudoscientific and conspiracy theories.

Montana Enacts Law Prohibiting NSA Spying

Montana Enacts Law Prohibiting NSA Spying

House Bill 603 requires any government to get a probable cause-based warrant before anyone’s electronic devices can be spied on. The law passed the Montana State Senate in April and was signed into law in May. It never really made any headlines, because it was all done before anyone heard the name Edward Snowden. I mean, most of us knew that the government was spying on everybody, but that was all a conspiracy theory until the media admitted it and then tried justifying it on “national security” grounds. So, H.B. 603 has been Montana law for several weeks now. Here’s what the law states:

Section 1. Location information privacy -- civil penalty. (1) Except as provided in subsection (2), a government entity may not obtain the location information of an electronic device without a search warrant issued by a duly authorized court.
(1) "Electronic communication service" means a service that provides to users of the service the ability to send or receive wire or electronic communications.

(2) "Electronic device" means a device that enables access to or use of an electronic communication service, remote computing service, or location information service.
So, basically, cell phones, laptops and tablets are off limits from the government’s nosy ears. Unless, of course, they obtain a warrant. And yes, there are a few other exceptions listed in subsection (2). They can track your location if any of these conditions is met:
(a) the device is reported stolen by the owner;
(b) in order to respond to the user's call for emergency services;(c) with the informed, affirmative consent of the owner or user of the electronic device; or(d) there exists a possible life-threatening situation.

(3) Any evidence obtained in violation of this section is not admissible in a civil, criminal, or administrative proceeding and may not be used in an affidavit of probable cause in an effort to obtain a search warrant. (4) A violation of this section will result in a civil fine not to exceed $50.

Will the NSA even care about Montana’s new law? Probably not. They can do whatever they want, and they’ll even claim that they’re within the state law’s limits under subsection (2)(d). They’ll claim that there exists a “possible” life-threatening situation with the possibility of a terrorist attack. I’m sure the Department of Justice will sue Montana on the grounds that it is “obstructing” their investigation of Montanans.

But at least it’s something. What we need are laws like this except with real teeth and state representatives and governors who will stand their ground against the feds.

He  wrote:

The American Dream ended (on November 6th). The second term of Barack  Obama will be the final nail in the coffin for the legacy of the white Christian males who discovered, explored, pioneered, settled and developed the greatest Republic in the history of mankind.

The Cocker Spaniel is off the front  porch...the Pit Bull is in the back yard.

The  American Constitution has been replaced with Saul Alinsky's "Rules for Radicals" and Chicago shyster, David Axelrod, along with international Socialist George Soros will  be pulling the strings on their beige puppet to bring us Act 2 of the New World  Order.

Our side ran two candidates who couldn't even win their own home states,  and the circus fatty Chris Christie helped Obama over the top with a  glowing "post Sandy" tribute that elevated the "Commander-in-Chief" to Mother Teresa status.

People like me are completely politically irrelevant, and I will never  again comment on or concern myself with the aforementioned coalition  which has surrendered our culture, our heritage and our traditions without a shot being fired.

You will never again out vote these people. It will take individual acts of defiance and massive displays of civil disobedience to get back the rights we have allowed them to take away. It will take Zealots, not moderates--not reach-across-the-aisle RINOs to right this ship and restore our beloved country to its former  status.

Those who come after us will have to risk their lives, their fortunes and their sacred honor to bring back the Republic that this generation has timidly frittered away due to "white guilt" and political  correctness.....

