Josh Blackman, assistant professor at the South Texas College of Law says that it(Obamacare) could turn out to be the greatest "legal mulligan in history." The term 'mulligan' is used by golfers to retake a bad shot according to Newsmax. I'm using a little stronger language. Ya'll can fill in the astrisks.
I've watched this all unfold pretty carefully from the beginning and it just goes from, "He did what?" to "WTF?" to "I can't believe I just read that."
A man, who can't prove and no doubt isn't a US citizen, commandeers the most powerful position in our nation. Then after gutting our Constitution and Bill of Rights on a regular basis, rams through (with the help of Democrats and myopic Republicans in Congress)a bill, which no one bothered to read first, a Marxist/Socialist health care bill that would have our Founding Fathers howling in the Halls of Congress.
On top of that, the fossils at the Supreme Court add to the insanity by declaring that Obamacare isn't commerce but a tax so it's okay for the IRS to rape and pillage the citizens. That's the right agency, they've been doing that for years.
Now a judge, Beryl Howell, who by the way was appointed by Barack Obama, dismissed the complaint against the United States Department of Health and Human Services. Senate Majority Leader Harry Reid used a legislative 'trick' and completely rewrote a bill that originated in the House - Service Members Home Ownership Tax Act - and after the first sentence, deleted everything else and rewrote it with Obamacare language to make it look like it came from the House. The original bill had passed unanimously. Really? A bill that was in no way connected to health care? 'Trick' doesn't begin to cover it.
"Judge Howell then went on to say that the Affordable Care Act (Obamacare) was not a bill for raising revenue, or in other words, a tax and ruled that the revenue raised by the bill was 'incidental' to the law and was not covered by the Origination Clause." Hmm, 'incidental - occurred casually.' Does that mean we don't have to pay for it? BTW, the Origination Clause is Article 1, Section 7 of the Constitution which states in part, that "all bills for raising revenue shall originate in the House."
Our Founding Father's didn't trust the Senate to do an adequate job for the people they were too far removed from and at the time were not dependent on for support or votes. Frankly, I don't trust either House to know what the hell they are doing. This just keeps getting more and more screwy.
So, Judge Howell says Obamacare isn't a revenue (tax). The Supreme Court declared that Obamacare was legal BECAUSE it was a tax and therefore the government could enforce and regulate it. Our Constitution doesn't allow the government to regulate non commerce, in other words, people can't be penalized because they don't engage in commerce, don't buy into Obamacare. They declared it was a tax so the IRS can penalize people.
So which way is it? Is it a tax or not? The only sensible thing to do, at this point,is scrap this train wreck before it gets any worse. But, if it's the sensible thing to do, you can count on our Keystone Congress not to do it. Instead, they will try to cobble and patch this bill until it looks like a pair of overhauls from Dogpatch USA.
To recap, the president, trying desperately to back pedal on a hugely unpopular Act, has attempted to rewrite (illegally) a bill that isn't working for the vast majority of citizens, the Senate is rewriting bills that have nothing to do with the health care act in their original form, the Supreme Court is doing their part to allow the citizens to get screwed. And a judge has declared the opposite in order to dismiss a complaint against Obamacare. Could this get any more convoluted - even for politicians/lawyers?
As for you Ms. Winfrey, declaring that "Obama's problems are all about race and that won't go away until all the 'old white people' are gone", race has nothing to do with it. Stupid is stupid no matter what color you are. When I read your recent remarks to my black friends - the ones I marched with in the 60's - they literally howled. This old white woman is very insulted. Try to remember that it was white folks too that helped you climb that ladder of success along side your own efforts.
I for one, am tired of the race card being used every time something doesn't go someone's way or they are criticized for something. Obama wouldn't have made it into the White House on just a block of black votes and you know it. A lot of 'whiteys' voted for him too. But unlike some, I'm not a total idiot. You might fool me for awhile with pretty words and slick promises, but if your actions don't match, I'm done with you. By very early 2010, there was no doubt in my mind that we had been had.
So, the question now is, what do we do about it? The answer comes from a truly great leader, actually a great man. Martin Luther King Jr. Civil disobedience.

Make up your mind.
People wanted to get 'free' healthcare, and everyone else would have to pay for this 'free' thing the people wanted.
Then they got Congress to pass it and the President to sign it. If he refused to sign it Congress would have over-rode him, and the people would be mad at him.

Then the law gets implemented and the IRS is in it with a penalty if you don't sign up.
People find out how much they have to spend for this 'everything is covered' insurance and opt out and find out they are fined for not wanting it.

But others are mad that the web page won't let more people sign up so they can give their bank account info and all kinds of info and find out they can't afford it and opt out and end up in the IRS's pocket.

So they call it a cluster-f*** when it's the most genius thing that could be done.

The people are too ignorant to know what they want, to know when what they get is not what they want, and to know when someone is protecting them from harm.

All they do is listen to and read the posts of people complaining about the man.
If you'd just open your eyes you'd see what you don't see.
Every time someone says Obama is good, a ton of people say they don't see it.
You don't see it because every thing about the man came to you via hearsay and you believe it.
You believe he killed the man on the street, or blew up a car, or knew about some activity because someone in his cabinet knew about it, and you believe the executive orders are against you and that he plans to stack them up to take over your lives.

Well there are US citizens who will run to anyone who tells them how to think. You are programmed so deep you can't even think for yourself or try to see something different that what you are shown.

I do believe we are all sharing different realities interlocked with each other. Some still see chemtrails and a bad man as president and other see no chemtrails and a man trying to do good for the people. He sure can't do good through Congress, they are bought out, but he can do good by his own hand in an executive order. Since he claimed ownership of all things and resources, how the heck can they sell it to China? If he didn't do that, your neighborhood could be owned by them.

Gosh, I'm tired of watching this 'approved' ignorance if the people really want to know, but if they are enjoying their journey down the ignorant hole, well so be it. I may be tired of watching, but like a bad t.v. show, I'll keep seeing it and I do not have a t.v.

You need to wake up and do some research instead of spouting off on something because you "think" it is so! This "free" health care bill...all 2,700 pages of it, was written long before the imposter was even "elected" (or pushed?) into office. Why? Go peddle your propaganda elsewhere.

I don't know what to say. Except you need a lobotomy. Any one that voted for him the first time is stupid, anyone that voted for him the second time is insane, anyone that still thinks he a good guy needs a lobotomy.
