There may be another step in this matter, i.e., the Supreme Court. As it presently stands, there's one more case confirming that the police have no authority to prevent an individual from the use of his/her camera. This time, Guam officials intended to destroy the evidence preserved by that man's camera. Thing is, it may be that no matter how great an award damages may be ordered, he still doesn't have his cell phone or the pictures.
In other words, the destruction of evidence may continue, but if the bean-counters get a say in the practice, we can hope their perspective is that such destruction of evidence is beyond the department's budget to be able to afford.

The concept to illustrate is that the notion of simultaneously uploading has been around for a while.

The point is that where one expects to need to use a cell phone for keeping evidence, having access to an application that posts "instantly" may still be necessary technology for so long as the "authorities" continue to charge criminally those intending to preserve evidence.

So the Guam Police destroy the picture files, and possible the cell phone camera.
So What evidence do they have now for a case?
Is it from their own word that is reliable?
So on that camera was evidence that another crime was being committed and that the Police destroyed that evidence?
One after another the Guam Police committed numerous violations that their case will NOT stand up in court!