DHS Secretary Janet Napolitano to Resign

DHS Sec. Janet Napolitano
DHS Sec. Janet Napolitano
The head of the Department of Homeland Security, Janet Napolitano, has announced that she will be stepping down from her post. As Secretary of DHS, Napolitano is tasked with overseeing immigration enforcement in the interior of the nation and at the borders. During her four-year tenure, she drafted memos that grants deferred action to certain illegal aliens through the use of prosecutorial discretion. The memos are subject of a lawsuit filed by a group of ICE agents against her.
Napolitano will leave DHS to head California's state university system.
"For more than four years I have had the privilege of serving President Obama and his Administration as the Secretary of Homeland Security. The opportunity to work with the dedicated men and women of the Department of Homeland Security, who serve on the frontlines of our nation's efforts to protect our communities and families from harm, has been the highlight of my professional career. We have worked together to minimize threats of all kinds to the American public. The Department has improved the safety of travelers; implemented smart steps that make our immigration system more fair and focused while deploying record resources to protect our nation's borders; worked with states to build resiliency and make our nation's emergency and disaster response capabilities more robust; and partnered with the private sector to improve our cybersecurity. After four plus years of focusing on these challenges, I will be nominated as the next President of the University of California to play a role in educating our nation's next generation of leaders. I thank President Obama for the chance to serve our nation during this important chapter in our history, and I know the Department of Homeland Security will continue to perform its important duties with the honor and focus that the American public expects."
One of Sec. Napolitano's vocal critics has been Sen. Jeff Session (R-Ala.).
"Secretary Napolitano's tenure at the Department of Homeland Security was defined by a consistent disrespect for the rule of law," Sen. Sessions said in a statement released earlier today.
"The resignation of Secretary Napolitano should refocus the attention of Congress on its first task: to ensure that the executive branch faithfully carries out the laws of the land. The most significant obstacle to immigration reform remains President Obama's selective enforcement of the law. Any selection--interim or permanent--to replace Secretary Napolitano must disavow these aggressive non-enforcement directives or there is very little hope for successful immigration reform.

"Whoever replaces Secretary Napolitano must restore the rule of law, as well as the morale of ICE officers, which has plummeted under her tenure."

Jester "Group Clarification" at I4U Friday Evening 7-12-13

Jester "Group Clarification" at I4U Friday Evening

07/12/2013

[Jester] HELLO CASTLE MODS, PEEPS, LURKERS, AND CRITTERS! HOW’S IT GOING THIS EVENING? POST TO FOLLOW AFTER HELLOS…

[Jester] THANKS FOR THE NICE WELCOME AS ALWAYS... YOU GUYS ARE GREAT!

[Jester] I WANTED TO TRY TO USE SOME LOGIC AND TRY TO MAKE SOME SENSE WITH THE EMAIL GROUP-NO EMAIL GROUP QUESTION… PAY ATTENTION BECAUSE IT IS A LITTLE COMPLICATED… AND IT IS LONG SO I APOLOGIZE IN ADVANCE FOR THAT…

[Jester] IT WILL ALL BE CAPTURED BY THE CRACKERJACK MOD TEAM FOR THE FORUM SO YOU CAN READ IT LATER AGAIN IF IT GETS TOO CUMBERSOME TO FOLLOW…

[Jester] FIRST LET’S BREAK DOWN THE DIFFERENCE BETWEEN STREET, BANK, AND GROUP RATE…

[Jester] THE STREET RATE IS SIMPLY THAT... THE EXCHANGE RATE ON THE STREET… OR IN THE SYSTEM…
....
Read More Link on Right
[Jester] THE BANK RATE IS SIMPLY THAT AS WELL… WHAT THE RATE IS BASED ON WHAT THEY WILL KICK IN FROM THEIR PART OF THE DEAL TO WORK WITH YOU… THIS BEING BASED ON THE GOING RATE OR THEIR PROJECTION OF WHAT IT WILL BE WORTH WHEN THEY LIQUIDATE IT…

[Jester] AND THE GROUP RATE IS A PRE-NEGOTIATED RATE THAT HAS BEEN ARRANGED FOR YOU BY THE NEGOTIATOR OF THE GROUP IN EXCESS OF 100,000 STRONG… THE EMAIL GROUP… AND THIS HAS BEEN DONE TO COLLECT THE DINAR FOR AN OUTSIDE INVESTOR USING THE BANKS AS A BROKER… WE ALL KNOW WHAT THAT MEANS… AND THEY WANT AS MUCH DINAR AS POSSIBLE…

[Jester] AND A BIT OF RECAPPING WHERE THE EMAIL GROUP DEAL IS COMING FROM…

[Jester] WE ARE ALL AWARE BY THIS TIME THAT THIS IS FOR A PRIVATE INVESTOR… CHINA… WITH THE BANK ACTING AS THE BROKER FOR THE DEAL… CHINA WANTS THE DINAR OIL CREDITS TO ADD TO THEIR RESOURCES… THEY ARE WILLING TO KICK IN SOME DOUGH TO GET THE DINAR TO USE FOR THIS… AGAIN... THEY WANT AS MUCH AS THEY CAN GET...

