If you’re still wondering if the US Constitution of 1787 failed to protect liberty, then just look around you...
That scrap of parchment is an obvious failure. The US government is the hugest government in the world and meddles in the lives of its citizens (and people worldwide) in every way imaginable. The government accepts no limits on its power whatsoever. The president rules by decree.
This isn’t done under some new constitution. This is all done under the 1787 one. Lots of liberty activists argue that the Supreme Court is just reading the document incorrectly, but one simply cannot deny that virtually everyone in government, as well as most of the general population, is perfectly fine with most of what government does today, and thinks it’s constitutional. If one can plausibly claim that the constitution authorizes most of what the US government does today, then the document’s language is obviously feeble, ineffective, and useless for the purposes of preserving liberty.
Even among those “constitutionalist” types, many of whom are militarists, you’ll find plenty of support for unconstitutional measures such as a standing army, drug prohibition, and other government programs beloved by conservatives, but which are obviously not authorized by the enumerated powers of the constitution.
Rothbard had this figured out a long time ago:
From any libertarian, or even conservative, point of view, it has failed and failed abysmally; for let us never forget that every one of the despotic incursions on man’s rights in this century, before, during and after the New Deal, have received the official stamp of Constitutional blessing.
At a recent meeting of Students for Liberty, John Stossel spoke to some students of Rothbard:
Kelly Kidwell, a sophomore from Tulane University, said, “Regardless of what its intent was, we still have the (big) government that we have now — so the Constitution has either provided for that government, or failed to prevent it.”
Stossel went on:
That’s an argument that libertarian economist Murray Rothbard used to make. He took the pessimistic view that the Constitution’s “limited government” was an experiment that had already failed, since 200 years later, government was barely limited at all. He concluded that libertarians should be not just constitutionalists, but anarchists — get rid of government completely. That idea sounds extreme to me, and to some libertarians at the conference — not to mention the few pro-big-government speakers, like movie director Oliver Stone. But I’m happy that students ask those sorts of questions rather than wondering which regulations to pass, what to tax and whom to censor for “insensitive” speech.
UPDATE: A reader points out this statement from Lysander Spooner:
But whether the Constitution really be one thing, or another, this much is certain — that it has either authorized such a government as we have had, or has been powerless to prevent it. In either case, it is unfit to exist.

ETERNAL VIGILANCE IS THE PRICE OF FREEDOM. ONE MUST REMEMBER THAT THE CONSTITUTION IS JUST A PIECE OF PAPER, BEING THE LAW OF THE LAND OR NOT. IT IS FREEDOM LOVING HUMAN BEINGS THAT TAKE OR DON'T TAKE ACTIONS TO MAKE IT REAL AND WORK. THIS "BEAST" IS NOT ONLY WORLDWIDE BUT MULTIDIMENSIONAL AS WELL. EVIL ALIENS ARE THE REAL CONTROLLERS WHO RUN THE ELITE POWER BROKERS, ALL TO KEEP THEIR SLAVE PLANET UNDER CONTROL AS THEIR "CATTLE" HERD. WE HAVE BEEN THEIR "LIVESTOCK" FOR THOUSANDS OF YEARS. THE WHOLE SPECIES IS ENTERING PLANETARY AWAKENING AND REVOLT, HOWEVER. GOD, THE LANDLORD IS WAXING IN WILL AND POWER AS WELL. HOLD FAST TO TRUST IN THAT AND IN LIFE. OR? GET REAL USED TO BOOT-LICKING AND TRAINING YOUR INNOCENT CHILDREN TO DO THE SAME. IN THAT EVENT I SHALL WITHDRAW BACK TO MY HOME PLANET AND WISH YOU WELL. DON'T EXPECT TO SEE ME EVER AGAIN.
John, This was obviously written by a member of the cabal or a communist ! To say the Constitution is not enforceable ? The Constitution is not a contract ? Why is this CRAP on here ?
No system of human law--no matter how just, fair, effective, or prescient--can withstand the weight of corruption which determined and lawless human beings can bring to bear upon it, over time. Faulting the Constitution is nonsense. We are the problem.
Right laws convey peace and prosperity only to those who abide by them. Those who do not have no business expecting positive results.
