Talk about fundamental judicial power, this one challenges such authority to the core of that system.
It doesn't matter that the judge is 100% practical in this matter. It's a question of judicial power. There's no question it's a very good idea, but does that mean that the court has the authority to do it?
Can't help but feel at a loss in favor the child saddled with parents with that kind of an idea about a name! But, judicially assigned given names, where that's not a request of any party, no matter how incompetent the parent's (parents') choice, may very well cross a line.
If not, then we'll have that much more confirmation of the STATE's "ownership" authority over children involved in legal matters. (Would the STATE have the authority if there were no court matter? Nothing is mentioned about a marriage "license" or a divorce in this piece.)
We'll have to follow this case as it progresses to see how TENNESSEE handles this.