Jester] NOW… FOR ALL GROUPS… AND I MEAN ALL OF THEM… THE BENEFIT FOR THE BANKS IS PRETTY MUCH THE SAME…

[Jester] IN THE STREET OF BANK RATE SCENARIOS… THE BANK RECEIVES A CREDIT TO ITS FEDERAL RESERVE ACCOUNT IN THE AMOUNT OF THE DINAR YOU HAVE DEPOSITED… THE DINAR GOES TO THE UST…

Jester] IN THE GROUP RATE SCENARIO… THE BANK RECEIVES A CREDIT TO AN ESCROW ACCOUNT IN THE AMOUNT OF THE DINAR YOU HAVE DEPOSITED… THE DINAR GOES TO THE INVESTOR…

Jester] THE DIFFERENCE BETWEEN WHAT THEY BUY IT FROM YOU FOR… AND WHAT THEY WILL LIQUIDATE IT FOR… THAT IS THE SPREAD… THAT IS THE PART THEY GET TO KEEP… AND THEY ADD THAT AMOUNT TO THEIR CAPITAL ACCOUNT… AND THEY CAN LEND 10 TIMES THAT AMOUNT FOR LOANS OR WHATEVER…

[Jester] NOT A BAD DEAL FOR THE BANK… SURE THEY WANT YOUR BUSINESS… NO DOUBT ABOUT THAT AT ALL… THEY ARE IN THE BUSINESS OF LOANING MONEY TO MAKE MONEY…

[Jester] BUT TO MAKE THE BEST DEAL FOR YOURSELF IT IS ALL ABOUT NEGOTIATING THE SPREAD OR MAKING A DIFFERENT SPREAD SOME OTHER WAY…

[Jester] IN THE STREET AND BANK RATE SCENARIOS… THE NEGOTIATIONS WILL BE BASED ON THE GOING RATE THEY CAN GET FOR THE DINAR… BUT KNOW THEY ALSO WANT TO NEGOTIATE AS BIG A SPREAD AS POSSIBLE FOR THEMSELVES… THEY KNOW WHAT THEY CAN SELL IT FOR… AND THEY CAN ONLY NEGOTIATE SO MUCH… AND THAT IS YOUR NEGOTIATING POSITION FOR YOU WHEN YOU ARE ON YOUR OWN… NOT THAT GREAT… BECAUSE ALL THEY HAVE TO WORK WITH IS THE SPREAD THAT THEY CAN CREATE AS DESCRIBED…

Jester] IN THE GROUP RATE SCENARIO… THE NEGOTIATIONS WILL BE BASED ON WHAT THE NEGOTIATORS IN THE DEAL HAVE ARRANGED IN ACCORDANCE WITH WHAT THE INVESTORS ARE WILLING TO GIVE FOR THE DINAR… NEGOTIATIONS BY PROFESSIONALS WITH A GROUP OVER 100,000 STRONG… WITH AN INVESTOR WITH HUMANITARIAN INTERESTS AS WELL… NOW DON’T GET ME WRONG… THEY WANT THE DINAR… BUT THEY ARE ALSO WILLING TO TAKE CARE OF PEOPLE TO GET IT…

Jester] LET’S TALK ABOUT TAXES… I HATE TO BUT I AM GOING TO TOUCH ON IT… BECAUSE IT DOES HAVE IMPORTANCE TO THE TWO SCENARIOS…

[Jester] TAXES WILL BE ASSESSED ON THE AMOUNT OF THE DEPOSIT PUT INTO YOUR ACCOUNT… NO ONE KNOWS WHAT THE TAX RATE IS… BUT YOU HAVE TO PAY IT SO WHO CARES? IT IS JUST PART OF IT… QUIT TRYING TO FIGURE OUT A WAY AROUND IT…

Jester] YOU PAY TAXES ON YOUR DEPOSIT IN ALL SCENARIOS… IT IS HOW AND WHEN IT IS APPLIED TO THE TRANSACTION THAT IS IMPORTANT…

Jester] IN THE STREET AND BANK RATE SCENARIOS… YOU WILL BE RESPONSIBLE FOR THE TAX LIABILITY AFTER THE FACT… YOU WILL PAY TAXES ON YOUR DEPOSIT AT THE END OF THE NEXT QUARTER AS PRESCRIBED BY LAW…

[Jester] IN THE EMAIL GROUP SCENARIO… THE RATE HAS BEEN NEGOTIATED IN SUCH A WAY AS ALL FEES, SPREADS, COSTS, AND TAXES ARE TAKEN OUT PRIOR TO YOU GETTING YOUR RATE… IT IS TAKEN OUT AS PART OF THE DEAL… YOU WON’T EVEN KNOW ABOUT IT… SO WHAT YOU SEE IS WHAT YOU GET…

Jester] SO TRYING TO MAKE SOME LOGICAL SENSE OF WHAT IS GOING ON... WHAT HAPPENS TO THE DINAR?