There are 2 Constitutions - I1) the original organic Constitution and (2) the one re-written to serve the rogue make believe and totally criminal 'government' that is NOT our TRUE government - the 'constitution' that serves THE UNITED STATES OF AMERICA CORPORATION that has made you and me each a corporation, and upon which we are taxed as a corporation doing business. It is this last 'constitution' that is currently in place. This 'constitution' does NOT protect any American, and until this rogue criminal organization is permanently removed from the lands of America and our Republic restored, you do NOT have a constitution that protects or serves you. United Americans and TAKE YOUR COUNTRY BACK! JUST SAY 'NO' TO ALL THE FRAUD BEING PURPETRATED UPON YOU - INCLUDING THE UNLAWFUL INCOME TAX VIA THE IRS.
I've never seen any evidence of a god, but that doesn't mean there isn't one. Any brief perusal of the old testament portrays a ' god ' comfortable with killing, ordering killing & slavery. Not my idea of the ideal omniscient, omnipotent being who " loves " us. What ' father creator ' would favor some of his children over others that he claims to have made ? At the least, this is horrible parenting, & ordering someone to kill one of their children to ' prove ' his faith is just plain fucked up. I need more than old books and pedophile priests to be convinced and ' on board.' The religion thing has been a murderous tool used by centuries of despots of one kind or another, and has killed and imprisoned more humanity than any other cause. BAD IDEA. How much longer will people flog this horse, despite overwhelming evidence of it's killing nature, before we unhook the reins and just be good people ? Mostly absent is talk of MORALITY. Most know what is right or wrong ( instinct ) and chose either moral or immoral behavior. We don't need any book or god to tell us what's right, do we ? Don't you know, unerringly, what is proper moral behavior without a book ? I bet you do. Humans have handed over our " souls " and hearts since deities and religions were invented. HOW'S THAT WORKING FOR US ? When we are told via hundreds of prophecies something will ' return ' and fix this, this just kicks the can down the road. An internet search for the end of the world prophecies ( that never seems to happen ) will yield all wrong answers ( to date ) and no correct ones. Another bad idea. I'm no more or less ' valuable ' than anybody else, but I'll be damned if I'll hand over myself to unproven entities who have a ' known ' track record of genocidal behavior, and no proof of any good behavior. OK, I could be going to some kind of ' hell,' but isn't that what a FEMA camp really is ? I'm sure Dick Cheney will gladly light the fire. TYJM frj
"...comfortable with killing..." ?
The OT God:
"Say unto them, As I live, saith the Lord God, I have no pleasure in the death of the wicked; but that the wicked turn from his way and live: turn ye, turn ye from your evil ways; for why will ye die, O house of Israel?" -Ezekiel 33:11
"The soul that sinneth, it shall die. The son shall not bear the iniquity of the father, neither shall the father bear the iniquity of the son: the righteousness of the righteous shall be upon him, and the wickedness of the wicked shall be upon him. But if the wicked will turn from all his sins that he hath committed, and keep all my statutes, and do that which is lawful and right, he shall surely live, he shall not die." -Ezekiel 18:20, 21
"For the Lord shall rise up as in mount Perazim, he shall be wroth as in the valley of Gibeon, that he may do his work, his strange work; and bring to pass his act, his strange act." -Isaiah 28:21
The God of the Old Testament was not bloodthirsty. Human beings are. Killing is a strange act to God. But, in a world filled with evil, there are times when it must be done.
If someone was about to rape your daughter, and God struck him dead, what would you feel? Indignation that God would do such a thing? Praise and gratitude for saving your girl?
There comes a time when He must deal finally with evil. Death is part of that sad picture. It is the inevitable final result of sin.
Slavery? Not God's idea--its ours. In the OT He instituted some regulations and laws concerning slavery. This was NOT because He liked it. We did. But, in mercy, He started an opening whereby the practice was a little bit less awful than what was being done elsewhere in the world.
Newborn children can't run immediately; they learn to crawl first. Wicked human cultures cannot be transported instantly into full "light". They must take steps, as God leads them.
To anon 1:41 AM -- See Council of Nicaea for some of the beginnings of biblical editing, which continues today, unfortunately corrupting the ' word of god, ' assuming it ever was. I'm continuously amazed how many like yourself claim to know what ' god ' feels, knows or thinks, you being a mere mortal, and far and away the most irritating assumption from bible thumpers. Test your faith, youtube 3 or 4 ACA shows, especially with Matt Dillahunty as host. They can point out ' scripture ' describing exactly what I pointed out above at 9:14 PM ( slavery & killing ). I've never considered the bible more than a hyper edited Vatican owners manual, bereft of provable origins, and hardly worthy of serious examination. You seem well intended, but blind to what your old testament actually says, your apologist & arguments from ignorance notwithstanding. TYJM frj