[Jester] I STARTED OUT TO DO A VERY LOGICAL EXPLANATION OF HOW IT ALL WORKS... BUT IT GOT VERY COMPLICATED BECAUSE I HAD TO USE A DANG SPREADSHEET TO UNDERSTAND IT MYSELF… AND I DON’T THINK ANY OF YOU WOULD WANT TO SIT THROUGH A DISCUSSION OF THE NUMBERS INVOLVED… AND THIS POST IS LONG ENOUGH ALREADY...

[Jester] SUFFICE TO SAY THAT THE INVESTOR CAN AFFORD TO PAY MORE TO GET THE OIL CREDITS… THIS IS WHERE THE LARGER SPREAD AND THE HIGHER RATE IN THE EMAIL GROUPS IS FORMED… THIS IS WHY THIS SCENARIO IS SO LUCRATIVE FOR EVERYONE… AND IT GETS BETTER…

Jester] SO TO CONTINUE… THEY TRANSFER DINAR TO THE CBI IN THE FORM OF PETRO DOLLARS/PETRO DINAR… AND EVEN THOUGH THE PRICE OF OIL IS IN DOLLARS… THE TRANSACTION CAN BE MADE IN ANY INTERNATIONALLY TRADED CURRENCY AGREED TO BY BOTH PARTIES… SO THEY NEGOTIATE THE PRICE… AND THEY HAVE CHEAPER OIL THAN BUYING IT ON THE OPEN MARKET...

Jester] OH… AND BY THE WAY... IRAQ NOW HAS ITS DINAR BACK… INTERESTING RIGHT? SO WHAT DID THEY GET OUT OF IT?

[Jester] WELL… THEY PRODUCE THE OIL FOR A FRACTION OF THE PRICE OF THE COST THEY SELL IT FOR… SO THEY GET THEIR DINAR BACK VERY CHEAPLY IN COMPARISON TO THE CURRENCY EXCHANGE RATE THEY WOULD HAVE TO PAY IF PEOPLE JUST CASHED IT IN AND THEY HAD TO PAY FOR IT…

Jester] SO THINGS WORK OUT WELL FOR EVERYONE IN THE DEAL WITH THE EMAIL GROUP… YOU GET MORE FOR YOUR INVESTMENT… THE INVESTOR GETS CHEAPER OIL THAN THEY COULD HAVE GOT ON THE OPEN MARKET…. IRAQ GETS ITS DINAR BACK FOR PENNIES ON THE DINAR…

Jester] THAT IS HOW THE EMAIL GROUP WORKS... AND WHY IT IS A GOOD DEAL FOR EVERYONE INVOLVED... INCLDING YOU... THAT IS WHY THEY NEED US IN THIS TRANSACTION NOW...

[Jester] WHEW… I HOPE THAT MAKES SENSE… BUT I HAVE A LITTLE MORE...

[Jester] I AM AWARE THAT SOME HAVE QUESTIONED MY MOTIVATIONS FOR PUSHING WELLS FARGO AND THE EMAIL GROUP… I CAN ASSURE YOU THAT I AM NOT GETTING ANY FORM OF INCENTIVE FROM EITHER… BELIEVE THAT OR NOT… I DON’T CARE… MY MOTIVATION COMES FROM A HIGHER POWER…

[Jester] I AM DOING THIS FOR ONE REASON AND ONE REASON… SO YOU GUYS CAN HAVE AS MUCH INFORMATION TO HELP YOU MAKE THE MOST IMPORTANT DECISION OF YOUR LIFE FOR YOURSELF AND YOUR FAMILY…

[Jester] FOLKS… AS YOU ARE AWARE THERE ARE THOSE OUT THERE PUSHING DEALERS OR TRYING TO FORM THEIR OWN GROUPS FOR THEIR OWN REASONS… FOLLOW THE MONEY AND YOU CAN PROBABLY FIGURE OUT THEIR MOTIVATIONS ARE…

[Jester] SOME OF THE PROMISES I HAVE HEARD MADE FOR RATES JUST MAKE ME SHAKE MY HEAD… IF IT SOUNDS TOO GOOD TO BE TRUE THEN MAYBE YOU SHOULD THINK ABOUT THAT… AND REALIZE THEY KNOW THAT ONCE YOU ARE LOCKED IN WITH YOUR INFORMATION TO THE BANK… YOU ARE LOCKED OUT OF THE EMAIL GROUP RATE…

[Jester] I WILL MAKE A RECOMMENDATION THAT SEEMS TO MAKE SO MUCH SENSE THAT IT WILL SEEM SILLY WITH IT’S SIMPLICITY…

GET YOUR EMAIL… MAKE YOUR APPOINTMENT… AND IF YOU DO NOT LIKE WHAT YOU HEAR WHEN YOU GET THERE… WALK AWAY… LEAVE… SIMPLE AS THAT…

NO ONE CAN FORCE YOU TO CASH OUT AT THAT TIME… GO DO WHAT YOU WANT… ARMED WITH THE PROPER INFORMATION… BUT YOU HAVE TO DO THIS FIRST BEFORE YOU TRY ANYTHING ELSE OR YOU COULD LOSE YOUR PRIVILEGE TO SO AFTER THE FACT…

[Jester] I HOPE THIS HELPS YOU ALL… THAT IS MY SINCERE AND HEARTFELT HOPE…

[Jester] THANK YOU FOR ALL THE KIND WORDS... I AM WORKING HARD FOR YOU GUYS OUT HERE... THAT MAKES IT ALL WORTHWHILE...

Panic In Serpent City - Obozo Dials Putin After Latest Snowden Appearance
Posted By: Watchman

The White House spiraled into panic mode late Friday after Edward Snowden’s earlier appearance in Russia, with President Obama moving forward with plans to personally call Vladimir Putin to urge the Russian president to deny Snowden asylum.
Snowden went public earlier Friday to announce his intention to apply for temporary stay in Russia until he is able to arrange safe travel to Latin America. The whistleblower forcefully defended his moral choice to expose the vast US spying dragnet, declaring “I did the right thing.”
He was flanked by international human rights and civil liberties campaigners, including Human Rights Watch, Amnesty International, and others.
Yet, White House press secretary Jay Carney termed the meeting with renowned human rights groups a “propaganda platform” for Snowden and denounced the Russian government for allowing it to take place, declaring it a move against ‘US interests.’
Furthermore, Matt Williams of the Guardian reports that the US ambassador to Russia even tried to use Human Rights Watch as a tool to send the threatening message to Snowden that, in the eyes of the US government, he is no whistleblower.
The threats and public statements coming from the White House insinuate that those who cross US power should not have access to human rights campaigners.
Yet, human rights groups declare Snowden has every right to human rights protections. Sergei Nikitin, head of Amnesty International’s Moscow office, declared at the Friday meeting with Snowden:
We will continue to pressure governments to ensure his rights are respected – this includes the unassailable right to claim asylum wherever he may choose. What he has disclosed is patently in the public interest and as a whistleblower his actions were justified. He has exposed unlawful sweeping surveillance programmes that unquestionably interfere with an individual’s right to privacy.
Human Rights Watch insisted Friday that Snowden has a legitimate claim to asylum that deserves fair treatment:
“Edward Snowden has a serious asylum claim that should be considered fairly by Russia or any other country where he may apply,” said Dinah PoKempner, general counsel at Human Rights Watch. “He should be allowed at least to make that claim and have it heard.”
The efforts to lobby Putin come after the Obama administration made several personal phone calls to Latin American leaders urging them to reject Snowden’s bids for asylum.

50 plus MPG cars not allowed in the U.S. or Canada

50 plus MPG cars not allowed in the U.S. or Canada

Americans get guilt tripped by their own government for driving huge gas sucking cars. Americans are called wasteful, and are often shown graphs of how much energy they use compared to the rest of the world. But what if the problem is not the American people, but those who govern them?
The following report is intended to be a wake up call for the American people. There are no tricks here, such as quoting imperial gallons, referencing tiny cars, electric cars, or even hybrids. These cars are straight up 50 plus mile per gallon winners which are banned for sale in the U.S., and if you think you can bring one home, think again, in America such cars are allowed a 30 day visit upon crossing the border, after which if they are found on American soil they get impounded and if not immediately shipped out of the country thereafter they are destroyed. The U.S. government quotes as a reason for such behavior that said cars are "not up to American standards". But what about Europe, where they are allowed? European standards are every bit as high as American standards, (BMW vs Ford) but with a simple quote from the government, American people will turn their nose and say if it is not up to American standards we do not want it here. But under all of this is a damning reality - there is nothing wrong with these cars other than the fact that they are too efficient and will reduce corporate profits as a result.

Lets get started

With a combined mileage of 52.8 U.S. mpg and an even higher highway mpg, the Urban Cruiser SUV crossover by Toyota, which is a European version of the Scion XD features front wheel drive for the ultimate mileage and if you are willing to sacrifice and get the 4 wheel drive version, you will suffer in life with a combined mileage of 48 mpg. Al Gore is not happy with this one, so you can forget about it in the U.S.

With a highway mileage of 56 mpg per U.S. gallon, the Nissan Qashqai SUV crossover would be sure to make any carbon tax junkie shiver with dread. Fortunately the American version delivers only 26 highway mpg (22 combined) so the local carbon tax tyrant can rest easy. I would like to ask HOW ON EARTH the difference could be so huge. True, the ultimate mileage is compliments of a diesel engine but that cannot account for such a severe mileage cut. The American version has got to be intentionally detuned to deliver horrific comparable mileage. And that is not the end of it, on E85 fuel which is rapidly being forced on the American people, the mileage drops to an amazingly low 18/23.

Here's a good one

With 78.5 imperial miles per gallon highway, the 1.6 blue motion TDI Volkswagen Passat wagon is definitely forbidden in America, where in the smaller American gallons it would deliver a carbon tax blood curdling 65.4 highway mpg. I never laughed at the 70 mpg carburetor even as a kid. How would that do you on vacation? And even city fuel mileage comes in at over 50 miles per U.S. gallon. Ever see National Lampoons vacation? The car is THAT big. They are flat out banned in America, and if you manage to get one into the states, you will be allowed 30 days to leave with it or it will be impounded and crushed. I looked into this topic, and when it comes to cars like this they really are banned even if purchased elsewhere and really will get taken by the government if you do not get them out of the country on time. Take a look at what an American who rented one of these in Europe had to say when he got home and could not buy one even though they are manufactured in America and shipped out of the country.

And now, the punch line

This is the 261 MPG volkswagen I mentioned a few months ago. Yeah, that station wagon delivering 65 U.S. MPG looks pretty good for an American family, but 261 mpg is pretty tempting. Perhaps I'd spring for it, and certainly if I managed to get one into Mexico it would not get crushed. But don't even think about approaching the U.S. border with this one, if 65 MPG from a large station wagon will get your car taken away by the FED, this bad boy would land you in prison.
It ended up getting ridiculed for only achieving a combined mileage of 160 MPG in U.S. gallons (192 combined in Imperial gallons), but come on now, at that point, WHO CARES. Even at 160 MPG combined, which means the highway mpg is well into the 200's, this particular car exposes the fuel mileage lie so harshly that there is absolutely no recovery or hiding from the truth, even Europeans are getting scammed at 65 mpg while Americans are getting more than raped.
How long are Americans going to continue to tolerate a government that can't even be honest about fuel economy, all the while that same government back stabs the American psyche with illusions of wastefulness? I now feel stupid about even mentioning that 64 U.S. mpg Seat Toledo I did a big write up about earlier. The only reason why I thought that car was remarkable is because I myself had been fooled, that station wagon mentioned above is a whole lot better. And that is not even the best there is. If you take the time to wade through all the censorship, you will eventually discover that there are over 20 full sized cars, including 10 SUV's that get combined mileage figures over 50 U.S. MPG, and that's not counting econoboxes. Even Renault has a 4 door hatch back that gets over 80 combined imperial MPG and pushes well over 100 imperial mpg on the highway. ( Megane expression pictured here.) This equates to 65 US MPG combined, 85 mpg highway, and though it is not a full sized car, it could hardly be called an "econobox".
Americans need to stand up and demand the government to stop censoring search results to prevent Americans from learning the truth elsewhere. Americans need to stand up and call the government on the carpet over the lies that "40 MPG can be achieved in the future" all the while even American car companies such as Ford are producing 65 plus MPG cars for sale on foreign markets right on American soil. It is time to end the lie, and tell these scamming frauds in our government to STICK IT.
If there is any "conspiracy" you could use to wake Americans up, it is this one, these cars are real and not just a bunch of blurry UFO photos. You cannot let the truth slip away on the basis of "the cars not being up to American standards", especially when those standards are forced to include having always on cell connections to every car that can be used to commit murder when the government deems fit as they did in the case of Hastings. There is nothing better about American "improvements" or "standards" that is in any way more beneficial to the people than the European counterparts, and forcing every car to give the government the option to murder via wire is an "improvement" every American can certainly live without. I'd take a fuel economy improvement over that ANY DAY.
